ORDER DESIGNATING DEPOSITORY FOR ASSETS

This order is entered on the Court’s own motion for authorization to deposit assets belonging to the ward above and designate       a financial institution, as the depository as provided by Florida Statute 69.031(1).

It is ORDERED and ADJUDGED:

1. That      , a financial institution as defined by Florida Statute 69.031(1) is designated as the depository for the assets of the above named ward and is hereby authorized and directed to receive and hold as depository assets of the ward to be held by the said financial institution in safe keeping subject to such instructions by the guardian of the ward as authorized by orders of this court directed to said financial institution, and to permit withdrawal of funds only upon court order.

2. That      , a financial institution shall hold the monies in a cash account until such time as the court approves other investments.

3. That      , a financial institution shall accept or reject the designation and shall file its acceptance or rejection with the court within 15 days after actual knowledge of the designation comes to the attention of the financial institution per Florida Statute 69,031(4).

4. That a receipt of depository shall be signed by an officer of the financial institution and include the account number and amount of assets received. This receipt shall be filed with the Court within ten (10) days from the date of receipt of assets.

5. If applicable, the assets currently held in the attorney’s trust account shall be deposited directly from the attorney’s trust account to the designated depository.

6. That any person or corporation having possession or control of any such assets of the ward, or owing interest, dividends, principle or other indebtedness on account thereof, shall, upon demand of the depository designated herein, pay and deliver such assets, interest, dividends, principle or other indebtedness to the said depository and the receipt and acceptance thereof by the designated depository shall relieve the person or corporation from all further responsibilities therefore.
