RESOLUTION NUMBER: 2008-10

RESOLUTION TITLE: REVISIONS TO PROCEDURES FOR THE DEPARTMENTAL APPEALS BOARD (DAB)

WHEREAS, the Federal Register, December 28, 2007 (Volume 72, Number 248) Notice of Proposed Rulemaking, Revisions to Procedures for the Departmental Appeals Board (DAB) and Other Departmental Hearing proposes that the DAB no longer be the final administrative decision entity of the Department of Health and Human Services (DHHS) but that all DAB decisions be subject to review by the Secretary of DHHS “and would permit the Secretary an opportunity to review DAB decisions to correct errors in the application of law,” and thereby allow DAB decisions to be reversed by the Secretary; and

WHEREAS, the current rules for the DAB set out a fair, quick and flexible process for appeal from final written decisions by DHHS and provides States with an impartial, binding third party final decision making entity to review decisions made by DHHS that impact States programmatically and financially; and

WHEREAS, in 1978, DHHS’s rules were modified so that the DAB decisions would be “final administrative decisions with respect to reconsideration of disallowances arising under various Federal-State public assistance programs.”

NOW, THEREFORE, BE IT RESOLVED THAT:

THE NATIONAL ASSOCIATION OF STATE HUMAN SERVICES FINANCE OFFICERS urges Congress to consider laws to require the Department of Health and Human Services to adhere to the original purpose of the DAB, that the decisions of the DAB be considered the final agency action on all matters of appeal without such decisions subject to Secretarial review and reversal, protecting States’ only avenue of impartial administrative appeal for all DHHS programs.

RESOLUTION NUMBER: 2008-11

RESOLUTION TITLE: TITLE IV-E ELIGIBILITY – CHANGING INCOME ELIGIBILITY TO CURRENT TANF NEED STANDARD PLUS ALLOWING FOR ANNUAL INCREASES TO THE STANDARD FOR CONSUMER PRICE INDEX (CPI) INCREASES

WHEREAS, the Personal Responsibility and Work Opportunity Act of 1996 (PRWORA) requires for a child to be eligible for the Title IV-E Foster Care and Adoption Program that eligibility must be determined based upon the State’s Title IV-A plan in effect as of July 16,1996. For initial eligibility determinations, the State must apply the former AFDC program's two-step income test to establish whether a child would have been considered a "needy child" under the State's title IV-A plan in effect on July 16, 1996; and

WHEREAS, prior to the passage of the Personal Responsibility and Work Opportunity Reconciliation Act of 1996, each State set its own AFDC need standard to use in determining eligibility for the program. The term "AFDC need standard" refers to the amount of money a State determined that a particular size family needed to subsist. The State’s need standard was able to be indexed against cost of living changes on an annual basis; and

WHEREAS, the continued requirement for Title IV-E eligibility to be based upon the 1996 income eligibility standard for the AFDC program is seriously impacting the number of children eligible for Title IV-E funding and Federal participation for the cost of care of children in the Foster Care and Adoption program; and

WHEREAS, the continued requirement for Title IV-E eligibility to be based upon the 1996 income eligibility standard for AFDC impacts the child’s eligibility for medical benefits and access services through the Medicaid program and Adoption Subsidy program; and

WHEREAS, the continued requirement for Title IV-E eligibility to be based upon the 1996 AFDC income eligibility standard negatively impacts those children most at-risk and in-need for support and services in our child serving systems; and

WHEREAS, the continued requirement for Title IV-E eligibility to be based upon the 1996 AFDC income eligibility standard imposes a significant and growing financial burden on states by utilizing an over decade old income standard which increasing limits the number of children to be eligible under the Title IV-E program;

NOW, THEREFORE, BE IT RESOLVED THAT:

THE NATIONAL ASSOCIATION OF STATE HUMAN SERVICES FINANCE

OFFICERS urges CONGRESS to consider changing the link and requirement for eligibility of the Title IV-E program from the 1996 AFDC income standard to current TANF income standard with an allowance for annual increases tied to the Consumer Price Index.

WHEREAS, Stuart Kettner passed away peacefully at home on February 4, 2008, and

WHEREAS, Stuart’s hard work and tireless efforts to support HSFo through his committee chair activities, Board positions, and executive officer responsibilities contributed greatly to the organization, and

Whereas, Stuart will always be remembered by HSFo members for his positive outlook and dedication,

NOW, THEREFORE, BE IT RESOLVED THAT:

THE NATIONAL ASSOCIATION OF STATE HUMAN SERVICES FINANCE OFFICERS expresses its heartfelt sorrow to Stuart’s co-workers and the Oklahoma Department of Human Services for the loss of a great friend and a sincere appreciation to everyone who supported Stuart’s involvement in HSFo so the organization too could share in his friendship.
