General Statement: Under the general supervision of the Supervising Nursing Education Consultant the Nursing Education Consultant (NEC), is involved in various programs and services provided by the Board of Registered Nursing in its implementation of the Nursing Practice Act. Duties include, but are not limited to, the following:
A. SPECIFIC ASSIGNMENTS [Essential (E) / Marginal (M) Functions]
40% (E) Education Activities
Utilize and disseminate results of relevant educational research to foster educational program improvement. Offer evidence-based nursing education expertise and consultation. Provide ongoing consultation to proposed and currently approved pre-licensure and advanced practice nursing education programs ensuring approved program curricula prepares safe, competent registered nurses and advanced practice nurses. Conduct comprehensive program and interim approval visits, according to a schedule determined by the Board, and as necessary, to facilitate compliance with the regulations. Review and approve faculty, clinical facilities, and all major and minor curriculum changes for assigned programs according to Board policies and guidelines. Assist nursing education programs to eliminate education barriers and course or content redundancies and support program efforts in the development and use of effective instructional methods and delivery models. Submit requisite written reports and provide expert consultation to the Board on education related matters. Monitor program NCLEX-RN pass rates and ensure programs institute viable action plans to improve NCLEX-RN pass rates. Provide ongoing orientation and support to program directors, assistant directors, and faculty, and interpret regulations for institutional administrators when needed. Maintain currency in curriculum development, nursing theories, and methods of instruction as well as identified nursing specialty or practice areas. Participate in local, statewide, and national educational activities and events relative to the Board’s regulatory authority and jurisdiction. Maintain a visible, credible, public face within the profession and effectively represent and articulate the role of regulation in nursing education, practice and health policy development.
30% (E) Nursing Practice Activities
Interpret and provide consultation on the laws and regulations related to registered nursing and advanced practice nursing for the legislative and executive branches of the State, Board staff, other government agencies, the general public, health care agencies, professional organizations, and other nursing stakeholders. Respond to inquiries regarding nursing practice and other highly technical nursing and health care issues. Prepare and disseminate evidence-based research reports and presentations on nursing workforce and nursing practice issues. Provide expertise to the Board and other nursing stakeholders and facilitate work groups and task force activities on a variety of nursing practice matters including trend forecasting, workforce and workplace issues, medical and technological advances, emerging consumer protection and health and safety issues, and related health policy development, implementation and evaluation.
20% (E) Enforcement Activities
Design and participate in probation matters including approval of work sites and education remediation activities. Consult with probation staff in monitoring complex cases. Provide consumers and nursing stakeholders information and referral resources when potential violations of State laws and regulations impacting safe nursing practice are identified. Respond to telephonic, electronic, and in person inquiries relative to possible violations of the Nursing Practice Act. Provide consultation to the Board’s Enforcement Program, Intervention Program, and Investigation Program regarding nursing practice complaints. Respond to continuing education provider appeals and complaints. Research, analyze, and prepare case evaluations of complex cases and provide expert testimony in administrative law hearings.
10% (E) Committee Activities, Other Assigned Liaison Activities, Special Projects, and Specialty Nursing Areas
Provide required staff work and support to assigned Board units and committees, including but not limited to: Education/Licensing, Nursing Practice, Legislative, Intervention/Discipline, the operational units of the Board, and the Department of Consumer Affairs.

The NEC reports to, and is under the general supervision of the Supervising Nursing Education Consultant, but may receive assignments from the Executive Officer and Assistant Executive Officer.

E. Personal Contacts
The NEC has frequent contact with registered nurses and registered nurse employers, nursing educators and students, professional organizations, state and federal agencies, the public, other nursing education consultants and Board staff. Provide occasional consultation to Deputy Attorneys General, the Division of Investigation, other governmental agencies, and professional organizations in the performance of nursing practice. The NEC makes presentations before Board committees and the full Board.
F. Actions and Consequences
Failure to provide expert nursing education consultation related to practice issues including correct interpretation of nursing laws and regulations could result in unsafe, negligent nursing practice, and inadequate consumer protection.
Failure to provide expert nursing education consultation to monitor and evaluate pre-licensure and advanced practice nursing education programs could result in registered nursing and advanced practice program students and graduates not having sufficient educational preparation and opportunities that require the requisite knowledge, skills, and abilities needed to safely and competently perform required nursing functions.
Failure to use nursing education consultant expertise to review and approve job requests and remedial education for nurses on probation could jeopardize public protection and result in registered nurses and advanced practice nurses practicing when they are unsafe or incompetent.
G. Functional Requirements
The incumbent is a Work Week Group E employee and is expected to work an average of 40 hours per week each year and may be required to work specified hours based on the business needs of the office. The incumbent is required to travel throughout an assigned geographical area by various methods of transportation. The use of computers, telephone, copier, fax machine and knowledge of computer software programs such as Word, Excel, E-mail and Powerpoint are essential. The position requires bending and stooping to retrieve files, sitting, standing and walking consistent with office work, and occasional light lifting of no more than 20 lbs.
H. Other Information
This duty statement encompasses the professional consultant class specifications described within Nursing Education Consultant Class Code 8250, revised September 16, 1997, as published by the California State Personnel Board. This position requires an active, valid California registered nurses license.
To perform the duties of this position, the NEC must have fingerprint clearance. This is a CORI sensitive position.
Title 11, section 703 (d) of the California Code of Regulations requires criminal record
checks of all personnel who have access to Criminal Offender Record Information
(CORI). Pursuant to this requirement, applicants for this position will be required to
submit fingerprints to the Department of Justice and be cleared before hiring. In
accordance to DCA’s (CORI) procedures, clearance shall be maintained while
employed in a CORI-designated position. Additionally, the position routinely works with
sensitive and confidential issues and/or materials and is expected to maintain the
privacy and confidentiality of documents and topics pertaining to individuals or to
sensitive program matters at all times.
This position is subject to Title 16, section 3830 of the California Code of Regulations,
the Department of Consumer Affairs’ Conflict of Interest Regulations. The incumbent is
required to submit a Statement of Economic Interests (Form 700) within 30 days of
assuming office, annually by April 1st, and within 30 days of leaving office.
