WASTE HANDLING FACILITIES INFORMATION

As an integral part of our services, we collect industrial wastes from customers and transport such wastes to and between our facilities for treatment or bulking for shipment to final disposal locations. Once a week, or more frequently, depending on waste volumes received, our 10-day transfer facility located in Kent, WA and Clackamas, OR will collect containerized waste throughout the State of Washington and Oregon and transfer onto a truck bound to one of our Primary Recycle, Transfer, Storage and Disposal (RTSDF) facilities – see Waste Handling Facilities. Here the waste will be treated onsite or will be transferred, temporarily stored and/or consolidated for more efficient transportation to an approved Final RTSDF site identified in our proposal. The final RTSDF chosen will be based on the waste profile acceptance and will follow the waste management method specified in the bid specification. Our central logistics center monitors all waste movements in real-time and ensures the most efficient routes are taken, which reduces the overall cost of waste transportation and liability

Waste Handling Facilities

Clean Harbors is the largest operator of non-nuclear hazardous waste treatment facilities in North America based on recent industry reports. With over 50 company-owned and operated waste management facilities in the U.S. and Canada we offer the most comprehensive hazardous and non-hazardous waste disposal services. We operate in aggregate, the largest number of incinerators, hazardous waste landfills, wastewater treatment facilities and RTSDFs in North America. This kind of treatment capability allows us to internalize a greater volume of waste, which reduces cost and protects our customer’s liability.

Below is a summary of our proposed Waste Handling Facilities and the waste management method that may be used in performance of this contract. As the world’s most comprehensive waste services company, Clean Harbors owns and operates most of the transfer, storage, and Final treatment/recycling/disposal facilities that will be utilized in the performance of services under this Contract. Over eighty (80%) of the states’ waste will be treated within Clean Harbors owned-operated RTSDF’s. This internalization of the management of wastes keeps the State’s associated liabilities with one company.

Clean Harbors anticipates the limited use of third-party disposal outlets for final disposal. While we try to manage as much waste within our own company, other subcontractor facilities are utilized because they either have specialty recycling needs, i.e. mercury retort, metals recovery, etc. not offered by Clean Harbors or, due to there physical location and, or capabilities can offer economic benefits to our Customers.

All our own in-house and subcontractor TSD facilities have gone through an extensive audit review by our corporate compliance team and have been determined to be operating in compliance with all local, state and federal statutes, regulation and by-laws and are financially and responsibly stable.

As mentioned, Clean Harbors has served the State of Washington through the State of Wisconsin statewide contract since 2005, and even earlier through previous ownership Teris. The reason the partnership between Clean Harbors and the State has endured is primarily due to trust. The trust exists because Clean Harbors has demonstrated that we have the dedicated resources, experience, vast array of services, logistics and liability protection that the State needs and desires to provide exemplary services and protect the State against the myriad of liabilities associated with hazardous waste collection, packaging, transportation and recycle / disposal.

Maximizing Clean Harbors Disposal Outlets

Reducing liability begins with knowing where your waste materials are being treated or disposed. Many other vendors find it necessary to broker your waste and liability to other companies for final disposition, because they simply don’t own the final treatment/disposal outlets. We have the most extensive collection of incinerators, landfills, treatment facilities and RTSDFs in North America. Our broad network enables us to effectively handle a waste stream from origin through disposal and to efficiently direct and internalize our waste streams to reduce your liability. Based history and the management method chosen, Clean Harbors can be your Final RTSDF for over 85% of your hazardous waste.

Improved Security

Since 9/11, security has become an even higher priority in the industry. Clean Harbors has developed a new Transportation Security Program and is currently in the process of upgrading all alarm systems at all of our facilities across North America.

Uninterrupted Service:

Clean Harbors offers the state access to what no other company can - the nations largest commercial incineration capacity and the nation’s largest incineration facility network. Clean Harbors owns five of the 12 major hazardous waste incineration facilities in North America. This national system can best meet the state’s requirements by flexibly responding to specific stream volumes and treatment needs. The majority of the state’s waste will be incinerated at our RCRA hazardous waste incinerator in Aragonite, UT or Kimball, NE. Compliance/Health & Safety

We regard compliance with applicable environmental regulations and the health and safety of our workforce as critical components of our overall operations. We strive to maintain the highest professional standards in our compliance and health and safety activities. Our internal operating requirements are in many instances more stringent than those imposed by regulation. Our compliance program has been developed for each of our waste management facilities and service centers under the direction of our corporate staff. The compliance and health and safety staffs are responsible for facilities permitting and regulatory compliance, health and safety, field safety, compliance training, transportation compliance, and related record keeping. To ensure the effectiveness of our regulatory compliance program, the Compliance organization monitors daily operational activities and issues a monthly report to senior management concerning the status of environmental compliance and health and safety programs. We also have an Environmental Health and Safety (EHS) Compliance Internal Audit Program designed to identify any weaknesses or opportunities for improvement in our ongoing compliance programs. We also perform periodic audits and inspections of the disposal facilities of other firms utilized by us.

Our facilities are frequently inspected and audited by regulatory agencies, as well as by customers. Although our facilities have been cited on occasion for regulatory violations, we believe that each facility is currently in substantial compliance with applicable requirements. Major facilities and service centers have a full-time compliance or health and safety representative to oversee the implementation of our compliance program at the facility or service center. These highly trained regulatory specialists are independent from operations and report to the Senior Vice President of Compliance and Regulatory Affairs, who ultimately reports to the General Counsel.

Clean Harbors takes pride in the success of our accident prevention activities and the fact that our safety performance far exceeds others in the hazardous waste industry. The Company’s stellar performance is evidenced in the context of the impressive experience modification ratings (EMRs) received by Clean Harbors’ for 2015-2016. All States: 0.67

Intellectual Property

We have invested significantly in the development of proprietary technology and also to establish and maintain an extensive knowledge of the leading technologies and incorporate these technologies into the environmental services that we offer and provide to our customers. We currently hold a total of three patents and 15 trademarks in the United States, and we license software and other intellectual property from various third parties. We enter into confidentiality agreements with certain of our employees, consultants and corporate partners, and control access to software documentation and other proprietary information. We believe that we hold adequate rights to all intellectual property used in our business and that we do not infringe upon any intellectual property rights held by other parties.

Management of Risks

We adhere to a program of risk management policies and practices designed to reduce potential liability, as well as to manage customers’ ongoing environmental exposures. This program includes installation of risk management systems at our facilities, such as fire suppression, employee training, environmental, auditing and policy decisions restricting the types of wastes handled. We evaluate all revenue opportunities and decline those that we believe involve unacceptable risks.

We dispose of waste at our incineration, wastewater treatment and landfill facilities, or at facilities owned and operated by other firms that we have audited and approved. Typically, we apply established technologies to the treatment, storage and recovery of hazardous wastes. We believe our operations are conducted in a safe and prudent manner and in substantial compliance with applicable laws and regulations.

Insurance and Financial Assurance

The following insurance information is a brief outline of the current Clean Harbors Casualty Program. It is intended to be used as a reference only, and does not attempt to provide a full description of conditions, premiums or policy stipulations.

Clean Harbors’ Insurance Program, inclusive of Safety-Kleen Systems, Inc., is managed through the Corporate Risk Management Department utilizing the brokerage services of Willis North America, Inc. All policies are purchased with Clean Harbors, Inc. as the named insured. Subsidiaries of Clean Harbors are insured under the Broad Form named insured endorsement. Additional information regarding the names of the insurers, expiration dates and policy numbers will be provided upon request.

Financial Assurance

The attached letter is provided to confirm Clean Harbors Environmental Service has the financial assurance to meet and exceed the $250n000 performance guarantee.

Closure / Post Closure Financial Requirements

The company is required by law to provide financial guarantees to state and federal agencies for Closure and Post Closure costs associated with company owned TSDFs. These requirements are met through the use of surety bonds and insurance. A copy of the financial mechanism used to meet these requirements can be furnished upon request.

The following documents contain detail information about each Final RTSDF that may be used in performance of this contract as identified in the Waste Handling Facility Summary Table. We believe we have included all the information requested. If information is unavailable, it was unintentional on our part, and will be made available upon request.

For ease of evaluation, Clean Harbors has provided a separate binder for the Waste Handling Facilities Summary Table and Waste Handling Facility Information Sheets. Per the Q&A[1], Q.22, and to reduce paperwork, we have elected to provide the Waste Handling Facility Information Sheets and supporting documents on an electronic copy USB Flash Drive.

Note: Due to the extensive number of requests for similar questionnaire documents and the amount of time and paperwork involved in completing these forms. Many companies have developed “Audit Packages” in response to such requests. The audit packages are quite complete and were developed to a level of detail to end the practice of completing questionnaires. For your convenience, we have referenced the section in the audit package to help identify the area in question. If you are unable to locate the answer to a specific question(s), please contact the facilities Environmental Manager or contact the Account Manager identified on the cover page of this bid document and he/she will entertain those.
