EXHIBIT 1RESOLUTION NO. 2014 - A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF HALLANDALE BEACH, FLORIDA, URGING THE FLORIDA LEGISLATURE TO ADOPT, AND GOVERNOR RICK SCOTT TO SUPPORT SENATE BILL 356, SPONSORED BY SENATOR THRASHER, WHICH HAS LEGISLATIVE CHANGES FULLY RESTORING THE ABILITY OF LOCAL GOVERNMENTS TO REGULATE VACATION RENTALS; PROVIDING DIRECTIONS TO CITY CLERK; and providing an effective date. WHEREAS, Florida Statute Section 509.032(7)(b) preempts the regulation of vacation rental units by any local government which did not have a regulation adopted prior to the passage of the state legislation; and WHEREAS, vacation rental uses have an adverse impacts on surrounding neighborhoods which cannot be mitigated including, but not limited to, increased noise, garbage, litter and traffic, changes to the private residential character of the neighborhood, the uncertainty and instability of the identify of occupants of neighboring properties, a decline in the shared sense community, and increased demands on water and wastewater and on code enforcement, police, fire and emergency services; andWHEREAS, maintenance of the character and integrity of residential neighborhoods is an essential local government purpose implemented through local zoning regulations, representing a substantial local government interest; and WHEREAS, short rental periods of a few days to transient occupants is a use that is more commercial in nature, that is best accommodated by uses other than single family and low-intensity residential development; andWHEREAS, the City finds local government autonomy to regulate vacation rentals will contribute to the stability of existing residential neighborhoods, and therefore requests that the Florida Legislature end the preemption and return its full home rule powers to determine whether to amend or expand its vacation rental regulations in the future; andWHEREAS, local government regulation of vacation rentals will protect visitors and surrounding residents throughout Florida; andWHEREAS, Senator Thrasher has filed Senate Bill 356 for consideration during the 2014 Session of the Florida Legislature, fully restoring the ability of local governments to regulate vacation rentals according to the needs of their individual communities; andWHEREAS, the Mayor and City Commission finds the ability for local governments to independently regulate vacation rentals will offer the best avenue to address each community’s specific regulatory needs in order to protect the health, safety and welfare of its residents, both permanent and temporary.NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF HALLANDALE BEACH, FLORIDA:SECTION 1.Recitals. Each “WHEREAS” clause set forth herein is ratified and incorporated herein by this reference. SECTION 2. Mayor and City Commission Action. The Mayor and City Commission urges the State Administration and Florida Legislature to support SB356 and any other legislation that restores home rule to local governments allowing them to determine the best needs of their community in the regulation and zoning of Vacation Rentals.SECTION 3.Authorization of Officials.The City Clerk is directed to distribute this Resolution to the Governor Rick Scott; the Speaker of the House; the President of the Senate; the Broward County Legislative Delegation; the Florida League of Cities; the Florida Association of Counties; the Florida City County Management Association; the Broward County Board of County Commissioners; the Broward County League of Cities; and each of the municipalities in Broward County APPROVED AND ADOPTED this ____ day of January, 2014.____________________________JOY F.
