Be it enacted by the Town Board of the

of Sandy Creek as follows:

SECTION 1: TITLE

This local law shall be known as the “Local Law extending the term of the Town Highway Superintendent” in the Town of Sandy Creek, County of Oswego, State of New York.

SECTION 2: PURPOSE

The purpose of this local law is to extend the term of office for the Town Highway Superintendent from two (2) years to four (4) years. The Town Board recognizes that the Office of the Town Highway Superintendent is a full-time position, and the Town Board believes an extended term would bring greater continuity to the office, and thus believes that the extended term is in the public’s best interest.

SECTION 3: AUTHORITY

This local law is enacted pursuant to the Town’s authority under Section 23 of the Municipal Home Rule Law of the State of New York.

SECTION 4: APPLICATION

This local law shall extend the term of the Town Highway Department from two (2) years to four (4) years, such four (4) year terms shall commence as of the 1st day of January, 2014, and shall apply to the person elected to such office at the Biennial Town Election to be held on November 5, 2013, and to those elected thereafter.

SECTION 5: EFFECTIVE DATE

In accordance with the provisions of the Municipal Home Rule Law of the State of New York, this local law shall not become operative or effective unless and until it shall have been approved at the next general election held within the Town of Sandy Creek by the affirmative vote of a majority of the qualified electors of the Town of Sandy Creek voting upon the proposition.

This local law shall take effect, if approved as set forth above by the electors, upon the filing with the Office of the Secretary of State.
