1. TAXES, SURCHARGES AND FEES

The Customer is responsible for the payment of any sales, use, excise, access, utility user or other local, state and federal taxes, charges or surcharges, howsoever denominated, (excluding taxes on the Company’s net income) imposed on or based upon the provision, sale, or use of any service provided pursuant to this tariff.

All such taxes and surcharges shall be itemized on the Company’s bills to the Customer.

Pursuant to Resolution T-16901, all telecommunications carriers are required to apply CPUC

mandated Public Program surcharge rates (excluding a. Universal Lifeline Telephone Service (ULTS) billings; b. charges to other certificated carriers for services that are to be resold; c. coin sent paid telephone calls (coin in box) and debit card calls; d. customer-specific contracts effective before 9/15/94; e. usage charges for coin-operated pay telephones; f. directory advertising; and g. one-way radio paging) and the CPUC Reimbursement Fee rate (excluding a. directory advertising and sales; b. terminal equipment sales; c. inter-utility sales) to intrastate services. For a list of the Public Program surcharges and Reimbursement Fee, and the amounts, please refer to the Pacific Bell website. (T)

1.1 Surcharge to Fund California Relay and Communication Devices Fund

1.1.1 Applicability

This surcharge is for the purpose of funding the California Relay and Communication Devices Fund and applies to the uniform billing base of intrastate Customer billings as defined by the California Public Utilities Commission in Decision 94-09-065 (“uniform billing base”), as modified from time to time by said Commission.

1.2 Administrative Service Fee

The Administrative Service Fee includes a number of administrative fees and charges that apply to all rate schedules. It does not include any Government Mandated Taxes and Surcharges which are listed separately

and not retained by the Company.

The monthly ASF is determined based on the following invoice charges: 1) all billed intrastate and interstate monthly and prorated recurring charges, 2) all billed usage charges including local, intraLATA toll, intrastate, interstate, and international long distance, inbound toll free, and Directory Assistance calls and 3) all billed Federal subscriber line charges.

The ASF does not apply to Residential or Wholesale customers who have a reseller certificate.

1.3 Regulatory Cost Recovery Fee

The Regulatory Cost Recovery Fee (RCR) is an end user charge, assessed as an access line factor per circuit unit of local, intrastate, interstate, international, and private-line services.

Monthly Fee

$1.52

This fee will be charged per line to all residential customers unless they qualify for low income programs.
