Interim Action by Standing Committees

MOVED, that the Standing Committees of the Board of Regents, be and they hereby are, authorized to take interim action for the Board of Regents during the period commencing on July 20, 2011 and ending on September 11, 2011 and that any such action shall be reported to the Board at its meeting on September 12-13, 2011.

Proposed Amendment to Section 3.8 of the Rules of the Board of Regents, Relating to the Duties of the Executive Deputy Commissioner

VOTED, that subdivision (b) of section 3.8 of the Rules of the Board of Regents be amended, as submitted, effective July 19, 2011, as an emergency action upon a finding by the Board of Regents that such action is necessary for the preservation of the general welfare in order to ensure that the Rules of the Board of Regents are immediately brought into conformance with changes in the Department’s internal organization, so as to ensure that the Executive Deputy Commissioner is able to immediately carry out her duties and responsibilities relating to the Executive Deputy Commissioner’s designation as the deputy commissioner of education under Education Law section 101.

Higher Education

Master Plan Amendment: Clarkson University, Doctor of Philosophy (Ph.D.), Interdisciplinary Bioscience and Biotechnology

MOVED, that that the Board of Regents approve a master plan amendment for Clarkson University to authorize the University to offer its first doctoral program in the biological sciences disciplinary area, a Doctor of Philosophy (Ph.D.) program in Interdisciplinary Bioscience and Biotechnology. The amendment will be effective until July 31, 2012, unless the Department registers the program prior to that date, in which case master plan amendment will be without term.

Master Plan Amendment: CUNY Baruch College to Award a Bachelor of Arts (B.A.) Degree in the Biological Sciences

MOVED, that the Board of Regents approve the amendment to the master plan of The City University of New York authorizing Baruch College to offer its first baccalaureate program in the disciplinary area of biological sciences (Biological Sciences, B.A.). The amendment will be effective until July 31, 2012, unless the Department registers the program prior to that date, in which case master plan amendment will be without term.

Petition of the Rome City School District for Consent to Exceed the

Constitutional Debt Limit

MOVED, that the Board of Regents hereby gives consent to the issuance of bonds and/or bond anticipation notes by the Board of Education of the Rome City School District in an amount not to exceed $30,000,000 for capital improvements, consisting of reconstruction and renovations, in part and construction to school buildings, grounds and facilities throughout the district and the issuance of such bonds and/or bond anticipation notes in excess of the constitutional debt limit of said school district.

PCOM NY, LLC (a.k.a. Pacific College of Oriental Medicine): Authorization to Award Degrees

MOVED, that the Board of Regents authorize PCOM NY, LLC (a.k.a. Pacific College of Oriental Medicine) to confer the Associate in Occupational Studies (A.O.S.), Bachelor of Professional Studies (B.P.S.), and Master of Science (M.S.) degrees on duly qualified students successfully completing registered programs, effective December 5, 2008, and to confer the Bachelor of Science degree on duly qualified students successfully completing registered programs, effective July 18, 2011.

Regents Permission to Operate in New York State: Rush University

MOVED, that the Regents approve the proposed permission to operate, effective July 18, 2011, which authorizes Rush University’s College of Nursing to use one agency in the New York metropolitan region for the clinical education of students enrolled in its Neonatal Nurse Practitioner programs leading to the Master of Science in Nursing degree or post-master’s Advanced Certificate.

Proposed Amendments to the Rules of the Board of Regents and the Regulations of the Commissioner of Education Relating to the Approval of Dual-Campus International Medical Schools Seeking to Place Their Students in Long-Term Clinical Clerkships in New York State

Adoption of Regulations to Allow Individuals with Advanced Degrees in Science, Technology, Engineering and Mathematics (STEM) and Related Teaching Experience at the Postsecondary Level to Obtain a Teaching Certificate in Earth Science, Biology, Chemistry, Physics, Mathematics or in a Closely Related Field

MOVED, that subdivision (b) of section 30-1.2 of the Rules of the Board of Regents be amended; that subdivisions (c) and (d) of section 30-1.2 shall be renumbered to subdivisions (d) and (e), a new subdivision (c) be added, and renumbered subdivision (d) shall be amended and a new subdivision (e) shall be added to section 30-1.2 of the Rules of the Board of Regents; that subdivision (b) and (d) of section 30-1.9 of the Rules of the Board of Regents be amended; that section 80-1.7 of the Regulations of the Commissioner of Education be amended and that subdivision (a) of section 80-1.8 of the Regulations of the Commissioner of Education be amended, as submitted, effective August 16, 2011, as an emergency action upon a finding by the Board of Regents that such action is necessary for the preservation of the general welfare to ensure that the proposed amendment remains continuously in effect until it can be adopted as a permanent rule.

P-12 Education

Your P-12 Education Committee held its scheduled meeting on July 18, 2011. All members were present, except for Regent Dawson, who was excused.

ACTION ITEMS

Guidelines and Resources for Social and Emotional Development and Learning

The Committee adopted guidelines and resources for social and emotional development and learning for voluntary implementation by school districts. Committee members asked that minor changes be made to language in the preface. The guidelines were developed through extensive collaboration with the Department’s Office of Student Support Services along with educators from around the State and incorporate social and emotional development into elementary and secondary school education programs, as prescribed in paragraph (b) of subdivision one of section three of the Children’s Mental Health Act of 2006. [P-12 (A) 6]

Charter School Actions

Your Committee recommends that the Board of Regents approves the charter revisions for the Albany Community Charter School, the Bronx Success Academy Charter School 3, and the Explore Excel Charter School as proposed by the Trustees of the State University of New York and the provisional charters are amended accordingly. [P-12 (A) 1]

Your Committee recommends that the Board of Regents approves and issues the second renewal charter of the Leadership Preparatory Bedford Stuyvesant Charter School as proposed by the Board of Trustees of the State University of New York, and that its provisional charter be extended for a term up through and including July 1, 2016; and the first renewal charter of the True North Rochester Preparatory Charter School as proposed by the Board of Trustees of the State University of New York, and that its provisional charter be extended for a term up through and including June 27, 2016. [P-12 (A) 2]

Your Committee recommends that the Board of Regents approves the revision to the fifth renewal charter of the Harriet Tubman Charter School, and the provisional charter is amended accordingly. [P-12 (A) 3]

Your Committee recommends that the Board of Regents approves the charter revisions for the Leadership Preparatory Charter School 4 and the True North Genesee Preparatory Charter School as proposed by the Trustees of the State University of New York and the provisional charters are amended accordingly. Your Committee recommends that the Board of Regents approves and issues the third renewal charter of the Buffalo United Charter School as proposed by the Board of Trustees of the State University of New York, and that its provisional charter be extended for a term up through and including July 31, 2016; the second renewal charter of the Icahn Charter School I as proposed by the Board of Trustees of the State University of New York, and that its provisional charter be extended for a term up through and including July 31, 2016; and the third renewal charter of the Sisulu Walker Charter School of Harlem as proposed by the Board of Trustees of the State University of New York, and that its provisional charter be extended for a term up through and including August 9, 2016. MATTERS NOT REQUIRING BOARD ACTION

Appeals Process for Local Diplomas – The Committee discussed proposed amendments to regulations to clarify that the local diploma option continues to be available under the appeals process for general education students. The proposed amendments will be brought back to the Committee for further discussion with final adoption planned for October. [P-12 (D) 1]

PARCC Assessment Design Update – The Committee was updated on the PARCC Assessment Design process and discussed recommendations proposed to the PARCC Governing Board that adjustments be made to address concerns regarding costs and unintentional negative impacts on instruction resulting from the four separate testing administrations of the original design. The Governing Board has approved allowing the first two components of the PARCC assessment to be optional. The approved design still requires two separate test administrations for the final summative score: performance-based assessment tasks to be administered towards the end of the school year; and a separate component of innovative, machine-scored tasks to be administered at the end of the school year.

ACTION ITEMS:

Modification of Program Design and Evaluation Process for the Graduate Level Clinically Rich Principal Preparation Pilot Program Request for Proposals. Your Committee recommends that the Board of Regents approve the modifications relating to the evaluation and design of the Graduate level Clinically Rich Preparation Pilot Program Request for Proposals. It is recommended that Department staff confer with the Board on issues for discussion and advance any revisions in the design and evaluation process for this program at the September Board meeting and release the RFP later that month.

Your Professional Practice Committee held its scheduled Executive Session meeting on July 18, 2011. No public session was held this month. All committee members were present. Chancellor Merryl H. Tisch was also present, but did not vote on any action or case.

Professional Discipline Cases

Your Committee recommends that the reports of the Regents Review Committees, including rulings, findings of fact, determinations as to guilt, and recommendations, by unanimous or majority vote, contained in those reports which have been distributed to you, be accepted in 7 cases. In addition, your Committee recommends, upon the recommendation of the Committee on the Professions, that 48 consent order applications and 2 surrender applications be granted.

In the case of Barbara Ann Heinssen, under Calendar Nos. 24257 & 24258, we recommend that the Calendar numbers “25427 & 25428,” wherever they are shown in the report of the Regents Review Committee, be deemed corrected and be deemed to read the correct calendar numbers of “24257 & 24258.”

These recommendations are made following the review of 57 cases involving ten licensed practical nurses who are also registered professional nurses, ten registered professional nurses, seven licensed practical nurses, five certified public accountants, four dentists, one chiropractor, one dental hygienist, one licensed clinical social worker, one licensed master social worker, one midwife, one ophthalmic dispenser, one pharmacist, one pharmacy, one physical therapist, one podiatrist, and one speech-language pathologist.

Restoration Case

Your Committee recommends that the application of Stephen B. Wilkins for restoration of his license to practice as a physician in the State of New York be denied and that the Determination of the Board of Regents with respect to such application be approved. [PPC EXS (A) 4]

The Board of Regents announced disciplinary actions resulting in the revocation of 4 licenses, surrender of 2 licenses, one of which was originally a certificate, and 51 other disciplinary actions. The penalty indicated for each case relates solely to the misconduct set forth in that particular case. In addition, the Board acted upon 1 restoration petition.
