Professional Services Master Services Agreement

RFQ 16-A

INSTRUCTIONS:

This Request for Qualifications (RFQ) is designed to comply with all applicable rules and regulations – including all Board of Education Policies.

Qualified firms wishing to be considered for providing services should submit one hard copy and one electronic copy (CD or thumb drive) of their qualifications package to Facility Design and Construction at the reception desk in the Facilities Building, Wake County Public Schools, 1429 Rock Quarry Road, Suite 116, Raleigh, North Carolina 27610, on or before Noon, Tuesday, March 8, 2016. Each qualifications package must include the following:

1) Professional Services Application Form (PSA)

2) Statement of Qualifications (refer to criteria below)

Please download the PSA and provide the required information noted below in the Statement of Qualifications section. Firms having an interest in multiple Professional Service categories must submit separate qualification packages for each category.

Firms should illustrate their experience and qualifications to perform work on the project categories for which they are expressing an interest. To qualify for consideration, firms must be licensed by the appropriate North Carolina Board(s) of Registration if your area of practice is regulated by NC. For Architectural Design of Capital Projects less than $2,000,000, it is the desire to award to firms with 3 or less Registered Architects.

1. PROJECT DESCRIPTIONS AND SCOPE:

The Master Professional Service Agreements are for a variety of services required for land acquisition, design, and construction. These agreements will cover work on an as-needed basis and the work will be performed using unit prices for labor and materials or negotiated lump sum.

2. MASTER SERVICE AGREEMENT PERIOD:

July 1, 2016 to June 30, 2018

3. STATEMENT OF QUALIFICATIONS:

The criteria listed below will be used to select firms for interview and also for final selection. Submit a separate Statement of Qualifications for each category your firm is interested in (along with the PSA).

Note: In order to be considered you must respond to each criterion in the order listed below. We prefer that you present your responses in 8.5” x 11” format and place a tab identifying each criterion (i.e. numbered tabs 1, 2, 3). There is a 25 page limit (single sided, excluding appendices).

1) Expertise in type of work, including number of years firm has been in business; a description of any legal or major technical issues in the past 10 years and their disposition (30%):

4. INSURANCE:

Selected professional services firm must carry $1,000,000 professional liability insurance.

5. POTENTIAL INTERVIEW DATES:

Firms selected for interview will be notified of the exact date and time of their interview which will be on one of the following dates: April 5, 6, 7, 2016

6. TRADE SECRETS AND PROPRIETARY INFORMATION

It is anticipated that proposal documents submitted to the Board of Education by private entities in response to this RFQ will generally be subject to the North Carolina Public Records Laws (“NCPRL”, see N.C.G.S. Chapter 132). In accordance with N.C.G.S. 132-1.2(1), however, such documents may not be subject to disclosure under the NCPRL if they meet all of the following conditions:

1. Constitute a “trade secret” as defined in G.S. 66-152(3).

2. Are the property of a private “person” as defined in G.S. 66-152(2).

3. Are disclosed or furnished to the public agency in connection with the owner’s performance of a public contract or in connection with a bid, application, proposal, industrial development, or in with laws, regulations, rules, or ordinances of the United States, the State, or political subdivisions of the State.

4. Are designated or indicated as “confidential” or as a “trade secret” at the time of its initial disclosure to the public agency.

In order for proposers to exclude confidential proprietary information from public release in response to a public records request, proposers must (i) invoke such exclusion upon submission of the data or other materials for which protection from disclosure is sought, (ii) identify the data or other materials for which protection is sought, and (iii) state the reasons why protection is necessary, (iv) mark each page of the information for which protection is sought with the legend- “Confidential Proprietary Information-Exempt from NCPRL Release,” (v) provide an Opinion of Counsel letter, signed by an attorney designated as “Confidential Proprietary Information” and that in his or her professional opinion, the information so designated meets the statutory standards set out in N.C.G.S. 132-1.2(1), (vi) agree in writing to fully indemnify the Board of Education in the event a lawsuit is filed against the Board of Education seeking disclosure under the NCPRL of any information designated as “Confidential Propriety Information” by the proposer, and (vii) agree in writing to reimburse the Board of Education for costs of defending any lawsuit filed against the Board of Education seeking disclosure under the NCPRL of any information designated as “Confidential Propriety Information” by the proposer.

7. SPECIAL REQUIREMENT FOR BUILDING COMMISSIONING ONLY

The Commissioning Authority will be contractually obligated to the Owner (WCPSS), and will become a member of the project team. The Commissioning Authority will provide third-party services to the Owner and will have no affiliation or conflict of interest with other members of the project team.

To qualify for consideration, firms must meet the following qualifications:

1. The project Cx team must have a principal-in-charge that is a Professional Engineer in the State of North Carolina

2. The firm must currently hold one or more of the following certifications:

a. AEE – Certified Building Commissioning Firm (CBCF)

b. ACG – Certified Membership

c. BCA – Certified Commissioning Firm (CCF)

d. NEBB - Building Systems Commissioning Certification

3. Acted in the role of principal CxA for at least (2) two projects over 100,000 SF.

Include one sample document, for each of the below, from past relevant project. Confidential information can be blanked out. Sample documents don’t count towards 25 page limit.
