Different Types of Law
International Law – the legal system governing the relationships between nations; more modernly, the law of international relations, embracing not only nations but also such participants as international organizations and individuals.
Foreign Law – generally, the law of another country (e.g. national law of Paraguay)
Comparative Law – the scholarly study of the similarities and differences between the legal systems of different jurisdictions, such as between civil-law and common-law counties
Public International Law – see international law, e.g. what is the legal boundary between Ethiopia and Eritrea?
Private International Law – international conflict of law, e.g. will a divorce in Senegal be enforced in France?
ICJ Statute Art. 38(1) Terms
Conventions (aka treaties, statutes, agreements, protocols, pacts, etc.) – an international agreement concluded between two or more states in written form and governed by international law (e.g. bilateral investment treaties, multilateral treaties)
Custom (customary international law) – international law that derives from the practice of states and is accepted by them as legally binding (e.g. coastal fishing vessels are exempt from capture as a prize of war)
General Principles – legal principles that are found in the national laws of states throughout the world (e.g. no one can the judge in his or her own case)
Judicial decisions – caselaw (note: this is a subsidiary means of deciding questions of international law)
Teachings of the most highly qualified publicists – e.g. treatises on international law, law review articles, the work of the U.N. International Law Commission, writers of civil-law commentaries (note: this is a subsidiary means of deciding questions of international law)
