CALL TO ORDER at 6:00 PM By Dan Small

ROLL CALL

Present: Mike Guthrie, Jimmy West, Tonnie Trotter, Stephen Carr ,Dan Small, Buddy Wright

CONSIDERATION OF MINUTES

Tonnie Trotter motioned to approve the minutes from the regular meeting on November 22nd , 2016 . Buddy Wright 2nd the motion. All Present Aye 7-0, Motion Passed.

PUBLIC HEARING: For Subdivision Regulation amendments .

Dan Small opens Public hearing.

A. Joe Huthcens spoke about another matter. Stephen Carr corrected him that this is for subdivision regulation in general.

B. Mike Armstrong spoke against changes in Subdivision regulations until public had more time to review changes. Reading the public notice it was tough to understand what is being changed. secretary began to go through list of amendments. Dan Small suggested we should defer subdivision regulation vote until after posted on the website. (See item A old business item A for voting details.)

PUBLIC FORUM:

A. Joe Hudgins Spoke against the Willows, Moved ten years ago, could have moved anywhere, moved here because it was a small bedroom community. Concerned about low end housing , do we really need this kind of growth.

B. Kenny Elrod Spoke against the Willows, Most of the discussion was lack of infrastructure. High density should be on highways. Consider the rezone tonight we do not want this kind of density city streets. If you are recommending for approval the road should be widened by the developer.

C. Sharon Armstrong Spoke against the Willows, The issue of traffic has been covered. I had a brief conversation with the school system on do they have a capacity. Has anyone allowed the fire dept. to review the plans for fire suppression. Have the police protection been addressed. You are required to give everyone adequate chance to address the board.

D. Mike Armstrong Spoke against the Willows, Stated that we are not following are on rules. Examples of not meeting our on ordinances. Redoing regulations is serious impact on the bottom line.

E. Vernon Weakley Spoke for the Willows , Engineer comments addressed on new plat given at this time. We have gone through traffic studies. Please get us any comments that you have.

F. City planner spoke about proposal dealing with traffic study and the standards of review in submitted documents. The question is do we feel that a development with no improvements are going to increase the hazard on Pleasant view Road.

G. Vernon Weakley spoke that there is section for a rural collector reconstruction shall be 22 feet wide. Read from page 14 of traffic study. He said small increase that the road would be sufficient to carry the small increase in traffic.

H. Dan Small spoke asked if any of us have questions for Mr. Weakley.

I. Mike Guthrie spoke wanted to know what is in the newest submitted plan.

J. City Planner spoke about the distance of the intersection sight distance and how it has changed.

K. Vernon Weakley stated that the intersection is as good as it can get sight distance wise.

L. Martha brook Perry spoke , Stated that she is the attorney for the developer and wanted to speak about the bylaws and covenants on the development, We have tried our best to address the traffic issues through studies and that the classification of the road has not changed and they want to bring a high quality development. This will generate a lot of sales taxes for the town.

M. David Berg spoke and stated that the commission needs to get your head in the game, you guys have killed development thru impact fees, design standards city has not grown, this city should be growing like White House. No property tax guess what I live in Cooperstown and have a property tax. Without guys like Bill Hall, Danny Holt, Dwight Pennington and Mack Wilson, how many people would not have a place to live. Cooperstown is aggressive. we need that sales tax.

N. Mike Armstrong spoke that we are not anti growth I think Mr. Hall is good development. Did Harris Farms meet probably not. I worked with him when I was with the county. This is a Master Plan not a Preliminary this is it. I think this is not smart development. It is not fair to him to change this a bunch of times. I have found some errors. It does not meet.

OLD BUSINESS:

A. Motion to defer Subdivision regulations changes until January so they can be reviewed by more people on website. made by Mike Guthrie 2nd by Jimmy West , motion passes all AYE 7-0

B. Motion to Approve Master Plan for map 010 parcel 56.01 located on Pleasant View Road. 18.20 acres. Current zoning Agriculture, Zoning proposed RPUD Residential Planned Unit Development. Owner Jimmy Peterson, Owner agent Bill Hall. made by Buddy Wright, Motion 2nd by Jimmy West ,

Discussion was brought up

Building Commissioner stated that the project would need to be deferred if the new plan is considered . My recommendation is that we use the existing plans submitted at workshop time. The changes referred in new plan were not applicable.

Buddy Wright spoke, Do you not The use of the land is a part of the rezone and master plan as well as the construction plan. What this seems like is no different than a conventional subdivision.

Mark Goins stated that the master plan sets the density, location and types or house types. Some developments do a plan book that has everything construction plans and master plans together. It can be done separately the master plan is for rezoning.

Town Planner stated that the basically that the master plan set the zoning and it is individual use of the property. Like a legal contract zoning that it must be built to the plan.

Mark Goins stated that we could use the master plan submitted after workshop that everyone has reviewed. The changes proposed by the engineer were only applicable to a Multifamily, town houses are not multifamily by definition.

Heather Hardwick spoke and asked, If what we are voting on tonight is Preliminary master plan and rezone.

City Attorney spoke, About the legislative process and approval for project and legal aspects of approval.

Buddy Wright spoke, About PV downs same width road and empties out on the same width road as PV road. nothing has changed on Pinnacle road. The realty is if you are not planning growth then you are telling your children to go away. this is a good development. There are as many cars there as in this development. The width of Pinnacle road is the same as this road. We should be thinking about the expansion of roads as a city. Cities do this after a development. You cannot use schools and roads as a throttle for development. We have 400 kids graduating every year. if we are not approving at least half of that you are telling them to leave. This does not put a dent in what is need.

Jimmy West spoke, Wanted to expand on what Mr. Wright said, I have been here and listened to recordings. I think we need to consider the growth if it is retirement people, It is much lower impact. I think Winfrey ct. is one of the nicest neighborhood in the town. I think we need to keep things in prospective. I think this would be a great development.

City planner spoke, Couple of more comments to address the this is a open long street they did include curb ins to reduce speed. Amenities should not be as big as having good connection to the park for pedestrians they have included that. The open space does include retention ponds which the park is open space anyway. The fire dept. needs to review the access point emergency gate. The developer has not included any roadway improvements I am concerned that with 3,700 cars a days on the roadway per TDOT count and no improvements on PV road being included.

Mark Goins spoke, The developer has not been open to improving Pleasant view road. The Mayor has inquired to what it would take to widen Pleasant View Road. The ROW is only 30 ft when you cross spring st There is not enough to widen the road that we can give the developer to use new ROW would need to be had. A better solution is completing the road thru the park to the major arterial road 41A. Thus routing traffic around down town where the streets are narrow. The items I had on my comments were the timeline for construction and phasing. The original design submitted is adequate since it is not a collector road in the development.

Buddy Wright asked, If there is a time line for recording the plat. Is there a deadline on commencement of a project.

City planner spoke, about vested rights state laws changes.

Dan Small inquired ,whether or not to recommend for rezone according to the master plan.

Mr. Guthrie Spoke This as I see is the connection of the roadway to the park and the PV roads. 41A connection makes all these problems go away. The street connection is as good as it can be. I believe we can send it on to the board of Mayor and alderman.

Jimmy West spoke, Brought up Winfrey Court and how nice it is. A 41A connection is still possible in the future.

Heather Hardwick spoke, That she is a mom, alderman and business owner in Pleasant view. I work at my station 6 days a week facing Pleasant View road. I have not seen traffic as a major issue. I have never had a issue with traffic at my business I do not want to expand Pleasant view road. I would like to see the 41A connection made. I think this development is going to be a asset to our town.

Stephen Carr spoke, He is trying to be open minded about this development. I think growth comes with difficulties, it is never easy making these decisions. I think it would be a asset.

Buddy Wright spoke, He would stand on his comments earlier. You must have people to get a Publix in town you don't want any growth but I want a Publix store. I support this development.

Tonnie Trotter spoke, She lived on Meadow View Circle and Winfrey Ct. I have had a lot of phone calls. you need to check on what you hear . I spent the last 20 yrs working for economic development. We need a course on what it takes to get economic growth. We don't paid to do this job. looking at the whole thing it's a good development. I do not believe that retired people would want to live by a park. I think we try to do the best and have a good wide variety of people on this board I am going to vote what I think is right.

Dan Small spoke, I am concerned that the developer is not willing to do any improvements on Pleasant View Road. I believe that schools are going to be addressed when there is a need I think there is a need for this. I am not looking forward to extra traffic. Where are our children going to live.

Motion Passes All present Aye 7-0.

C. Construction Plans for map 010 parcel 56.01 located on Pleasant View Road. Mr. Hall requested to withdraw Construction Plans from the agenda before meeting start.

NEW BUSINESS:

A. Motion to approve Proposed Amendments to Zoning Ordinance Article VIII, section 8.050 Pleasant View Board of Zoning Appeals. Introduction paragraph and subsection D item 1.made by Mike Guthrie, 2nd by Buddy Wright. Motion passes all present Aye 7-0

OTHER BUSINESS:

Motion by Mike Guthrie to approve Irrevocable letter of credit amount for Pleasant View Downs phase 1,2 and 4 replat improvements set at $52,475.50 2nd by Dan Small. Motion passes All present Aye 7-0. Bond shall not include sidewalks. Sidewalks to be installed by builders before Certificate of Occupancy issued for homes.

Motion to Adjourn by Tonnie Trotter , 2nd by Mike Guthrie. Motion passes all present Aye.
