Pension files of Joel Hurt, a Corporal of Independent Battery B, 1st Kentucky Light Artillery, original pension claim # 456,673, and his widow Mary "Polly" Ann Cabbell-Hurt who filed pension application # 333,036 following Joel's death. Joel Hurt was the son of Alban Hurt and Martha “Meeky” Montgomery.

The original pension files of Corporal Joel Hurt consist of over 120 pages of documents. Spelling has not been corrected; some punctuation has been added for clarity. All major documents have been included.

On this the . . day of . . . . . . . . 1882 Personally appeard before me, the undersigned authorty, Joel Hurt, a resident of the County & State aforesaid, who after having been duly sworn, on oath declares that his age is 66 years, was born & raised in Adair County - never lived out of said County; that he was enrolled on the first day September 1861 at Columbia Ky. in Co. [D], 3rd Redgiment of Ky volunteer infantry to serve 3 years or during the war - I subsequently was attached to Hewetts Battery of said Redgiment called the 2nd Battery - That whilst in the line of duty, at the battle of Mill Springs in the State of Kentucky -(date not recolected by reason of great fatigue & exposure), I contracted deep cold, which resulted in Rheumatism, which became Chronic. Dr. Hector Owen, was our Redgimental Surgeon, who is now, dead, who waited on me during my affliction; I was placed in no hospital; That previous to going in the U.S. service I was unusually stout, & healthy, & since my discharge, my disease has continually increased in violence, rendering me entirely unable to maintain myself & family by manual labor; I did not expect to have called on my government for assistance, hopeing that I could get along without it, but necessity impels me to do it; & I hereby appoint L.L. Dunbar of Adair County Ky. my true, & lawful attorney to present, & prosecute this claim.

Likewise also personally appeard before me, the undersigned authority, Dr. J.K. Nell & W.B. Montgomery, persons whom I certify to be reputable, & entitled to full credit, who after haveing been duly sworn on oath declare that they are well, & personally acquainted with applicant (Joel Hurt) that I belonged to the same organization myself, & was with him during the whole campaign to the close of the war, & know personally that he was afflicted as he represents in his declaration above written & that we have no pecuniary interest whatever in this matter, & that our post office address is - see enclosed certificate of witnesses

Likewise also personally appeared before Dr. Wm. B. Montgomery who after having been duly sworn by me on oath declares, that he is, & has been the family Physician of applicant (Joel Hurt) & have treated him for Rheumatism ever since the close of the late war; that his post office address is Columbia Ky. & he has no interest in this matter

Montgomery, a resident of the County and State aforesaid, who after haveing been duly sworn, on oath declares, that he is well & personally acquainted with Joel Hurt, (Applicant) & am, & has been his family Physician for a great many years, & that previous to going into the army, he was a sound healthy man, in all appearance, & since his return from the U.S. service his health has been very bad, laboring continuously under Rheumatism, & Chronic Cystitis which Seems to render incapable of maintaining himself, & family by manual labor & that I have no interest whatever in this claim. Nell, States on oath that he is personally acquainted with Joel Hurt, Late of (Company) 2nd Ky Battery of U.S. Armey and was mustered in with him during the fall of 1861 and Served 3 years and four months with said Soldier in the above named Company; was with soldier the whole period of service and in January 1862 at Battle of Mill Springs, Ky, Soldier contracted a severe cold and which culminated in Rheumatism of General System, Effecting the Joints and Soldier has been Effected with Chronic Rheumatism ever Since, until now at this time he is not able to perform manual Labor; Said Soldier was hale harty and Stout when he entered the service and came out of service disabled to the extent above named; Affiant is a Physician in regular practice in Adair County, State of Kentucky; Affiant is not interested in the prosecution of this claim

I hereby certify That I have carefully examined this applicant, who claims that while in the service of the United States, at or near a place named Somerset Ky, and while in the line of duty, on or about the .......... day of January, 1862, he incurred Rhumatism, and that in consequence thereof he is Total disabled for earning his subsistence by manual labor.

He states that he is 66 years of age, that he weighs 160 pounds, and that he is 5 feet 9 inches in height.

His pulse-rate per minute is 76, his respiration 18, and his temperature 99.

The examination reveals the following facts:

There are no Physical Signs of Rhumatism. applicant states that he has frequent spells of Rhumatism; that he has no strength or power in his legs or Arms

Shows cicitrise [cicatrised=scarred] on right side from musket ball - did not enter the abdomen

The condition of the heart normal

From the condition and history of the claimant, it is ....... opinion the disability was ....... incurred in the service as claimed, and that it is not aggravated or protracted by vicious habits.

Sublett a resident of Taylor County Kentucky: Who being duly sworn : according to law - deposes and says in relation to the aforesaid case as follows : to wit : Deponent states : That he was well acquainted with the said Joel Hurt prior to the date of his Enlistment, and in his opinion, the said soldier was a sound and able-bodied man at the time of his Enlistment : and That while in the performance of his military duty, serving with his command on the Zollicofer Fights at Mill Spring during the month of January in the year 1862, said soldier was attacked with a severe cough : and from the effects of which he has never recovered : Deponent states, That The above information is given from having been personally present at the time the disability was incurred : and That he has no interest either direct or indirect in this matter.

On this the 3rd day of Dec, 1883 - personally appeared before me the undersigned authority, George Campbell, a resident of the County & State aforesaid, who after haveing first been duly sworn, on oath declares that he is 50 years old; that he belong to Battery B. or 2nd Ky Battery, the Same that applicant, Joel Hurt belonged to; that he (Joel Hurt) whilst at Somerset in the State of Ky, just before the Mill Spring battle which took place about the 19th of Jan, 1862, Said Hurt was attacked of a violent coal, which resulted in chronic Rheumatism; after the battle, we went to Louisville; from thence to Nashville, Tennessee; from thence to Murfreesborough; that he was with Applicant to his discharge at Louisville Ky & that he was complaining all the time, & seems to labor under the same disease to the present time; & that he has no interest in this matter & that his Post office address is Columbia Ky

That his whole System is seriously involved, in said disease, not only his lower limbs, but hands, wrists, and shoulders are affected to the extent that he cannot use them but very little.

Date of examination, April 16th, 1884.

We hereby certify That we have carefully examined this applicant, who claims that while in the service of the United States, at or near a place named Mill Springs Ky, and while in the line of duty, on or about the ......... day of ..........., 1862, he incurred Rheumatism, and that in consequence thereof he is totally disabled for earning his subsistence by manual labor.

He states that he is 68 years of age, that he weighs 167 pounds, and that he is 5 feet 8 inches in height.

His pulse-rate per minute is 72, his respiration 22, and his temperature normal.

The examination reveals the following facts:

There is enlargement of all the joints of both superior and inferior extremeties and a crackling sound on motion of some of the joints of the inferior extremeties. The muscular tissue presents a glazed appearance and is atrophied and flaccid.

There is a varicose condition of the veins of both inferior extremeties, extending from the knees to the ankles on the inner side of the limbs.

Auscultation discloses a rough clearly defined endocordial sound.

Alleges lumbago and stiffeness and want of freedom of action of the muscles in stooping and bending about.

There is slight opacity or muddy appearance of the chrystaline lens of both eyes, impairing vision to such an extent as will only allow him to read, Snellen's test type No. 12 at 17 inches distance from the eyes, The Result we Think of the Rheumatic diathesis with which we believe he is afflicted as claimed

From the condition and history of the claimant, it is Our opinion the disability was -- incurred in the service as claimed, and that it is not aggravated or protracted by vicious habits.

We find the disability as above described to entitle him to Total rating.

I am almost blind, & cannot attend to no business whatever; I cannot even make my own fire, & I have no assistance excep my wife, & two daughters; I therefore respectfully request that you will make my claim a speciality, altho it may be preceded by many others in turn; I am badly ruptured, outside of other physical disabilities - Please let me hear from you at your earliest conveniency, informing me what other proof is requisite in the case, & very much oblige, your most obt. servant

Know ye, That Joel Hurt a private of Captain J. M. Hewetts Company, (2'.) Batty Regiment of Ky Vol Artillery VOLUNTEERS who was enrolled on the first day of September one thousand eight hundred and Sixty one to serve three years or during the war, is hereby Discharged from the service of the United States, this sixteenth day of November, 1864, at Louisville Kentucky by reason of Expiration of Term of Service.

(No objection to his being re-enlisted is known to exist.*)

*This sentence will be erased should there be anything in the conduct or physical condition of the soldier rendering him unfit for the Army.

Said Joel Hurt was born in Adair Co in the State of Kentucky, is fifty two years of age, five feet nine inches high, fair complexion, blue eyes, mixed grey hair, and by occupation, when enrolled, a Farmer.

I can not make any statement in the case of Joel Hurt any more accurate than those already on file in the pension office and perhaps not as accurate as I have not the proper record to refer to and my recolection is verry bad the present time.

Dooley, a resident of Adair County Kentucky : whose Post office address is Columbia in said county and state : who being sworn in due form of law = on oath declares in relation to the aforesaid case as follows, to wit = The Deponent states = that he is well and intimately acquainted with Joel Hurt, said soldier, having served in the same Battery with said soldier, to wit = Company (B) of the 1st Regiment of Kentucky Light Artillery in the War of 1861. The Deponent state = That during the month of January as near as deponent can remember in the year 1862, while said command was stationed at Mill Spring in the state of Kentucky, said Joel Hurt was attacked with Camp Fever and Rheumatism as the result of his Military Service, a Knowledge of which fact is derived from having been personally present at the incurrence of said disability. Deponent further swears, That he was well acquainted with the said Joel Hurt prior to and at the date of his enlistment, and does positively swear, That said soldier was a man of sound bodily health and vigorous constitution at That time. Deponent further swears, That said Joel Hurt has continuously suffered with Rheumatism and a prostration of the whole system from date of discharge to the present time, a Knowledge of which fact is derived from having lived as a neighbor to said soldier from date of discharge to the present time, and from having had every oppertunity of observing said soldiers condition during the above mentioned length of time : and he further swears That he has no interest either direct or indirect in the prosecution of this claim.

On this 6th day of December 1884, Personally appeared before me, The Undersigned Authority : within and for the county and state aforesaid = Matthew Wooten, a resident of Adair County in the state of Kentucky : whose Post office address is Gradyville in said county and state : who being sworn in due form of law = on oath declares in relation to the aforesaid case as follows, to wit = The Deponent states = That he is well and intimately acquainted with Joel Hurt who was a member of Battery (B) of the 1st Regiment of Kentucky Artillery in the War of 1861. The Deponent states = That he served as a comrade with the said Joel Hurt in said command. That during the month of January in the year 1862 while the said Joel Hurt was stationed with his command at Mill Spring in the State of Kentucky, while in the line of his duty, said soldier was attacked with Camp Fever and Rheumatism as the result of his Military Service, on account of exposure and hardships incidental to a soldiers life. The Deponent swears, That he has been acquainted with the said Joel Hurt for a period of about twenty four (24) years, and at the date of his Enlistment he was a man of good sound bodily health and vigorous constitution, not being afflicted with any disease whatever observable to affiant. The Deponent further swears, That he was personally present at the time the said Joel Hurt contracted the above named disabilities in the United States Army. That on the return home of said Soldier after discharge he was suffering with Rheumatism and a general prostration of the whole system as the result of his Military Service, and from the effects of which he has never recovered; and That he has continuously suffered with the above named Rheumatism from the date of discharge to the present time, with no prospect of an ultimate-recovery, a Knowledge of which fact is obtained from having had every oppertunity of observing said soldiers condition from date of discharge to the present time : and the affiant further swears That he has no interest either direct or indirect in the prosecution of this claim.

On this 10th day of December 1884, Personally appeared before me = The Undersigned authority : within and for the county and state aforesaid = Joel Hurt, residing in Adair County in the state of Kentucky : whose Post office address is Columbia in said county and state = and who being sworn in due form of law - on oath declares, That he was born and reared in Adair County Kentucky : and That Columbia Adair County Kentucky has always been his Post office address. The Deponent states that since the date of his discharge to the present time he has been engaged in the occupation of Farming when capable of performing manual labor for the maintenance of himself and family. The Deponent would respectfully state, under oath, That during the month of January in the year 1862 while he was stationed with his command at Mill Spring in the state of Kentucky, and while in the performance of his military duty he was attacked with Camp Fever and Rheumatism, as the result of his military service. The Deponent further swears, That regarding his medical treatment, he herewith furnishes the Certificate of Dr W.B. Montgomery, family Physician, who has treated affiant from date of discharge to the present time. The Deponent further swears, That he is disqualified for the performance of equal to a total inability, and would respectfully refer to the evidence herewith accompanying and heretofore filed in establishing the validity of his claim.

On this 10th day of December, A.D. one thousand eight hundred and eighty-Four personally appeared before me, Clerk of the ................, a court of record within and for the county and State aforesaid, Joel Hurt, aged ......... years, a resident of the .......... of ............. county of Adair, State of Kentucky, who, being duly sworn according to law, declares that he is the identical Joel Hurt, who was ENROLLED on the 1st day of September, 1861, in company (B) of the 1st regiment of Kentucky Artillery commanded by John M. Hewitt, and was honorably DISCHARGED at Louisville Ky on the 16 day of November, 1864; that his personal description is as follows: Age, 69 years; height, 5 feet 9 inches; complexion, Fair; hair, mixed gray; eyes, Blue. That while a member of the organization aforesaid, in the service and in the line of his duty at Mill Spring in the State of Kentucky on or about the ........ day of January, 1862, he

Claimant was attacked with Camp Fever and Rheumatism from the effects of which he has never recovered. This Declaration is filed in lieu of an original Declaration originally filed and acknowledged.

That he was treated in hospitals as follows: The claimant states = That whilst he was sick as above stated, he received only such medical treatment as he could obtain from Surgeons and Assistant Surgeons connected with the army, whose names affiant states he cannot now remember.

That he has not been employed in the military or naval service otherwise than as stated above

That since leaving the service the applicant has resided in the County of Adair in the State of Kentucky, and his occupation has been that of a Farmer & Teamster. That prior to his entry into the service above named he was a man of good, sound physical health, being when enrolled a Farmer. That he is now almost totally disabled from obtaining his subsistence by manual labor by reason of his injuries, above described, received in the service of the United States; and he therefore makes this declaration for the purpose of being placed on the invalid pension-roll of the United States.

On this 10th day of March 1885, Personally appeared before me The Undersigned Authority : within and for the county and State aforesaid = Joel Hurt residing in Adair County in the State of Kentucky : whose Post Office address is Columbia in said county and State = who being sworn in due form of law = on oath declares in relation to his aforesaid case as follows, to wit = The Deponent states = referring to the paragraph marked thus (#) in Hon Commissioners letter herewith accompanying, to wit = That he was treated as stated in his affidavit under date of May 4, 1882 by Dr Hector Owens who was Regimental Surgeon of the 3d Regiment of Kentucky Volunteer Infantry for Rheumatism and Camp Fever. The Deponent states That at the time of said treatment it was supposed That a Battery of Light Artillery could be attached to an Infantry Command, but it was afterwards ascertained that such could not be done According to Army Regulations, and in consequence of which, the Battery of Artillery was detached from the Infantry command, and was made a seperate organization. The deponent states, That it was previous to this detachment That he received Medical treatment at the hands of Dr Hector Owens who was at That time Surgeon of The 3d Regiment of Kentucky Infantry as before stated, in connection with the aforesaid Battery. The affiant states further That Dr Hector Owens died of Cholera in Adair County, Kentucky on the 2d day of September in the year 1873. The deponent further swears That he was treated for the foregoing disability at Somerset, Kentucky in Post Hospital, but does not remember the name of the Surgeon in charge. That there was no Surgeon or Assistant Surgeon attached to Battery (B) of the 1st Regiment of Kentucky Artillery, and in consequence of which he was not treated by any medical officer while in said Battery, there being none as previously stated. The deponent further swears That the only medical treatment he received while in the service was at the hands of Physicians with whom he was unacquainted, (with the exceptions of Drs Owens & Thompson,) and at intervals as he required Medical Attendance. The deponent positively swears That Rheumatism and general prostration of the whole system with which he is now afflicted originated in the United States Army as set forth in his declaration and previously filed affidavits.

Personally came before me The Undersigned Authority : within and for the County and State aforesaid = William B. Montgomery, a citizen of Adair County Kentucky = whose Post Office Address is Columbia in said county and state = well known to me to be reputable and entitled to credit : and who being duly sworn, declares in relation to the aforesaid case as follow : to wit = That he is a Practising Physician of 26 years standing and That he has been Acquainted with the said Joel Hurt about 60 years : and That he has treated or prescribed for said soldier as follows = for the following Disability, I have treated Joel Hurt at various times since his discharge from the army for rheumatism. I cannot make any statements now more deffinite than heretofore as I have to make them from memory and my memory is verry imperfect. He has been able to do verry little labor for four or five years and is not able to do any at this time on account of rheumatism and general dibility. I have kept no particular accounts against the soldier as I never expected any compensation on account of his condition.

I John Reynolds, a resident of Green County in the State of Kentucky, whose Post Office address is Milltown in the county of Adair and state of Kentucky, Late a member of Battery (B) 1st Regiment of Kentucky Artillery, War of 1861, on oath depose and say, That I am well acquainted with Joel Hurt the above named claimant, who was a member of my said Battery. That at the time of the Enlistment of the said Joel Hurt in my Battery he was regarded as a man of good sound bodily health and vigorous constitution, having passed the necessary muster. The Deponent states, That while in said service and in the line of his duty during the month of January in the year 1862 at Mill Spring in the state of Kentucky, said soldier was attacked with Rheumatism and Camp Fever, the same having originated in the United States Service, as the result of the same, and That without any fault or improper conduct on the part of said soldier. The Deponent further states That said soldier was afflicted with Rheumatism in the legs, extending to some portions of his body, affecting the parts in a very painful manner, and by reason of which he was frequently unable to perform Military duty. The Deponent further states - That said disability continued with said soldier at intervals during his term of service, and on account of which he was frequently treated whilst in the service for the same, and That at the date of discharge of said soldier from the United States Army he was still suffering with Rheumatism and general debility originating from exposure and the hardships of a soldiers life, and affiant further swears, That he has frequently seen said soldier from date of discharge to the present time, and has observed That said soldier is still afflicted with Rheumatism and general debility and has so continued each year successively from date of discharge to the present time : and affiant further swears, That a knowledge of the foregoing facts is obtained from having been personally present at the incurrence of said disability and That he has no interest either present or prospective in this matter.

Please share if he was in any manner disabled with said disease, from Jany 1862, until the date of his discharge in Nov. 1864, and if so to what Extent he was prevented from performing military duty during the period mentioned. You are further requested to describe his physical condition at the date of his discharge, and during Each year since, stating the Extent to which he has been disabled for manual labor, during Each year, up to the present time by reason of the alleged rheumatism. On This 9th day of September AD 1885, Personally appeared before me - The Undersigned Authority, within and for the County and State aforesaid = Mrs. Polly Ann Hurt, aged 65 years : a resident of Adair County, Kentucky : whose Post Office address is Columbia in said county and state = who being duly sworn according to law = on oath declares = That she is the widow of Joel Hurt, deceased, who was a member of company (B) 1st Regiment of Kentucky Light Artillery in the War of 1861, and doth on her oath make the following Declaration in order to obtain the benefit of the provisions made by Act of Congress approved July 14, 1862 : That she is The widow of Joel Hurt who served in the above named mentioned Command, and who filed an application No. 456.673 for an Invalid Pension in consequence of disabilities incurred in the military service as aforesaid. That her said deceased husband died in Adair County Kentucky on the 19th day of August in the year 1885 of Rheumatism, and its attendant effects, resulting in a general prostration of the whole system and the immediate cause of his death, which the affiant states has been duly proved by innumerable testimony forwarded on different occasions pending his Invalid Pension Claim.

She further declares That she was married to said Joel Hurt on the 18th day of June in the year 1842. That her husband, the said Joel Hurt, died on the day above mentioned : and That she has remained a widow ever since, as will more fully appear by reference to the proof hereunto affixed. She also declares That she was never gave any aid or comfort to the Rebellion during the late War, and That her Post office address is Columbia, Adair County, Kentucky.

On This 3d day of May 1886, Personally appeared before me = The Undersigned Authority = within and for the County and State aforesaid = Polly A. Hurt, a resident of Adair County in the state of Kentucky : who being duly sworn according to law = on oath declares as follows in relation to her aforesaid claim, to wit = The Deponent states That her maiden name before her marriage to the said Joel Hurt (deceased) was Polly A. Cabble. That she was married to the said Joel Hurt in Adair County, Kentucky by Revd. James Warriner (deceased) on the 18th day of June in the year 1842. The Deponent further states - That she was never previously married before her marriage to the said Joel Hurt : That her said deceased husband, the said Joel Hurt, was previously married to Susan Hurt, who is now dead, having died a number of years ago in Simpson County, Kentucky. That the said Susan Hurt died within about six (6) months after her marriage.

I hereby certify That said Mrs. Polly A. Hurt has no children under the age of sixteen years, and had none at the time of the death of the said Joel Hurt. This certificate is given in consequence of the sickness of Mrs. Hurt, being confined to her bed and her total inability - to appear before a qualifying officer to make the above statement.

Hurt aged 56 years : a resident of Adair County, Kentucky : whose Post Office address is Columbia in said county and state : who being duly sworn according to law = on oath declares in relation to the above cited claim as follows : to wit = The Deponent states = That he is well acquainted with Mrs. Polly A. Hurt, the widow, legal representative and heir of Joel Hurt, a deceased soldier, who was a member of Battery "B" 1st Regiment of Kentucky Light Artillery in the War of 1861. That he was also well acquainted with said deceased soldier. The Deponent further swears That the said Joel Hurt and Polly A. Cabble were married in Adair County, Kentucky on the 18th day of June in the year 1842, by Revd. James Warriner, who is now deceased. That a knowledge of the above mentioned fact is obtained from having been personally present at the performance of the marriage ceremony between said parties. That said parties lived and cohabitated together as man and wife from the date of their marriage to the date of death of the said Joel Hurt : and were recognized as such by the community in which they resided : and the Affiant further swears, That he has no interest either direct or indirect in the prosecution of this claim, nor is he concerned in any manner with its prosecution, or its settlement.

Hurt, the widow, legal representative and heir of Joel Hurt, a deceased soldier who was a member of Battery "B" 1st Artillery (as he has been reliably informed, in the War of 1861. That he was also well acquainted with said deceased soldier. The Deponent further swears = That the said Joel Hurt and Polly A. Cabble were married in Adair County, Kentucky on the 18th day of June in the year 1842, by Revd. James Warriner, who is now deceased. That a knowledge of the above mentioned facts is obtained from having been personally present and witnessed the performance of the marriage ceremony between said parties. Conover, residents of Adair County in the State of Kentucky : aged 55 and 53 years respectively : whose Post Office address is CrayCraft, Adair Co. Ky, persons whom I certify to be reputable and entitled to credit = who being sworn in due form of law = on oath declare in relation to the aforesaid case as follows, to wit = The Deponents state : That they are well acquainted with Ms Polly A. Hurt, the legal representative, widow, and heir of Joel Hurt, a deceased soldier who was a member of Battery "B" 1st Regiment of Kentucky Artillery in the War of 1861. That They were also well and intimately acquainted with the said Joel Hurt. The Deponents state = That the said Joel Hurt intermarried with Polly A. Cabble who was a maiden lady : and That the said Polly A. Hurt was never previously married : and That her first and only marriage was with the said Joel Hurt, said deceased soldier : and affiants further swear = That they have no interest either direct or indirect in the prosecution of this claim. The affiants state That the above information is given from having lived as neighbors to said soldier and claimant for a period dating from marriage.

The Deponent Polly A. Hurt, a resident of Adair County, Kentucky = being sworn in due form of law = on oath declares That she is the legal widow, representative, and heir of Joel Hurt, a deceased soldier, who was a member of Battery "B" 1st Regiment of Kentucky Light Artillery in the War of 1861. The Deponent states = That she has made diligent search and inquiry regarding the death of Susan Hurt, the first wife of her said deceased husband, and can only obtain such evidence as is herewith presented in support of such fact, which affiant prays may be acceptable in the premises. The Deponent further swears, That by reason of the great length of time since the death of the said Susan Hurt, it is impossible to obtain any more definite information regarding said occurrence, the majority of persons cognizant of the fact of said death having died or removed to parts unknown to affiant. The deponents further declares that Susan Hurt died some six (6) months before her marriage to the said Joel Hurt.

Powell, a resident of Adair County Kentucky : whose Post Office address is Cray Craft in said county and State : aged 55 years : and who being duly sworn according to law = on oath declares in relation to the aforesaid case as follows = to wit = The Deponent states = That he was well acquainted with Susan Hurt, who was the first wife of Joel Hurt, said deceased soldier, said deceased soldier having married the said Susan Hurt in Adair County, Kentucky : and subsequently removed to Simpson County in the State of Kentucky, when she died some six (6) months before the marriage of the said Joel Hurt to Polly A. Cabble who is now said soldiers living widow, representative, and heir. The Deponent further states = That a knowledge of the foregoing facts is derived from having lived as neighbors to said parties, at the time of their marriage : from information derived from an unquestionable source as to the death of Susan Hurt, the first wife of said deceased soldier, as hereinbefore mentioned : and affiant further swears = That he has no interest either direct or indirect in the prosecution of this claim.

On this 8th day of November 1886, Personally appeared before me = The Undersigned Authority within and for the county and State aforesaid = Polly A. Hurt, a resident of Adair County, Kentucky : whose Post Office Address is Craycraft in said county and state = who being sworn in due form of law = on oath declares That she is the legal widow, representative, and heir of Joel Hurt, a deceased soldier, who was a member of Battery "B" of the 1st Regiment of Kentucky Light Artillery in the War of 1861. The deponent states = That during the year 1880 her said deceased husband filed an application for an Invalid Pension by reason of having contracted disease in the United States Army, and of which he eventually died in Adair County, Kentucky on the 19th day of August in the year 1885. The deponent further swears That during the life time of her said deceased husband he filed various and sundry evidence to establish the validity of his said claim, complying with all requirements of the Pension Office so far as made Known to him. That upon the death of the said Joel Hurt, affiant made an application for a Pension as the widow of said deceased soldier, and filed such evidence as was demanded of her to support the merits of her claim, and on the completion of such evidence she was granted a Pension Certificate No 225,685 which she now has in her possession, and upon which an original payment has been made. The deponent further swears That she believes herself to be entitled to a greater amount of Pension money than was granted to her by the conditions of said Certificate. That in as much as her said deceased husband made his application for an Invalid Pension prior as she believes, to the expiration (of the time) for filings claims for Invalid Pensions under the Act granting Arrears of Pension. She should be entitled to accrued Pension money as provided by law, and in consequence of which, deponent would respectfully request a re-examination of said claims, and an allowance consistent with the provisions of the same.
