Effective December 1, 2010, the State of Maine adopted a statewide Uniform Building Code. Any building codes that municipalities had in place are null and void. Municipalities over 2,000 in population are required to enforce the new code if they adopted a nationally recognized building code by August 2008. Municipalities over 2,000 in population that have not adopted a nationally recognized building code by August 2008 are required to enforce the new code as of July 1, 2012. Municipalities under 2,000 are not required to enforce it unless they wish to, however, one must still build to the new code. The Town of Hancock never adopted a nationally recognized code and will begin enforcement of the new code* on July 1, 2012.

All building construction in Maine is governed by the Maine Uniform Building and Energy Code (“MUBEC”), which has been adopted by the Technical Building Codes and Standards Board by rule in Chapters 1 through 6, pursuant to 10 M.R.S § 9721 et seq. The Technical Building Codes and Standards Board is located within the Department of Public Safety which was established to adopt, amend, maintain, resolve conflicts between the uniform code and other codes, and to develop standards for training and certification for municipal building officials, local code enforcement officers and third-party inspectors.

*ASTM E-1465-2006 Standard practice for Radon Control Option for the Design and Construction of New Low-Rise Residential Buildings is in effect throughout the State of Maine as of December 1, 2010, in units which have never been occupied and in new homes equipped with a radon reduction system. All building permits issued after this date for modular or stick-built homes, which are equipped with a radon reduction system, must be constructed according to ASTM Standard E 1465-2006. This standard also outlines how foundations shall be constructed for soil depressurization.
