Attachment C

TUITION RECIPROCITY PROGRAM

Definition of South Dakota Resident

1. South Dakota High School Graduate

A student is considered a South Dakota resident if:

• S/he was a SD resident at the time of graduating from a SD high school and lived with a parent or legal guardian who was also a SD resident; and

• The parent or legal guardian continuously resided in SD from high school graduation up until the time the student enrolls in post-secondary education; and

• The student enrolls in post-secondary education no later than the fall semester of the seventh year after the date of high school graduation

2. 12 Months Residence in South Dakota for Purposes Other Than Post-Secondary Education

An emancipated (age 21 or older) person moving to SD from another state or country must live in SD for at least 12 consecutive months immediately preceding the first day of classes for other than educational purposes.

• Residence in SD for the sole purpose of attending an institution of higher education is not counted towards the 12 months.

• Student who attended post-secondary education during the 12-month period can appeal for SD resident determination after 12-month period by providing proof that predominant purpose for moving to SD was not post-secondary education. The following factors shall be considered:

o Residence of student’s parents

o Source of the student’s income

o To whom a student pays taxes, including property taxes

o The state in which the student’s car is registered

o The state issuing the student’s driver’s license

o Where the student is registered to vote

o The marriage of the student to a SD resident

o Ownership of property in SD or outside of SD

o The residence claimed by a student on loan applications, income tax returns and other documents

o Admission to a licensed profession in SD

o Membership in civic, community and other organizations in SD or elsewhere.

3. Unemancipated Student and Parents Reside in South Dakota at Time of Post-Secondary Enrollment

The 12-month requirement is waived for an unemancipated (under age 21) student living in SD as a result of parents moving to SD for reasons other than to classify the student as a SD resident. However, if parents later leave SD within 12 months, the student can no longer be considered a SD resident.

4. Residence of Unemancipated Person

The residence of an unemancipated person under age twenty-one follows that of the parents or legal guardian. In the case of divorce or separation, if either parent meets the SD residence requirements, the student is considered a SD resident.

5. Foreign Citizenship

The foreign citizenship of a student is not a factor in determining SD resident status as long as the person has legal authority to remain permanently in the U.S.

6. SD Resident Classification Remains With Continuous Enrollment

Once classified as a SD resident, resident status remains through degree completion with the exception of parents leaving SD within 12 months of moving to SD (see #3).
