FACILITIES PROTECTIVE SERVICES FOR CP VANCE / CP MONTRONDSTATEMENT OF WORK06 APR 11PURPOSE: The Combined Joint Special Operations Task Force (CJSOTF-A) headquartered at Bagram Airfield, Afghanistan, is a Joint Special Operations Task Force leading the Global Counter Terrorism Forces (GCTF) in Afghanistan. In order to ensure unit readiness and mission capability, the CJSOTF-A seeks to contract Security Guards at locations (firebases, village stability platforms, etc.) and facilities throughout the Area of Operations currently occupied by United States Special Forces (USSF) supporting Afghan and Coalition Forces. The intent of this initiative is to prevent unauthorized access, perimeter incursions, and surveillance activities against Afghan and Coalition Forces. Upon award, the Government intends to encourage a teaming relationship between the Government and the Contractor to address daily operations and unexpected contingencies.OBJECTIVE: The contractor shall perform security functions at CP VANCE / CP MONTROND. Through the combined efforts and effects of established procedures, Security Guards, and the use of security-related equipment, the primary objectives of this Guard Force are: To detect, identify, report, and guard against threats related to unauthorized personnel, contraband, and instruments of damage, destruction, and information collection from entering the installation through the Entry Control Points (ECPs), Perimeter Towers, Observation Points (OP) and Checkpoints (CP); To conduct surveillance and counter-surveillance of the installation perimeter, avenues of approach, likely indirect-fire locations and vicinity from designated Perimeter Defensive Positions (PDPs) in order to prevent unauthorized personnel from gathering information or illegally entering the installation; and To employ appropriate force to neutralize any threat from unauthorized individuals illegally attempting to enter the installation with the intent to harm personnel or damage facilities and equipment. LIMITATIONS: Security guards are not allowed to engage in inherently governmental activities. An inherently governmental activity is any activity that is so intimately related to the U.S. public interest as to mandate performance by Government personnel. These activities require the exercise of substantial discretion in applying Government authority and/or making decisions for the Government. Inherently governmental activities in a combat environment include those activities that require discretionary judgment that commits the U.S. Government to a course of action, such as deciding who or what to attack or search. Any activity that requires more than a response in self-defense to a hostile attack is inherently governmental. Some authorized activities may become inherently governmental when there is a high likelihood of hostile attack. The Contractor recognizes that a Security Guard is a non-combatant and cannot take part in combat or combat-like activities to include law enforcement activities. Combat or combat-like activities and law enforcement activities include, but are not limited to, quick reaction force, reconnaissance patrolling, cordon and search operations, acting as an observer or spotter for indirect fire operations, and route clearance operations. The Contractor understands that Security Guards may participate in certain non-combat activities such as static guard duties at U.S. Government facilities – including gates, walls, observation outposts, and towers. The M9, M4, M16, or equivalent (e.g., .45 CAL, AK-47) are the standard weapons used for personal security and protection. Other weapons systems may be requested and approved on an individual, case-by-case basis when applied for by the sponsoring command to the Armed Contractor Oversight Division (ACOD) in coordination with J-3 Force Protection.DESCRIPTION OF SERVICES: Utilizing indigenous personnel from the area surrounding the performance location, the Contractor shall provide internal security for CP VANCE / CP MONTROND. Security shall include defending all equipment, personnel, and property, whether military and/or civilian in nature as contained therein. Contractor shall provide all labor, weapons (minimum of one (1) weapon per person), ammunition, protective body armor, helmets, uniforms, secure communications, night vision devices, and other operational equipment to perform facility protective services at the above listed sites. For towers, night vision devices shall be static while roving patrols shall have individual type devices (each roving patrol member is required to have their own device). Contractor shall ensure all equipment is functional and has batteries or other required accessories to ensure the equipment operates and functions as designed. Contractor shall ensure its personnel are trained and equipped and have previous military, guard, paramilitary and/or police experience. Contractor shall provide management personnel who are capable of interacting, conversing, and/or acting as liaisons with their US Government counterpart personnel. Security guards shall maintain a high level of security for all internal, entry control point, exterior checkpoints, and perimeter security operations to include, but not limited to:Manning ECP – Maintain Installation Security. Searching personnel and vehicles entering and leaving the installations to deny the introduction of unauthorized weapons or contraband, to prevent theft of U.S. Government Property and to ensure only authorized personnel gain access.Manning Guard Towers, Checkpoints and other static positions 24 hours a day, 7-days a week, for the duration of the contract. The Contractor shall report any unusual incidents and repel any attempted attack or breach to the Base Defense Operations Center (BDOC) Commander and COR.Security sweeps – Daily periodic checking of the interior perimeter defenses, other areas inside the installation as specified, and outside of buildings and structures as specified by the BDOC Commander. Security sweeps are not authorized outside the perimeter of the performance location.Assist with minor Force Protection upgrades – Assist in any relocation or improvements to the force protection equipment at guard positions (i.e. move jersey barriers, replace damaged sandbags, repair positions, replace/emplace concertina wire, etc).Evaluate Force Protection Requirements – Assist in the evaluation of force protection requirements and security requirements to include protective and defensive measures at the ECPs and towers and provide recommendations to the BDOC on any deficiencies, weaknesses, or conditions which would interfere or limit their ability to ensure security at the various points around the OP.Escorts for local national workers.While on duty, all guards shall have a minimum basic unit load of 150 rounds of ammunition on their person if assigned an AK-47, 210 rounds of 5.56mm ball if assigned an M-4 rifle, and 30 rounds of pistol ammunition. Ammunition shall not be modified any way that will cause it go further or do more damage to personnel. Modifications include but are not limited to crossing the ammunitions tips, drilling the center of the bullets to make it similar to a hollow point round or adding additional powder to the casing to increase performance/distances in accordance with USFOR-A FRAGO 09-206, Attachment 1, Paragraph 7 and as updated.Contractors must understand that the Afghan Security Guards SHALL NOT aim or point their weapons at U.S, Coalition, or Afghanistan National Security Forces.? During the post award conference, the, Contracting Officer, the Base Defense Operations Center (BDOC) Commander, the Contracting Officer Representative, and Contractor will develop the process for dealing with U.S. or coalition forces on the OP itself in conjunction with the installation commander’s order.? This Standard Operating Procedure (SOP) will address what the contractor shall do if U.S. or coalition forces personnel on the OP do not follow the orders/direction of the Contractor. It shall be emphasized that they shall not shoot or otherwise harm U.S. military or civilian personnel but must instead report them to the proper Command authority as outlined in the SOP. In addition, the COR shall report all violations to the Contracting Officer.CONTRACTOR RESPONSIBILITIES AND KEY PERSONNEL: The overall objective for the Contractor is to provide management, training, and quality assurance services for the contracted local Afghanistan Security Guards at each designated location, in accordance with the contract, this Statement of Work, and USFOR-A FRAGO 09-206. It is essential that in the course of its activities, the Contractor take all steps necessary to ensure a compatible interaction with local contracted personnel and to grant all due consideration to local customs, culture, and community, including deference to community hierarchy for the local area in which these services are provided. KEY PERSONNEL: The contractor shall identify and provide acceptable qualifications for the following individuals that the Contractor intends to utilize in the performance of this contract:The contractor shall provide a Site Manager (or appoint a Shift Manager as Site Manager depending on the size of the force) at CP VANCE / CP MONTROND, that is a U.S. citizen with prior U.S. military service, who separated/retired from the military on honorable terms. The specific shift shall be determined through coordination between the Site Manager and COR. The Site Manager shall be fluent in the English language (written and spoken) and shall be responsible for overall contract performance at this specific location to include logistics, management, training, and all other duties required to meet contract requirements. The contractor shall provide Shift Supervisors, who are fluent in the English language and shall represent all members of the Security Guard on each work shift. If the Security Guard Supervisors are not fluent in English and able to speak any of the following languages, Pashto, Dari, Urdo, Pashiae or Farsi, the contractor must provide an interpreter that is available at all times. The Site Managers and Shift Supervisors shall interface directly with the designated Contracting Officers Representative (COR). CONTRACTOR RESPONSIBILITIESWhen applicable, the contractor shall maximize the employment of incumbent guards at each location. To do so, the contractor shall give the right of first refusal to 100% of the incumbent workforce including supervisors and site managers. Additionally, the contractor shall hire a minimum of 75% of its guard force from within a 50-kilometer radius of the location requiring security; subcontracting opportunities shall also be afforded to those companies within 50 kilometers of the location requiring security. If subcontracted, the subcontractor shall be appropriately licensed and registered with the Afghanistan Ministry of Interior and Ministry of Trade. Additionally, a SF 1413 shall be completed and provided to the Contracting Officer along with proof of licensing/registration. At the very least, all guards recruited and subcontractors shall come from the local population where the sites are located; however, contractors may not recruit exclusively from a single village or tribe. Guards and subcontractors recruited from outside of the site region shall be approved by the Contracting Officer on case-by-case basis. In addition, Tribal Elders acceptance or “by in” of hiring plans and subcontracting plans is essential to the success of the security operations in areas surrounding the installations where the services shall be performed. The intent of this is to retain stable, civil cooperation with the local political figures within the region to sustain high levels of force protection. The nature of work shall be to provide static security and related services as described herein:The specific purpose of the Security Force shall be to augment the existing installation interior and exterior security by providing 24-hour security of individually specified locations in support of an integrated base defense plan.The Site Manager shall ensure that their guards are integrated into and participate in the military installation/facility security plan as provided by the COR.The Contractor agrees to implement a regular maintenance program for all Security Guard weapons. Pursuant to this program, all weapons shall be checked and cleaned periodically. Security Guards have the obligation to ensure that their weapons are in proper working order at all times. Security Guards shall conduct daily function checks on all assigned weapons prior to assuming duties. If an employee has knowledge that their weapon is not in the proper working condition, the employee shall immediately report to his Security Guard Supervisor for immediate repair and/or approved replacement within 24 hours.The Site Manager shall ensure the guard force undergoes quarterly qualification. The Site Manager shall be responsible for ensuring each Security Guard is trained on safe handling of firearms at all times. The number of hours of proficiency training shall be specified by the Site Manager. The Site Manager shall afford each Security Guard the opportunity to have at least two (2) practice sessions prior to any formal re-qualification test. Each Security Guard shall be given at least three (3) opportunities to qualify, at least one (1) of which must be prior to the expiration of their qualification. If the employee is unable to qualify prior to expiration of his qualification, the employee shall be suspended without pay. Such employee(s) shall be re-instated if re-qualifying occurs within thirty (30) days of the suspension. If the employee does not re-qualify during the thirty (30) day suspension, such action shall be considered a voluntary quit. The training must be documented in writing for each Security Guard and be maintained in accordance with paragraph 5.9 below.While armed, Security Guards shall carry proof of authorization to be armed with firearms. Arming requirements and reports are in accordance with USFOR-A FRAGO 09-206 and respective attachments/enclosures. Absent specific authorization, Security Guards shall not carry firearms concealed. It is the responsibility of the U.S. Government to provide proof of authorization to be armed via the Contracting Officer’s Representative (COR). Proof of security guard authorization to be armed shall be the issuance of the permanent installation access badge that cannot be issued without a letter of authorization from the ACOD and USFOR-A, in accordance with DODI 3020.50 and authorization from USFOR-A J4 requirements. The COR shall not authorize a permanent installation access badge without proper documentation of training, qualification, medical screening, biometric registration, or contractor arming authorization. Upon termination of employment or this contract, all employees must immediately turn their installation access badges in to the COR. The contractor shall provide payment to all guards no later than the 5th day of each month. A by-name listing of personnel not paid and/or not paid in full (along with an explanation of how much and why) shall be provided to the COR no later than the 10th day of each month. Monthly payroll records, in English, shall be maintained with each employee’s signature to validate payments made to each guard. All pay records shall be made available to the COR and/or the Contracting Officer immediately upon request. Afghan guards shall not be paid more than wages of an equally rated Afghani National Security Force member. Each security guard shall receive adequate pay to retain them as an employee; receive an adequate cost of living increase for each year that they work under any given contract. Contractor shall be responsible for maintaining an on-hand supply of ammunition appropriate to the local threat and rate of consumption. SPECIFIC TASK DESCRIPTION: TASK 1: Facility Guard Manning Requirements.Contractor shall provide the appropriate number of personnel to man designated positions on the performance location, as specified in annex C, on a 24 hour/7day a week basis or as otherwise directed by the COR. Duties include, without limitation, manning ECPs, tower guards, checkpoints, and other static positions; conducting vehicle and personnel searches; conducting security sweeps inside the installation, and assisting with minor Force Protection upgrades with in the immediate vicinity of the perimeter. Positions may be adjusted based upon Force Protection requirements and threat. However, total manning numbers required shall remain no less than what Annex C requires. Supervisors/Site Managers shall be included in the manning requirement. ** No contractor employee shift shall be longer than 12 hours in any given 24-hour period. Should any tower which indicates one guard per shift also be manned by a US/Coalition Soldier, the contractor will not need to provide equipment for communications to the Base Defense Operations Center (BDOC). The US Government will provide communication to these towers. The contractor shall provide secure communication to all other towers as well as to all other positions, guards, escorts, and patrols. Contractor’s secure communication architecture must allow for not only communication between its employees and supervisors, but must also tie directly, but independently, into the BDOC. The intent is not to have the contractor provide military grade, single channel, frequency hopping, communications but to have the contractor provide a secure communication infrastructure to tie an entire security force together with an independent feed to the BDOC. All communication equipment provided by the contractor shall be approved by the COR and local BDOC. Where required, communication equipment must be compatible with US and Coalition Forces existing radios or the vendor must provide sufficient equipment to provide an interface to the BDOC communication network. If required, a detailed explanation of the communication requirement can be discussed during the post award conference. TASK 2: Management. The Site Manager shall be capable of acting as liaisons with Government staff and the BDOC. Contractor shall ensure the Site Manager is on-site and responsible for overall contract performance at that specific location to include logistics, management, training and all other duties required to meet contract requirements. At a minimum, the individual must be able to fluently speak and write English. The Site Manager shall coordinate and staff security details after conferring with BDOC commander. The Site Manager is required to attend scheduled and unscheduled briefings, meetings, and submit reports as required. The Site Manager shall coordinate and staff security details after conferring with BDOC commander. The contents of each report will be discussed and agreed upon at the post award conference with the COR to establish reporting procedures that are consistent with the locations SOP’s. At a minimum, the following reports shall be submitted to the COR and the Contracting Officer addressing:Security Status (Daily)Communication Status (Daily)Unusual Incident Report (To be reported as required, when incident occurs)Weapons, Law of Armed Conflict (LOAC), Rule for Use of Force (RUF), Rules of Engagement (ROE) Training and Qualification Status (Quarterly)Weapons, Ammunition Status (Daily)Force Protection Assessment Report (Weekly)Vehicle Report (Daily)Facility Report (Weekly)Termination/New Hire Report Fuel consumption report (twice a month)Monthly Arming Status Report (IAW USFOR-A FRAGO 09-206) Initial report due 14 days after personnel begin duties at contracted location6.2.2.13. Monthly reports shall be completed and turned in to COR and Contracting Officers not later than 25th day of each month. Census format shall be provided by COR or contracting officer.6.2.2.14. Format shall be as directed by USFOR-A.6.2.2.15. Bio-metric enrollment (Initial employment of contractor employees, within 14 days of initiating employment, one-time requirement)6.2.2.16. Individual Arming Authorization Packages (Initial employment of contractor employees, within 30 days of initiating employment, one-time requirement)Contractor shall not replace the Site Manager within the first six months of the contract and without 30 days notice to the Government. The Government reserves the right to approve any replacements to the specified Site Manager. The Government also reserves the right to request immediate replacement of the Site Manager at any time. Arms room. The Government shall provide a connex or other securable container for the contractor to use as an arms room to store and maintain all weapons. The Government shall provide a separate storage facility for all ammunition when not in use. Contractor shall manage issuance and storage of all weapons and ammunition in arms room and storage facilities. Contractor shall establish a records accountability system to track all weapons and ammunition. The COR will inspect the arms room and accountability records on a monthly, or no-notice, basis. Contractor personnel shall secure their weapons while off duty. Guards that are on duty shall not leave their weapon unattended/unsecured.TASK 3: Training. As a minimum, training must include:Weapons. Contractor shall provide individual weapons familiarization training for all personnel who shall carry weapons under this contract to include sighting on each individual’s weapons. Training shall be accomplished to Army weapons qualification standards. This training shall be specified and the standard monitored by the COR. Weapons training shall be documented on weapons qualification forms DA Form 88-R and DA Form 3595-R or such records or forms that may be specified by the COR. Contractor shall provide a by-name roster with the attached documents prior to allowing any of its personnel to assume their duties. To ensure personnel remain qualified under this contract, this training shall be conducted a least once every three (3) months. Contractor shall be permitted access to use established weapons ranges. They shall be required to coordinate use of ranges IAW established OP procedures and following all existing SOP while on the range. TASK 4: Screening of Personnel. The Site Manager and Shift Supervisors that are former military personnel must have been honorably discharged from the military or possess the equivalent honorable discharge from their nations military. All former police officers shall provide proof they were not discharged or resigned for misconduct. No personnel can be hired from any of the countries listed on the OFAC’s List of Specially Designated Nationals and Blocked Persons as listed in FAR Clause 52.225-12. Contractor personnel that are identified as a threat shall be immediately terminated by the Contractor, and at a minimum, the individual will be removed and barred from post. The Contractor shall, within fifteen (15) calendar days of a change in personnel, provide the Contracting Officer and the COR the documentation on all additional and/or replacement personnel. The contractor shall coordinate and provide completed TF Spotlight/ACOD required Individual Arming Authorization Packages for each armed contractor employee within 30 days of initiating employment to the COR and the Contracting Officer. The COR will route these packages through TF Spotlight/ACOD as necessary. The arming package format shall be in accordance with USFOR-A FRAGO 09-206, Attachment 1.TASK 5: Life Support. Unless specifically stated otherwise in this SOW, any life support requirements that arise are provided by the contractor. The contractor must comply with 29 CFR 1910.142, Temporary Work Camp Standards, US CENTCOM Regulation 415-1, The Sandbook, as well as US Army, and subordinate command regulations and orders for life support standards. The US CENTCOM Sandbook, US Army, and subordinate command regulations and orders for life support standards shall control over 29 CFR 1910.142 in the event of conflicting requirements or standards.Billeting/Office Space: The Government will provide buildings with electrical, plumbing (where applicable) and HVAC for billeting of Contractor personnel and office space for command and control during the length of the contract. Contractor shall be responsible for all office equipment and supplies necessary to run their command and control operation. Contractor shall supply necessary living items such as bedding, beds, and furnishings as required to accommodate its personnel. Contractor shall be responsible for procurement of items to properly equip personnel to effectively complete required services. Contractor shall be responsible for all facility cleaning of provided buildings and any damage caused other than fair wear and tear. The contractor shall provide all cleaning supplies and equipment for cleaning of the living compound(s). Any electrical, plumbing or HVAC services, repairs, or installations shall be made by the U.S. government or U.S. Contracted personnel. The intent is to ensure safety and compatibility of billeting/office space to the rest of the installation in which security services is being provided. The COR will conduct a monthly inspection with regard to the billets adequacy and availability of life support and inform the contractor as to any corrective action as necessary. Dining Facilities and Water: Contractor personnel shall not be permitted to eat in US Government dining facilities. The contractor shall provide all meals and eating utensils for the security guard force. The Contractor shall be responsible for the transportation of meals. The Contractor shall be responsible for transportation of the meals to the feeding sites. The Government will provide bottled water for the guard force. The Government will allow all Common Access Card holders to eat in the Government dining facility. Intra-Installation Transportation: The Government shall not provide the Contractor and its personnel with any transportation assets to accommodate the movement of personnel. Internal movement of personnel to their respective duty stations shall be the responsibility of the contractor and conducted in coordination with BDOC. Contractor vehicles must be distinctively marked so that they are distinctive from U.S., Afghan or Coalition Vehicles.Uniforms, Equipment, and Weapons: Contractor shall provide at least two (2) complete sets of uniforms every 12 months (to include boots) to each guard, weapons, body armor, ballistic helmets, ammunition, and other individual equipment as required to include appropriate gear/clothing for the season. Contractor shall designate a company uniform or dress code in accordance with Government of the Islamic Republic of Afghanistan (GIRoA) law that is distinctive from US, Afghanistan, or Coalition Forces uniforms. Contractor’s uniform must be recognizable on sight and properly worn throughout the course of each person’s duty day. Uniforms shall not be of a camouflage nature. The uniform must be marked with a clearly visible sign/logo of the employing company. Personnel shall comply with the installation commander’s dress code. Contractor is responsible for providing and maintaining any equipment necessary to complete the tasks outlined in this SOW. Contractor shall provide communication to any tower not manned by a U.S./Coalition soldier. Contractor shall be responsible for providing laundry services. Unless otherwise directed by the COR or Contracting Officer, all required equipment, weapons, and uniforms are required to be prepared, function checked, and ready for use at the site prior to the first day of the period of performance.MWR/PX/Fitness Center. Only CAC holders shall be permitted access to these facilities. DoD-issued Common Access Cards (CAC). Only the minimum essential personnel shall be permitted to have a CAC issued. The COR shall be responsible for ensuring that all CAC requests are legitimate and necessary before approving the application for this privilege. Should a CAC card be issued to a contractor employee, upon termination of employment or of this contract, the employee shall immediately return their CAC card in to the issuing office. All contracted personnel shall maintain their area of operation free from refuse and human waste. This includes all guard posts, towers, all immediate work areas as well as living areas. All Contractor generated refuse shall be properly disposed of and transported to Base Ops contracted waste containers daily. The Government will provide trash removal and black and grey water septic removal service. The intent of trash control is to prevent unsanitary conditions that could lead to vector control issues. Vector control prevention is the responsibility of the contractor but vector control measures are the responsibility of the Government. Unsanitary living conditions leading to vector control issues may lead to reimbursement of the Government for vector control costs. Guards shall conduct training on a regular basis to include: Physical fitness training, weapons training, communications training, and Security Guard training.Guards shall also be expected to maintain their personal uniforms, haircuts, and weapons in accordance with standards established by the Security Guard Supervisor but under the overall supervision and direction of the commander each location. TRAVEL: Contractor shall provide all required transportation to include all maintenance and replacement of vehicles, except JP8 and MoGas fuel. Contractor shall provide its own transportation and security to move between installations, if necessary. This includes independently procured transportation to/from the site for mobilization/de-mobilization, employee payment, equipment replacement, etc. Contractor shall be permitted to move within existing US Government convoys, but no convoys will be established for the express purpose of supporting the contractor’s movement of personnel or equipment, nor shall any member of the contracted security force participate in the security of such a convoy. Due to security reasons, Contractor personnel shall not be permitted to bring privately owned vehicles onto locations. Contractors may be able to fly space available on military air, at established rates, if available and agreed upon with the Contracting Officer. U.S. Government convoys and space available on military air are not to be considered the primary source for the contractor movement (mobilization/de-mobilization, employee payment, equipment replacement, etc.). Any delays as a result of the use of such movement methods shall not be considered at the fault of the U.S. Government, nor shall these delays be considered valid reasons for the inability to execute performance of the contract. The use of MILAIR shall not be used unless it is required for the purpose of providing the services identified in the contract and this Statement of Work. Abuse of these circumstances shall result in termination of this privilege by the Contracting Officer.WORK HOURS: Operations shall run 24 hours a day, 7 days a week. SECURITY GUARD DUTIES: The duties that guards shall provide are as follows:Provide gate guards and man perimeter defensive positions to verify the identification of visitors, conduct searches of individuals and vehicles, and utilize radios to apprise the Security Guard Shift Supervisor of any suspicious activities. Security Guards within Afghanistan are authorized to guard U.S./Coalition military facilities, and military property consistent with applicable host nation laws and regulations. Contracted security personnel always maintain their ability to exercise self defense against hostile acts or demonstrated hostile intent, but are not authorized to undertake offensive operations. SECURITY PRECAUTIONS: The Government may, at any time, terminate its security contract with Contractor if Contractor and/or its personnel act contrary to force protection standards. All Contractor personnel shall be subject to random screening to ensure that they do not have anti-coalition and/or subversive intentions. Personnel who fail a screening shall be immediately removed from the OP. No Contractor personnel shall have in their possession maps of the installations (whether professionally or personally made), cameras, or other memory type devices. Personnel found in possession of such materials shall be immediately removed from the OP. CELL PHONES/PERSONAL COMPUTERS: Contractor, with written approval by the COR, may issue a limited number of cell phones to its management. No blanket approval shall be acceptable; each written approval shall contain the name of the management personnel permitted to have a cell phone. Moreover, Contractor and its management personnel with cell phones shall provide the COR and BDOC with phone number. Nothing contained herein shall be interpreted to permit privately-owned cell phones or computers. No Contractor personnel, management or otherwise, is permitted to have privately-owned cell phones or computers on the OP and personnel determined to be in violation of this paragraph shall be immediately removed from the OP. Contractor provided equipment is not considered privately owned, provided it is used in support of the PSC award. This includes but is not limited to company issued laptop, notebooks, computers, and cell phones. All company provided automation shall be discussed and agreed upon during the post award conference. STANDARD OF CONDUCT: As performance of the Contractor’s duties specifically requires entry into the installation and/or perimeter in order to provide security services, the respective Contractor personnel are no longer qualified to fulfill the terms of the contract can no longer provide security services to the installation.The contactor shall replace the relieved Contractor personnel within 48 hours of formal notification that Contractor personnel are “barred from post.”GOVERNMENT PROVIDED SERVICES13.1. The Government will provide JP8 and Mogas fuel for contractor vehicles and generators. Any other type of fuel will be the responsibility of the contractor. Each site manager will be responsible for accounting for fuel consumption and preventing fraud, waste, and abuse.13.2. The Government will provide electrical power to the towers and other guard posts.13.3. The Government will only provide Class IV type materials (wood, nails, sandbags, etc) for force protection measures, requirements or improvements on the OP.13.4. The Government will allow access and use of weapons ranges located on CP VANCE / CP MONTROND. The contractor shall make scheduling arrangements with the COR for use of the weapons range at least 48 hours in advance from the request date and time of usage. 14. QUALITY Contractor shall implement and maintain a quality control plan in accordance with Attachment 2 (Quality Assurance Surveillance Plan).ANNEX ARULES FOR THE USE OF FORCE FOR SECURITY GUARDSDoD civilian personnel and DoD Contractor employees armed for personal protection or contract security/private security companies (PSC) work have the inherent right to exercise self-defense in response to a hostile act or demonstrated hostile intent.DoD civilian personnel and DoD Contractor employees armed for personal protection or contract security/PSC work are not combatants. Taking a direct part in hostilities (e.g. engaging in combat actions with Coalition forces) or performing law enforcement activities is prohibited.Interaction with Coalition and Afghanistan National Security Forces (ANSF):Cooperate with Coalition and ANSF and comply with theater force protection policies.Do not avoid or run Coalition or ANSF checkpoints.If authorized to carry weapons, do not aim them at Coalition or ANSF.Report all incidents of weapons discharge/use (to include accidental discharges) to applicable CJSOTF-A Unit.Use of deadly force.Deadly force is that force which one reasonably believes will cause death or serious bodily harm.Deadly force is to be used only when all lesser means have failed or cannot reasonably be employed.For DoD civilian personnel and DoD Contractor employees armed only for personal protection, use of deadly force is permitted only for individual self-defense when there is a reasonable belief of imminent risk of death or serious bodily harm.For DoD civilian personnel and DoD Contractor employees armed for contract security/PSC work, use of deadly force is permitted for individual self-defense and in defense of others when there is a reasonable belief of imminent risk of death or serious bodily harm. Details regarding this authorization will be provided, for DoD civilian personnel, by appropriate DoD authorities and, for DoD Contractor employees, within the terms and conditions to which the Contractor employee is assigned. DoD contract security can be specifically authorized to protect designated mission essential and US national security equipment/property with force, including deadly force.Graduated use of force:A reasonable amount of force that is necessary under the circumstances shall be used.The following are some techniques you may use, if their use will not unnecessarily endanger you or others:Shout – verbal warnings to halt in native language.Show – your weapon and demonstrate intent to use it.Shove – stop the threat using physical force.Shoot (use deadly force) – to remove the threat only when necessary as authorized in para 4If you must fire your weapon, fire only aimed shots with due regard for the safety of innocent bystanders and immediately report the incident and request assistance.Local Civilians: Treat local civilians with dignity and respect. Make every effort to avoid civilian casualties. You may stop, detain, search, and disarm local persons if required for self-defense only or as reflected in the terms of the relevant contract. All civilians shall be treated humanely and any detained persons or property shall be reported immediately and turned over to the host nation police/security or coalition forces as soon as possible.DoD civilian personnel and DoD Contractor employees, whether armed for personal protection or serving as contract security/PSC, shall not engage in combatant activities, combat-like operations, or offensive operations alone or in conjunction with US/Coalition or ANSF.No person or force is declared hostile for purposed of the RUF.
