Wholesale Gasoline Increases in 2009!
Wholesale gasoline increased approximately 92 cents a gallon in 2009!
The decline in gasoline demand last year has contributed to the closings of five oil refineries in the U.S., including plants in Delaware, New Jersey, California and New Mexico a signal that the business of oil refining is mired in a deep crisis according to a report by The New York Times. Gasoline demand, which some analysts had long expected to keep rising for decades, is down sharply in the recession, and some refiners

Petroleum retailers also suffer from higher prices, supply and demand fundamentals, not investor demand, are the prime factors in energy commodity markets.
Once again, greed has popped up and with no oversight at the Commodities Exchange buying and selling crude oil.
News of refinery closings and gasoline demand down sharply is not a recipe for price increases in the gasoline industry.
Congress should hold hearings why gasoline prices are up sharply and closing of refineries (roughly 150 in recent years, from more than 300 in 1982) and consumer demand is down?
"We have too much capacity," Lynn D. Westfall, the chief economist at the Tesoro Corp., a midsized San Antonio based refiner-marketer, told the paper. Westfall estimated that the industry's capacity of 18 million barrels a day must be cut 5% to 8%. Gasoline consumption fell 3.5% last year, the steepest decline since 1965, while diesel consumption fell 6.8%, the most in 28 years. Both are set to fall again this year, said the report.

Speculation costs everyone, take a stand
Stop speculation now! Speculation hurts many people, including individuals, businesses, and organizations, and leaves many speculators at the receiving end of the deal. Speculation hurts just about everyone but those who do it. It hurts gas stations when they are forced to raise prices and make little money on gasoline. It hurts other parts of the petroleum industry, so who's making the money? Traders and banks who pour billions of investment dollars into oil to try and reap a short or long term harvest.
Right now, it’s happening at an alarming rate again. Oil prices are being pushed higher not by fundamentals, but by speculators, hoping to get a huge payday, trading oil on paper with no intention of taking delivery, simply hoping to sell at today's price in the future when oil prices rise.
The CFTC says it’s underpowered and underfunded to take on the challenge of watching today's commodities trades! If you think enough is enough, talk to your government representatives and tell them that enough is enough, vote to limit paper trading and speculation in oil and other commodities.
Slump in refinery utilization comes on heels of falling oil demand
January New York - U.S. crude processing plants have cut activity to the lowest utilization rate since the 1980s, excluding hurricanes, the latest sign of crisis in the world's top oil consumer, according to a Reuters report. U.S. refinery utilization dropped to 78.4% of total capacity 17.6 million barrels per day since it surged to 21 million bpd in 2007 Energy Information Administration (EIA) showed.
The last time utilization of U.S. refining capacity fell to these levels was in the 1980s, excluding 2005 and 2008 when activity cratered due to hurricane-related refinery outages, said the report.
The slump in refinery utilization comes on the heels of falling oil demand in the United States, triggered by cleaner fuel standards and more use of biofuels have also cut into refining output.
There's lots of spare oil capacity from OPEC, lots of spare refining capacity, and lower demand for crude," Tim Evans, energy analyst at Citi Futures Perspective, New York, told the news agency. "The conditions today look a lot like they did in the 1980s, which was a lost decade for oil refiners."
Oil majors Chevron and ConocoPhillips each warned in the past weeks of poor conditions for their refining operations. Last year, several refiners including Valero Energy Corp., Sunoco Inc. and Flying J shut U.S. refineries for economic reasons, while many more idled units to stem losses. Experts say more closures are inevitable, the report added.
"There have to be more closures. Either that or we better fairly quickly have a five to six percent global demand growth...[but] the likelihood of such is remote," Mark Gilman, an oil analyst at Benchmark Co., told Reuters, adding that the U.S. refining industry may face a raft of plant closures similar to what it saw in the 1980s.
In addition to financial pressures, U.S. refiners are also facing competition against more imports of gasoline and other fuels from new refineries in Asia and the Middle East, such as India's Reliance Industries, said the report.
The last time refinery utilization remained consistently below 80% was in 1985, when EIA figures show they averaged 77.6%.
That was the same year the world's top crude exporter, Saudi Arabia, quickly increased its crude output by 150%, a move that helped to collapse world oil prices and later led U.S. motorists to boost purchases of less fuel-efficient vehicles.
Chevron Could 'Divorce' Richmond
Company contemplating refinery's exit from California community
Richmond, Calif. -- Chevron Corp. is considering leaving the Bay Area town of Richmond, Calif., just east of San Francisco, reported National Public Radio (NPR). The biggest producer of greenhouse gases in California, Chevron's Richmond refinery which makes jet fuel, gasoline and diesel opened more than a century ago, and Richmond has always been a loyal company town, said the report.
The city's "green" mayor, Gayle McLaughlin, however, has been trying to raise Chevron's local taxes. "Richmond has suffered, especially in the neighborhoods near the refinery," she told NPR, pointing to high rates of asthma, cancer and heart disease in the neighborhoods affected by the refinery's pollution.
"The Richmond refinery has been here well over a hundred years, and we have had good times and bad times," Mike Coyle, the refinery's general manager, told NPR. "Nobody likes divorce." McLaughlin said she thinks Chevron's talk of moving is a bluff. But the company said it needs to stay competitive, and to do that, it wants some major technical upgrades to the refinery. So far, however, a local judge has temporarily blocked the upgrades, pending more environmental review.
Meanwhile, the situation has emboldened Chevron's local critics, the report added. At a recent demonstration, activists protested the refinery, calling it a corporate polluter and accusing it of ignoring the needs of the community.
In reaction to rising tensions, Chevron is trying to boost its local image, said the report. The company said that it will spend more than $3 million this year helping Richmond's nonprofit groups and economic development projects.
Kandea Mosley, director of sales and marketing at the organization, said her group did not hesitate to take Chevron's money. "Chevron is grappling with what it means to be a 21st century corporate citizen," she told NPR. "And to the extent that we can work together and accelerate renewable energy adoption and create employment opportunities right here at home in Richmond, we want to be part of that work." Winning new friends could forestall talk of the refinery leaving, the report said. Still, many are wondering how the marriage between Chevron and the city of Richmond can be saved.
EPA Delays Higher Ethanol Blend Decision
The agency said it may let more ethanol mix with gasoline, but will wait until next year in order to see more test results.
Washington –The U.S. Environmental Protection Agency (EPA) said it would delay making a decision on whether or not more ethanol could be mixed with gasoline to allow for more testing, Greenwire reports. The agency is leaning toward allowing a 15 percent ethanol blend but will not make a firm decision until mid-2010.
In a letter to Growth Energy, EPA indicated its likely support for increasing the ethanol limit over the current 10 percent. Two tests the agency has completed on E15 (15 percent ethanol blend) seem to indicate newer car engines would be able to run on the fuel.
“Should the test results remain supportive and provide the necessary basis, we would be in a position to approve E15 for 2001 and newer vehicles in the mid-year timeframe,” wrote Gina McCarthy, EPA assistant administrator.
The EPA was supposed to respond to Growth Energy’s petition to increase the “blend wall” on Dec. 1, 09 but it decided to delay to see the results of more testing on component durability and long-term emissions from E15. However, McCarthy wrote that it is “clear that ethanol will need to be blended into gasoline at levels greater than the current limit of 10 percent.”
Growth Energy’s co-chairman Wesley Clark said the agency’s letter is “a strong signal that we are preparing to move to E15.”
Congress must pass legislation that enables this fuel to be sold through the existing retail infrastructure.
Gulf Oil Acquires Brand Rights for Entire U.S.
Framingham, Mass. -- Gulf Oil L.P., a wholly owned subsidiary of Cumberland Farms Inc., will be making a significant geographic brand expansion now that he company has acquired all rights, title and interest to the Gulf brand in the U.S.
The Gulf brand has been in existence for almost 110 years. However, for the last 20 years, Gulf-branded gasoline in the continental U.S. has only been available in an 11-state region in the Northeast through a licensing agreement between Gulf Oil L.P.'s parent company and Chevron U.S.A. Inc., according to a news release.
While specific terms of the new deal are not being released, Gulf Oil now controls the right to market the brand throughout the United States and its territories. This acquisition enables Gulf Oil to expand its use of the Gulf brand throughout the U.S. for the first time since it first acquired certain rights to the brand in 1986, the company stated.
Ron Sabia, Gulf Oil's president and chief operating officer, and Rick Dery, senior vice president and chief sales and marketing officer, will lead the expansion.
Sabia is equally enthused about the company's new direction. "Gulf truly is an iconic brand with a long and distinguished reputation for combining quality petroleum products with outstanding service," he said. "We have worked incredibly hard over the past few years restoring the glimmer to Gulf. I am very fortunate to have surrounded myself with an amazingly diverse and talented team of professionals who live it every day. I share in their pride about now being a national brand, and look forward to expanding our network of supply and service to other regions beyond the Northeast base."
Framingham, Mass-based Gulf Oil currently distributes motor fuels through a network of more than 2,000 branded gasoline retail centers and 12 proprietary oil terminals.
Shell Gas Stations Argue Franchise Fees in Supreme Court
Washington -- The Supreme Court heard arguments earlier this week on whether or not Shell Oil terminated a contract with franchise gas stations when it raised fees in violation of a Petroleum Market Practices Act, according to a report by Courthouse News.
"Is there any area of the law in which a termination includes a non-termination?" Justice Ruth Bader Ginsburg asked the gas stations' lawyer, according to the report.
The Petroleum Market Practices Act generally forbids franchisors from terminating or failing to renew a contract with franchisees. The case marks the first time the Supreme Court addresses the act, according to Courthouse News.
A total of 63 Massachusetts gas stations sued Shell Oil Products after contracts were changed to increase their franchise fees. Mac's Shell Service, representing the gas stations, maintained Shell had promised to continue with the lower fees, except if there were a war or major oil embargo.
Jeffrey Lamken, representing Shell, argued by continuing as franchisees and signing a new contract after the fee increases, the gas stations could not claim their franchises were terminated or not renewed. To claim the contract was terminated, he argued, the franchisor would have to expressly end it.
Justice Antonin Scalia appeared skeptical, according to the report. "I thought that if you had a lease and the landlord fails to provide heat that you can move out and he will be deemed to have constructively evicted you," he said.
Ginsburg probed Lamken's insistence that there is only a violation of the act if the franchisor, not the franchisee, ends the contract. "So the franchisor can do outrageous things -- triple the rent, double the price of the fuel -- and you would say that doesn't count as a termination because the franchisor hasn't terminated?"
Justice Samuel Alito followed up. "So if the franchisor completely refuses to supply gas, that's an implicit termination? But if he charges $1,000 a gallon, that's not a termination?" he asked.
Lamken also argued Shell could cancel one of the two independent contracts it made with gas station managers and said this would not count as terminating the contract because part would still be left. Scalia asked: "Do you really think that that's how those contracts should be interpreted?"
John Farraher, representing Mac's and other retail fuel stations, claimed Shell and Motiva terminated an essential portion of the franchise: the rent calculation, according to the report. Farraher said if Shell's argument were upheld, franchisors would be able to circumvent the petroleum act to end a contract by simply increasing the burden on their franchisees.
Alito pressed Farraher on whether the contact changes really amounted to a termination of the contract. "All but one remained in business, isn't that correct?" he asked in reference to the gas stations and convenience stores.
Justice Stephen Breyer added: "One thing we know, the conduct wasn't so bad that this person left, because he didn't leave," he said, in reference to the gas stations that stayed in business.
Breyer appeared to prefer the clarity of Shell's argument over Mac's, according to Courtroom News. "The other side is saying, 'I know what the test is. The test is he has to leave,'" he said, adding he didn't understand how courts could determine that a franchisor terminated a contract if the franchise continues.
Since 1982, Shell's franchise contracts had reduced the rent each gas station paid based on how much gasoline the station sold, the report noted. But when Shell combined with Texaco and Star Enterprises in 1998, it handed the franchise management to Motiva Enterprises, which ended the subsidy program so that the franchises paid higher fees. While filing suit, however, the gas stations signed onto new contracts with Shell and Motiva.
In the district court, the jury found in Mac's favor, and awarded $3.3 million in damages for termination of the contract and for its non-renewal. Upon appeal, the 1st Circuit agreed that Shell and Motiva terminated the contract, but rejected the claim that they failed to renew. Both sides appealed to the Supreme Court.
Thieves Empty Jobber's ATM Using Factory Default Pin
ATM vendors urge retailers to change the preset PIN numbers on older machines.
Gaithersburg, Md. – A scam involving factory pre-set PIN numbers for ATMs has cost a Kansas marketer the contents of his cash dispenser in a matter of seconds.
The marketer, who never changed the ATM's original code, said the loss was preventable. "If we had just read the manual that came with the ATM, we would have known to change the code, but we didn't," he said.
Oil Express reports the theft could signal a trend, as marketers buy and sell stores and inherit older ATMs.
"We would advise anyone with a legacy ATM that's more than five years old to check whether the PINs were ever changed and to make sure that they have the test software installed," said James Phillips, a spokesman for ATM manufacturer Triton told the news source. ATM vendors offer free software that helps prevent ATM thefts.
New ATMs contain a PIN that allows owners to access the machine's menu. While it does not provide access to the cash vault, it does allow thieves to change the denomination of the bills that the ATM dispensed.
In the Kansas case, while the manager loaded the ATM with $20 bills, the thieves, accessing the ATM menu, changed the denomination of the bills to $1. As a result, the thieves received 20 times the amount that the ATM actually calculated that it had dispensed.
"They swiped an ATM card three times and emptied our ATM". "We have the crooks on video and the authorities are investigating. The crooks are believed to travel up and down the Interstate, searching for certain brands of ATMs. If you have ATMs, make sure all the codes have been changed from the factory defaults.”
ATM vendors learned of the scam several years ago. As a result, machines manufactured today force operators to change the PIN before the machine can be used. However, the older systems are still vulnerable, the reason that Triton and other vendors produced free software fix. "Customers should work with their equipment distributor or processor to put in the software as soon as possible," Phillips told the news source.
Refining losses could destabilize gas prices
So far in the last few months, we've seen a few refiners close their facilities indefinitely. This isn't just cutting production, its ceasing production, sending Americans home jobless, and basically shutting the plant down. While this doesn't have an immediate impact on gasoline prices, should the economy roar back to life and gasoline demand rises, we'll likely need the capacity that the shut refineries offer and you can't just flip a switch and have the refinery running.
When the consumer demand went down and gasoline went over four dollars a gallon; the consumer said enough is enough.
The record profits year after year and misjudged consumer’s anger and financial burden has made the consumer live with less. Now the oil companies have to tighten their belts like everyone else.
Walgreens to Get Fresh
Drug store chain plans to offer fresh food, prepared meals
Deerfield, Ill. -- Walgreen Co. plans to offer fresh foods and prepared meals to draw "time-starved" shoppers to its more than 7,000 stores, taking on supermarkets, convenience stores and other retailers, reported Bloomberg. The drugstore chain has been talking with Foodmaker’s including creating private-label and branded products.
He declined to say when the project will be implemented or how much it costs, said the report.
The move will push Walgreens into competition with supermarket chains Kroger and Safeway Inc., membership warehouse clubs operated by Costco Wholesale Corp. and Wal-Mart Stores Inc., and retailers such as Target, said the report. Wal-Mart’s supercenters sell prepared foods including ready-to-bake pizzas.
"You've also got convenience stores and gas stations trying to go in that direction," Bob Goldin, an executive vice president at Technomic Inc., a Chicago-based food industry consulting firm, told the news agency. Walgreen "does have a lot of stores, but I don't see it as being a venue of choice for consumers," he said. "It will be hard for them to establish credibility in freshness and variety. I don't see it as being a big business driver."
Target, the second-largest U.S. discount store, is expanding its food offerings in general merchandise stores under the name PFresh. PFresh stores will have fruit, ground meat and other fresh foods, as well as premade sandwiches, salads and other prepared meals, spokesperson Jana O'Leary told Bloomberg. "Our customers asked for an expanded food section," she said. "We want it to be a one-stop location for all their needs."
Target has 108 PFresh stores and plans to have 350 by year's end, the report said.
What's for dinner will be much trickier to pull off. The challenge is attracting enough customers to keep the fresh food turning over and finding space for the new products in already crowded venues, he said.
Unemployment Compensation—It appears that there will be a reprieve on the huge increase in the unemployment tax you are due to be paying soon. Thursday evening, the Governor, Speaker of the House and Senate President agreed to issue a joint press release calling for a delay in implementing the new tax. It is planned that both the House and the Senate will take up the first week in the upcoming session. What this basically means is not all rosy but better than the alternative. Employers who were facing a new per employee rate of $100.30 will not see that manifest itself. However, employers will see a minimum increase from the current $8.40 to $25.00.
Not great but a lot less than the rate that was set. The bill will also provide language that delays the big increase for two years.

Residents trying to hang onto their homes in a working-class neighborhood of New London, Conn., are waging a battle in the Supreme Court over their city government's attempt to seize property for private economic development. FinCEN Announces Launch of FinCEN Updates E-mail Subscription News Service
The Financial Crimes Enforcement Network (FinCEN) today announced the launch of FinCEN Updates – a new, free
e-mail subscription management service designed to keep the financial industry, the media and the public informed of news, rulemakings, advisories and other developments at FinCEN. This new secure e-mail subscription management service permits users to customize their updates, which enables them to receive e-mails related to the topics to which they have subscribed.
FinCEN Updates allows users to choose their subscription preferences. Subscription items include advisories, guidance, news releases, rulings, enforcement actions, and current career opportunities at FinCEN. Users can add or delete subscription items themselves, and have the option to password protects their accounts for increased security. Users can opt to have FinCEN Updates sent immediately, daily, weekly, or monthly to their e-mail accounts or directly to a wireless device.
FinCEN selected the GovDelivery® E-Mail Subscription Management service to monitor designated website content and to send an e-mail to alert subscribers when there is new information posted on FinCEN’s public websites. Subscribers will receive e-mails from the Financial Crimes Enforcement Network at the address fincenupdates@.
