It is a pleasure to notify you that your application for a first mortgage loan has been approved subject to the following Terms and Conditions:

In the event a Lock-In Agreement has not been executed and a Commitment has been issued, and the loan does not close before the expiration date of the Commitment through no fault of the Borrower, the Borrower may:

1. Terminate the Commitment, whereupon the Lender shall promptly refund to the Borrower any Commitment Fee paid by the Borrower; or

2. Request that the Commitment be extended for a reasonable period, not to exceed 14 calendar days (which may require an extension fee), to permit Closing.

If you are unable to Close by       , the terms of this commitment expire and your loan will be subject to reverification of the credit documents. At that time, it may be necessary to submit your loan to our Underwriting Department for re-approval.

The provisions of this Commitment cannot be changed prior to the expiration period. The right conferred in this paragraph is not permitted to be modified or waived by the Borrower except for a bona fide personal financial emergency. To modify or waive the right, the Borrower must give the Lender a dated written statement that describes the emergency, specifically modifies or waives this right, and bears the signatures of all Borrowers. Preprinted forms for this purpose are

prohibited. You are approved for this loan if your employment, creditworthiness and financial position does not materially change prior to Closing and subject to the following additional conditions are fully satisfied:

Underwriting Conditions:

The following conditions must be in our office as soon as possible to prevent any delays in settlement. Upon receipt, the underwriter must review and approve all documentation. You will not be able to close until all underwriting and closing conditions have been met.

1. Additional Conditions may apply upon receipt and review of any provided documentation.

This Commitment is based on information contained in your Loan Application regarding your income, employment and financial situation. Should there be any material changes in your financial status, capability (including, without limitations, changes in employment, assets, debts or credit history), and/or any changes in subject Property’s condition prior to Closing, it may be necessary to submit your loan to our Underwriting Department for re-approval. We reserve the right to modify or withdraw our Commitment if any material changes have occurred.

By your acceptance, you agree to exercise every reasonable effort to comply with all terms and conditions of this Commitment. Should this loan not close, or if you fail to exercise every effort aforesaid, this commitment will automatically expire.
