Selling your Vehicle with "NO RESERVE" (selling at auction with no minimum sale price)

No Reserve attracts serious bidders. A vehicle being sold at No Reserve indicates to the buyers that it will be Sold to the highest bidder which in turn generates true auction block excitement, which typically equates to higher bids.

MARKETING / ENTRY FEE: $100

AFTER SALE COMMISSION FEE: 5 % (minimum $350)

Selling your Vehicle with a "RESERVE" (selling at auction with minimum sale price)

Selling vehicle with a reserve ensures a vehicle will not be sold for a price lower than seller sets as a bottom dollar. Sellers may decide to lower reserve at any time but may not raise the reserve amount once vehicle is consigned.

MARKETING / ENTRY FEE: $100

AFTER SALE COMMISSION FEE: 7 % (minimum $350)

Terms of Auction

1. Protected price may be lowered at any time by seller. Protected price cannot be raised after auction company has received a

listing agreement. Commission fees shall be deducted directly from the proceeds of the sale of vehicle by Tailpipe Events.

2. If said vehicle is sold within 21 days after the sale to any person as a direct result of the auction, advertising or promotions, then I

shall agree to pay the commission to Tailpipe Events on the stated reserve price.

3. Seller warrants that he/she is sole and only owner and has the right to sell vehicle and has clear consent from lienholder. Seller

agrees to provide buyer with good, clear and transferable title and agrees to correct any title defects and/or pay the cost associated with providing buyer with good, clear and transferable title as required by the state where buyer seeks to register vehicle.

4. Seller agrees to consent to the sale of this vehicle subject to the terms and conditions contained herein and in the Purchase

Invoice and Bill of Sale. Seller authorizes Tailpipe Events to release said vehicle to the successful buyer upon payment in full to Tailpipe Events. In the event that there is a delay in payment for any reason beyond Tailpipe Events control, seller may be asked to retain property or allow Tailpipe Events to arrange proper storage of said vehicle to be paid by bidder/purchaser, until payment has been received in full from bidder/purchaser. Upon payment being received in full by Tailpipe Events, seller agrees to transfer ownership to buyer and make arrangements to meet with Tailpipe Events and/or purchaser to deliver said sold vehicle and title. Proceeds from the sale may be withheld at Tailpipe Events discretion to satisfy any existing debt or obligation owed to Tailpipe Events by the seller. Payment checks for sold vehicles shall be made available to seller usually 3-5 days after the sale. In some rare cases (such as unforeseen title issues etc.) payment may be delayed for additional days or until issues are resolved.

5. Seller acknowledges that it is impossible to predict with certainty the sale times and or process which will be received for auction

items. Accordingly, no such representations is made. Tailpipe Events reserves the right to reject a vehicle not suitable for the auction or with an unreasonable reserve. Seller understands that entry fees are not refundable. Title may be held by Tailpipe Events until any and all funds do clear Tailpipe Events bank or until cash is received.

6. Tailpipe Events shall do our best to protect your consigned items, but we nor Chisholm Trail Expo Center shall not be held

responsible or liable in any way for any damages or loss due to transport, movement or display, including theft, vandalism, water damage or fire. Buyer's and seller's should maintain their own property insurance at all times. Unsold vehicles must be removed from auction property immediately after auction.

7. This document contains entire agreement of the parties and shall be binding on them and respective heirs, personal

representatives and assigns. It shall not be modified, except in writing, signed by Tailpipe Events or at the auction block. This agreement shall be interpreted according to laws in Oklahoma.

8. The parties agree that any action to which Tailpipe Events is a party, the laws of the state of Oklahoma shall be used to interpret

and enforce this contract. The parties agree that in any action to which Tailpipe Events is a party, the proper venue and jurisdiction for any dispute herein shall be either in the Superior court of Payne County, Oklahoma or the district court located in Stillwater, Oklahoma. Purchaser agrees the address which is listed on this contract is the proper address to be used for any service of process.

This document is complete and shall be binding upon the parties and heirs. By signing below, I acknowledge that I have read, understand and agree to the above terms and conditions of this contract.

IMPORTANT TAILPIPE EVENTS VEHICLE AUCTION ENTRY INFORMATION

Title discrepancies must be corrected prior to the auction. Tailpipe Events must be able to locate VIN numbers at check-in and VIN numbers must match Title EXACTLY or vehicle will not be entered into the auction. Please Include a copy of BOTH sides of your title & any attachments with this entry form. Titles MUST be presented to Tailpipe Events Staff when Dropping of Vehicles If selling for someone else or as a broker, a Notarized Power of Attorney or letter from the vehicles owner authorizing you to act as a representative must be submitted with your entry forms and title.

Please Note: Some race cars and motorcycles may be sold on a Bill of Sale. A copy of your purchase agreement will be needed to confirm ownership. Vehicles/Motorcycles sold with a Bill of Sale that are not race machines or off-highway machines will need prior approval before entering the auction.
