ORDINANCE AMENDING REGULATIONS ADOPTED BY ORDINANCE 18-10 REGARDING TEMPORARY RESIDENTIAL $WIMMING POOLS

AS SET FORTH IN TITLE 4, CHAPTER 2 IN THE VILLAGE CODE

WHEREAS, the Village of Barrington Hills (hereinafter the "Village") is a duly organized and existing Illinois home rule municipality pursuant to the Illinois Municipal Code, 65 ILCS 5/1-1-1 et seq.; and

WHEREAS, the Village of Barrington Hills is authorized and empowered, under the Municipal Code and the Code of Ordinances ofthe Village of Barrington Hills, to adopt regulations applicable to swimming pools within the Village; and

WHEREAS, the Village Board of Trustees adopted Ordinance 18-10 setting forth regulations allowing temporary swimming pools to be constructed within the Village, which regulations are set forth in the Village Code in Title 4, Building Regulations, Chapter 2 Building Code; and

WHEREAS, staff has recently reviewed provisions set forth in Chapter 2, Section 4-2-2 and has recommended the amendment of certain regulations set forth relative to swimming pools designed and constructed to be for temporary use during the summer season; and

WHEREAS7 the Village President and Board of Trustees have reviewed the amendments recommended and based on the recommendations of staff, deem it prudent and necessary to adopt the amendments; which will amend Title 4, Building Regulations, Chapter 2 Building Code, of the Village Code.

NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Barrington Hills, Cook, Kane, Lake and McHenry Counties, Illinois, as a home rule municipality, the following:

SECI'ION ONE: herein.

That the forgoing recitals are hereby incorporated by reference as if fully set forth

SECTION 'IWO: That building regulations relative to swimming pools shall be amended to provide for erection and operation of temporary pools for a defined season, and for such purpose, Title 4, Chapter 2 Building Code be and hereby is amended effective immediately upon passage to state as follows:

C. Inspection: An inspection is required when work to install the pool is complete, and pool must pass inspection prior to use. Failure to schedule an inspection shall result in permit revocation for the season. An inspection to confirm removal of the structure may be required on September 15 of each year.

D. Submittal requirements:

Executed permit application;

2. Plat of survey (11 x 17 maximum size) showing all existing structures, including fenees and gates, the location of the proposed pool and where the GFCI outlet is located.

3. Product and specification sheets for pool and equipment.

SECTION THREE: That all other ordinances and resolutions, or parts thereof, in conflict with the provisions of this Ordinance, are, to the extent of such conflict, expressly repealed.

SECTION FOUR: That this Ordinance shall be in full force and effect from and after its passage, approval, and publication in pamphlet form as provided by law.
