ESSAY QUESTION

Jim Beasley is a 14-year-old eighth grade student at Dunder Middle School, a public school. During second period one day, he was taken to the principal’s office by a Student Resources Officer ("SRO") after getting into a fight in gym glass.

The principal sat behind his desk and told Beasley to sit in the chair across from him. The gym teacher sat in another chair next to Beasley. The office door was open, and the SRO stood in the doorway behind Beasley. The teacher told the principal that a fight broke out between Beasley and another student, Dwight Martin, and that he saw Jim hit Dwight in the head.

The principal asked Beasley if this was true. Beasley said:

“Dwight was picking on Pam in class, and I told him to stop. He said ‘what are you gonna do about it’ and pushed me. I said ‘you better not start with me’ and crossed my arms. Dwight got in my face and started calling me names. I started to walk away, and he called me a bad name, so I turned around and pushed him and told him to quit. He was yelling at me and calling me names. He said ‘Beasley fights like a girl,’ and then he pushed and started to walk away. He told the other guys ‘Beasley is just a stoner and a loser,’ and I hit him on the side of the head to get him to shut up. He fell down, and then the teacher came over and broke it up.”

The principal asked Beasley if there was any truth to the statement that he is a ‘stoner.’ Beasley looked down and did not answer the question. The principal asked Beasley if he smokes marijuana, and Beasley responded “maybe sometimes.” The principal asked Beasley if there was anything illegal in his backpack, and Beasley stated “no.” The principal then said that Beasley needed to be honest, or he would get in more trouble. Beasley said that he had a pocketknife in the front pocket of his backpack, but said “that is all, I swear.” The principal unzipped the front pocket of the backpack and retrieved the knife; although possession of a pocketknife is not illegal, knives and weapons are administratively banned from school grounds. When he reached into the front pocket, the principal could see an empty 1” square baggie inside. The principal knew that high school students often carry marijuana in small “dime bags.” He then thoroughly searched the backpack and found another “dime bag” containing a small amount of marijuana at the bottom of a zipped pocket of the bag. Beasley said that the marijuana was not his, and he did not know how it got into his backpack.

At this point, the SRO stepped into the office and collected the evidence. The SRO placed Beasley under arrest for Battery and Possession of Marijuana on School Property.

For his defense, Beasley’s attorney filed motions to suppress the marijuana and all statements made by Beasley.

Discuss the merits of the suppression motions, citing to relevant authority.
