1. Agenda Item Title: Proposed 2012-2013 Tuition and Fees ? UNLV School of Law

2. BACKGROUND & POLICY CONTEXT OF ISSUE: At the April 16, 2010 meeting the Board of Regents approved the FY 12 and FY13 Tuition and Fees for the UNLV William S. Boyd School of Law. Given the 94.2% increase in resident fees for the current biennium, there was no increase for FY12 over the existing FY11 fee level, but the Board did approve a 3% increase in fees for FY13. However, as a result of the Legislative budget reductions for FY12 and FY13, the Law School is presenting a proposal for additional increases in tuition and fees for Board of Regent consideration.
3. SPECIFIC ACTIONS BEING RECOMMENDED OR REQUESTED: To cover the shortages as a result of the State budget reductions for FY12 and FY13 the Law School is requesting approval of proposed increases in tuition and fees.

The projected incremental revenue from the increase is estimated to be ~$1.5M for FY12 over FY11. The Law School proposes to allocate 30% of the increases to Financial Aid and, netting increases of $1M for FY12 to use to address State General Fund reductions.
The legislative budget for FY12/FY13 currently calls for State General Fund reductions of $1.75M in each year of the biennium.
4. IMPETUS (WHY NOW?):

Additional revenues are needed to cover the FY12 and FY13 State budget reductions.
5. BULLET POINTS TO SUPPORT REQUEST/RECOMMENDATION:
? The tuition and fee structure approved in April 2010 by the Board did not assume significant State Budget cuts and was based on the fact that we nearly doubled our fees over the course of this biennium. It was anticipated at the time that the Law School would have the ability to impose an additional emergency tuition increase if significant State budget cuts were imposed for FY12 and FY13.
? There have been significant reductions in expenditures, both staffing and operations, since 2007; additional reductions to meet the Legislative proposed budget would have a major detrimental impact on the Law School.
? The proposed tuition and fee structure still falls within the range of the Law School's Peer Group.
6. POTENTIAL ARGUMENTS AGAINST THE REQUEST/RECOMMENDATION: Any fee increases have an impact on students and should not be pursued.
7. ALTERNATIVE(S) TO WHAT IS BEING REQUESTED/RECOMMENDED:
Implement additional program cuts, including faculty reductions. This would seriously impact the viability of the Law School.

Our FY 11 resident fee was the 8th highest of 13 peer schools whose median tuition in FY 11 was $21,598. Our proposed FY 12 tuition of $23,900 would be the 6th highest if no school increased its tuition but still well below the $28,114 FY 11 mean peer resident tuition.

FY 11 nonresident tuition at Boyd was 8th highest of the 13 peer schools and with 5% of the median. Our proposed nonresident tuition for FY 12 would remain 8th highest if no schools increased their nonresident tuition for FY 12 and would remain just below the $35,514 mean nonresident tuition charged by peers in FY 11.
