The Bankruptcy Abuse Prevention and Consumer Protection Act of 2005 imposed new requirements on people filing for bankruptcy. With limited exceptions, those who plan to file for bankruptcy protection MUST complete pre-bankruptcy credit counseling from a government-approved organization within 180 days BEFORE filing their bankruptcy petition.

If you file your bankruptcy petition before completing the pre-bankruptcy credit counseling course, your case may be DISMISSED. Any filing fee paid may not be refunded AND you will still owe the filing fee if it is not paid in full at the time of filing.

In general, you must file a certificate of credit counseling at the same time you file your bankruptcy petition.

You may take the credit counseling course on a computer or by telephone.

Before filing the bankruptcy petition, you may obtain a list of approved credit counseling agencies from the Clerk's Office or court website, or go to the US Trustee website:
