Questions and Comments on the text of the Constitution:
1. List a provision(s) in the Constitution which strikes you as strange and why.
2. What do think of Art II, § 1[5]?
3. In studying the text of the Constitution, consider the following questions:
a. What are the unique powers of the executive branch?
b. “Legislative powers” are vested in Congress, but what are “legislative powers”? e.g., Congress often demands information from executive officials, (e.g., Secretary of Labor) and sometimes issues subpoenas to executive officials to appear before it or to bring certain documents. Is demanding such testimony or information a “legislative power”? Did you see anything in Article I that would authorize such action?
c. What benefit did slave states receive in terms of their representation in the House of Representatives?
d. Review X35–41. What in the text of the Constitution authorizes (or forbids) a state from seceding from the Union? If you can find nothing in the text, how do you resolve this question? Is there anything in our history or founding documents that helps answer this question?
