Dear Burkett Properties,

At this time I can no longer continue to rent my apartment, Unit Number________________________located at ______________________________________________, Miami Beach, FL and as a result, I realize that I will be breaking my one-year lease agreement with you. I will be vacating the apartment (should be at least 60 days from the date of this agreement and calculated to end on the last day of any month) on _____________________________________(Date).

As a result of my breaking the lease agreement with your company, I understand that there may be costs and losses incurred by Burkett Properties. Therefore, I agree to increase, via a cashier’s check delivered with this executed agreement, my security deposit by an amount equal to two months rent and immediately pay to Burkett Properties any outstanding balance on my account. To qualify for this special arrangement, I agree to increase my security deposit by $_____________________. 00 (rent x 2) & pay $___________________. 00 (any outstanding balance to date) with submission of this agreement.

I furthermore agree to continue to pay my regular monthly rent, for at least 60 days calculated to end on the last day of any month, from the date of this agreement and through the date of my departure as stated above. I acknowledge and understand that I will be held responsible for any damage to the apartment, except for normal wear and tear. I promise to return all apartment and mailbox keys to your office on the day I move out. Additionally, I promise to remove all personal belongings and furniture from the apartment and building, not to place garbage or furniture in the trash area or property, obey all my lease regulations and clean up my unit before I vacate. I agree that Burkett Properties may show my apartment at any time during normal working hours and after working hours by appointment. I also agree and acknowledge that as of this date I have absolutely no outstanding issues, including but not limited to maintenance issues with my unit or any outstanding issues whatsoever with the Rental Office or Burkett Properties, Inc, its employees, agents, affiliated or related companies or representatives thereof. I understand that if Burkett Properties finds a tenant who qualifies for the apartment and said tenant subsequently rents the unit, I understand that I may receive a prorated refund of my security deposit subject to all terms herein. This prorated refund may be paid after all applicable fees, expenses and/or costs including costs for damage to the unit and any lost rent following my departure have been deducted from my security deposit. Lost rent is anytime the landlord is not collecting rent on the unit and before a new tenant has taken occupancy of said unit, paid all amounts due for same in full and has begun paying regular rent on the unit.

All disputes, with the exception of collection efforts by Burkett Properties for money owed pursuant to this agreement, between the parties concerning the provisions of this agreement shall be submitted to binding arbitration pursuant to the State of Florida with all fees shared equally. If I fail to honor any part of this agreement or owe money pursuant to this agreement, beyond the amount of my security deposit from which all claims shall be first be set off against, I unconditionally authorize Burkett Properties, Inc. to use all available methods of collection to recover the outstanding amounts due from me and hold me responsible for all costs associated with said collection efforts. I understand that in order to have my liability terminate with respect to my lease agreement, all terms of this break lease agreement must be fully complied with, all money due and any lost rent on the unit shall be paid as required and that there shall be no modifications by tenant to this agreement whatsoever. As an inducement for Burkett Properties to enter into this agreement, it will not be necessary for Burkett Properties to send me a notice of intent to deduct damages/money from my security deposit, otherwise known as a 15-30 day letter as outlined in chapter 83 of the Florida Statues. Burkett Properties will, once the unit is vacated, inspect and repair the unit, if necessary. Once the unit is rerented and upon written request, Burkett Properties will forward to me an accounting of my security deposit. Said accounting will be emailed or mailed to tenant’s last known address.
