MINUTES

Present: Cllrs. E. Mitchell, A. Prowse, L. Wakeham, S. Daniels, J. Fox, G. Burrell, D. Johns, D. Wakeham and J. Trend.

04.109 QUESTIONS FROM THE PUBLIC

Mr. Atkins of Brook Cottage, Ludbrook thanked the Council for longstanding support of the planning issue at Ludbrook Gate. He read a report from Mr. John Trentham who was unable to attend. Report gave details of the Planning Committee Meeting at SHDC when permission was granted for the change of use of land from agricultural to the keeping of horses and for the ‘portable’ stables to be moved further into the field along the roadside. Councillors voted 11 for and 3 against. It was stated that the levels do not correspond with those on the plan, the development is larger and there is an extra roadway into the field. Therefore the development is not accurate to the plans that were granted by SHDC. The applicants now have views into all rooms of the neighbouring property with resultant loss of privacy. Mr. Trentham intends to take professional advice and report the matter to the Ombudsman to show maladministration. Mr. Atkins had particular concerns regarding amenities on site especially regarding water facilities and drainage. Cllr. Burrell stated he felt that SHDC Planning Authority had ‘railroaded into this situation’ and had interpreted planning policies to their own ends. Cllr. Mitchell stated that, as a Member, he could not say very much about the situation if it is going to the Ombudsman but confirmed that a majority decision was made. He said that residents have no right to appeal in a decision, but have every right to take a complaint to the Ombudsman. Resolved: Clerk to write to Mr. Bottomley to ask for reply to letter of 27.9.04 and to ask for his confirmation that the current development is accurate to the plans that were passed.

04.110 POLICE REPORT – WPC Jacqui Hopper

Five crimes reported: 9.9.04 theft of trailer. 19 & 28.9.04 non-payment of petrol from Carew Garage. 25.9.04 theft from car at Wrangaton and 30.9.04 dangerous dog at Bittaford. 61 other logs, mainly relating to A38 incidents but also include horses injured at Cutwell and suspicious male acting inappropriately towards horses in the Cheston area. Offender arrested for theft from car on 25.09.04, he was caught by heat seeking device on police helicopter which was deployed on its return from another operation. The offender was caught and has been charged with numerous offences including theft from motor vehicles in the Bittaford area some months ago. Clerk to report in Newsletter. WPC Hopper discussed the problems in Hillside/Moorland Close area in Bittaford regarding vehicle obstruction and nuisance issues with youths. A meeting had been arranged with Tim Durbin from Tor Homes, but he failed to keep the appointment. Police wish to discuss turning bay issue in Hillside. Resolved: Clerk to contact Moorhaven Management Committee to chase up previous correspondence regarding improved use of Moorhaven playing field facilities for youths to congregate as an alternative to meeting in the streets and annoying residents. Accident involving school bus at Ludbrook on 07.09.04: WPC Hopper reported that the bus was empty at the time and that there were no injuries, just damage to a wall. Ministry of Transport have examined the bus and found no defects therefore it is thought to be the result of driver error which may result in report of ‘driving without due care and attention’.

04.111 BITTAFORD COMMUNITY HALL PROJECT – Viv Howard and Jean Mitchell

1. Breakdown of costs and funding from grant giving bodies and the community – copy to all Councillors. Questions were answered satisfactory by Mr. Viv Howard and Mrs. Jean Mitchell. UPC were told there were problems dealing with DNP in obtaining the full grant as had been originally pledged. Cllr. Mitchell stated he was disappointed with the response from DNP and that he would pursue the issue with the Chief Executive to ask for a more generous donation. DNP have requested more expensive materials used in construction such as paving slabs instead of concrete to be more aesthetic pleasing within the Park boundary, therefore it was felt a more substantial donation (as has been given in other Parishes) should have been awarded. Cllr. Mitchell to look into this and will report back.

2. Advice regarding constitution had been sought. The Constitution has now been signed and appears correct. Parish Council representative to be appointed in April at AGM. Cllr. Sue Daniels reported that she had looked at the Charity Commission web site which stated the Constitution was the previous 1996 version. She suggested this is amended.

3. Grant from Ugborough Parish Council under Section 19 of 1976 Local Government Miscellaneous Provisions Act. Clerk reported huge support from the public in Bittaford with over £30,000 having being raised from the village itself. Cllr. Mitchell said this was an overwhelming response for which the Committee should be very proud as this far exceeds fund raising from other very much larger towns within the South Hams. Resolved: All in favour of releasing the grant therefore cheque for £5,000 signed and handed to Chairman Mr. Viv Howard who thanked the Council for their support.

04.112 FINANCE

04.113 RESIGNATION OF CLERK

Chairman read formal letter of resignation from Clerk. This was accepted by Council. Clerk will give 3 months notice and will advertise the post of Clerk in both the Parish Newsletter and Ivybridge Gazette following advice from DAPC. Cllr. Mitchell spoke on behalf of the Council to thank the Clerk for all her hard work over the past 8 years in bringing Ugborough Parish Council up to date to be the professionally run Council it is today. Clerk thanked Cllrs. Mitchell and Beable for their very kind words.

04.114 LICENSING ACT 2003 - Noted

1. Report of Power Point presentation meeting Follaton House 5.10.04 by Clerk given to all councillors. To be kept on file for future reference.

2. Statement of Licensing Policy – consultation paper. Response to draft paper from Clerk & Chairman.

04.115 MOORHAVEN VILLAGE

There has been no response in writing to the following three items. Clerk to contact Moorhaven Management.

1. Response to request for improved provision for young people at Moorhaven Playing fields (following

request from Annual Parish Meeting)

2. Sports facilities: Response from Moorhaven Management to request for shared Parish use of sports facilities

such as tennis, cricket, football.

3. Problem of children congregating in inappropriate places in Bittaford causing public nuisance. Police

working hard in Bittford.

4. Cllr. Daniels reported that Staff at Jays Nursery informed her that the 106 agreement is to be revoked and

plans will be drawn up to replace the current building with a purpose built nursery with some residential

element. It was thought by Council that this would follow the opening of the new Community Hall in

Bittaford which would release the former Moorhaven Clubhouse from its obligations as a community space.

04.116 SHDC PARKS & OPEN SPACE MANAGEMENT

1. Leisure and recreation provision document had been given to Councillors at September meeting for

response. It was felt that the questions on the response document were too ambiguous and that the Clerk

should write a letter stating that it would be a more efficient use of public money to manage and maintain all

District open space and playgrounds centrally rather than every Parish having to see to this on an individual

local basis. Cllr. Mitchell stated that the District Council was facing a shortfall of about £500,000. As

Parish Councils can precept without capping, the District needs to put more expenditure on to Parishes in

order to save money. Cllr. Mitchell also reported that money is to be saved by cutting back on street

cleaning in order to cut down on staff levels. The future of public toilets was discussed at some length. It

was felt that cleaning and maintenance would be cut back and it may be that future care may well be a Parish

responsibility.

04.117 IVYBRIDGE AREA COMMUNITY ACTION PLAN

1. Market & Coastal Town Initiative Brokering event 22.09.04. Report from Clerk noted by Council.

Document to be passed around to all Councillors as this contains important information which will affect

residents of Ugborough Parish who use Ivybridge as a central market town.

04.118 PLANNING

Ugborough Parish Council made the following recommendations to Planning Authoroties:

1. Renewal of permission 57/1117/94/3 for the erection of hotel bedrooms THE WOODPECKER, SOUTH BRENT. Mr. G. M. Clerk NO OBJECTION

2. Erection of stabling for horses. TOAD HALL, LOWER FILHAM, IVYBRIDGE. Mr. J. Stafford. NO OBJECTION

3. Erection of livestock shelter, feed/machinery store. WORKHOUSE MEADOW, UGBOROUGH. Mr. & Mrs. P. Davis. OBJECTION. THE BUILDING PROPOSED IS TOO LARGE FOR THE ACERAGE OF THE FIELD. THIS WOULD BE AN INAPPROPRIATE ISOLATED DEVELOPMENT IN THIS AREA.

The following application arrived after printing of the Agenda. Response to be ratified at the next meeting and any response from the public to be taken into account.

4. Erection of general purpose agricultural building for storage of fodder/livestock. BOWCOMBE PARK, UGBOROUGH. Mr. W. Hoskins. OBJECTION BECAUSE OF THE VISUAL IMPACT OF A LARGE BUILDING ON THE SKYLINE.

farmers and landowners. Document to be passed from Cllr. Beable to Cllr. Daniels.

2. Ivybridge Town Council Civic dinner 12.11.04 invitation to Cllr. & Mrs. Holway.

3. DCC Road closure between Venn Cross and Ladydown 20th October for 3 days.

4. SHDC Future Management of Leisure Centres in the South Hams.

The following resolutions were made:

5. Trafalgar Weekend 21-23rd October 2005. Resolved: UPC to support. All in favour of lighting the beacon.

6. Devon Lane Credit Union – information. Credit Union branch now open in Ivybridge. Clerk to advertise in

newsletter.

7. SHDC Lee Bray Community Regeneration: Parish Cluster meeting 19.10.04 @ 7.00pm Follaton House for

Clerk + two other representatives from UPC to look at Planning & Compulsory Purchase Act with regard

to Local Development Scheme, Statement of Community Involvement, Issues, Options and Preferred

Options Reports. Resolved: Clerk, G. Beable and G. Burrell to attend.

8. The Milestone Society: Letter from Tim Jenkinson regarding condition and future maintenance of

milestones in Ugborough Parish. Further milestones in Parish were discussed: One near Dunwell Cross.

One between Kitterford Cross and Ladydown Cross (on right hand side before ash trees). Resolved: Council

felt these were a significant part of the Parish heritage and there condition would be reported by Cllr. L.

Wakeham to look at the cast iron post at Wrangaton and Cllr. John Fox to report on the others.

9. DNP Community Forum meeting 29.10.04 at 2.15pm Meeting Room, Parke, Bovey Tracey. No one

available to attend.

10.Letter from Mrs. C. Howard regarding notice board on Wrangaton Road Bittaford. Noted.

11.Devon Chestnut Appeal: DCC participation in fundraising general knowledge quiz 21.10.04 7-10.00pm.

Noted.

12.Letter from Mr. R. Cleverley regarding design of memorial stone to be erected in Burial Ground. Resolved:

No objection.

13.At request of parishioner Cllr. Mitchell requested reinstatement of road signposts at Toby Cross and Ennaton

Cross signs. Cllr. L. Wakeham requested reminder to be sent to ILSG regarding fence at ‘Sign of the Owl’.

04.120 P.3 WORK

1. Completion of works to restore Spriddlescombe Lane. Noted.

2. Continuation of work to improve standard of all parish paths. Progress report on restoration of green lanes. Letter from Mr. C. Whittle re: Forder Lane – noted.

3. Work to clear Donkey Lane. Quote from Paddy Trinder £100 (same as 2003). Resolved: Clerk to accept.

04.121 MEMBERS REPORTS (Councillors to give reports on meetings attended on behalf of UPC and/or on any points of interest in each specialist topic.)

1. DAPC AGM Sat 25th September Peter Chalk Centre University of Exeter. – report from Cllr. Daniels and

copy given to all councillors. Points of note included role of DAPC to assist all Councils to carry out their

tasks more efficiently and to the benefit of the parish. Proposed Unitary Authority structure would see loss

of County and District Councils which would result in Parish Council being the only arena for local people

to voice their opinion. Parish Councils and Clerks should try to obtain quality status to be ready for many

extra responsibilities. There would be an increase of 5% in subscription – this should be noted when setting

next year’s budget. The seminar on Affordable Housing was interesting and illustrated that many parishes

are dealing with this problem by small scale developments in areas of need. A great deal of time and effort

needs to be put into tackling this growing problem. Cllr. Beable thanked Cllr. Daniels for attending this

meeting and writing such an excellent report.

2. Cllr. Wakeham reported that he is now a Staff Governor at Ugborough School not a local authority

governor representing the parish council as before.
