Under the general supervision of a Staff Services Manager I (SSM I), the Staff Services Analyst (SSA) will provide a less complex analyses of internal and external discrimination complaints at their assigned institutions, parole regional offices, or other departmental offices; review complaint allegations; and manage a caseload of complaint filings ensuring efficiency, timeliness, and completeness. The SSA will review and compile information relative to an assigned discrimination complaint and identify possible staff discrimination.

ESSENTIAL FUNCTIONS:

35% Reviews, evaluates, and provides a less complex analyses of external and internal discrimination complaints. Communicates with Hiring Authorities or their managers and involved parties, gathering relevant information. Prepares and presents recommendations to the Hiring Authority regarding employment discrimination laws, regulations, best practices, and CDCR policies. Communicates effectively with Superintendents, Wardens, Parole Regional Administrators, Chief Executive Officers, and other Hiring Authorities throughout the complaint process. Completes EEO complaints in a timely matter to ensure all Statutes of Limitations for disciplinary actions against CDCR employees are met.

30% Under guidance, reviews, processes, and responds to formal discovery requests (interrogatories, subpoenas, position statement request, and request to produce) from external agencies that are used by those enforcement agencies to compel a respondent to produce documentation in a formal manner. Responds orally and in writing to attorneys representing external agencies and charging parties during an external agency investigation, in subsequent court actions, or with settlement discussions. Review and evaluates complaint information, using the analytical legal framework developed by DFEH, EEOC, and the courts. Provides technical advice regarding EEO complaints and related case law for the assigned institutions, parole regional offices, or other departmental office. With direction from the SSM I, refers sensitive cases and potential liability issues to the Office of Legal Affairs.

15% Assists the SSMI/AGPA with EEO/SH complaint training on a statewide basis, in group settings, and one-on-one on-the-job training for CDCR employees. Attends meetings regarding EEO and civil rights issues within and outside CDCR.

10% Testifies at administrative and civil hearings and depositions, to support the findings of the Department on the most complex and difficult cases.

10% Performs other job related duties as required including, but not limited to, making recommendations on procedures and policies, EEO training development, modification and revision, and completing assignments required to meet OCR operational needs.

ESSENTIAL FUNCTIONS AND SKILLS:

Knowledge of California Fair Employment and Housing Act, California Family Rights Act, California Ralph Civil Rights Act, U.S. Title VII, U.S. Americans with Disabilities Act, U.S. Family Medical Leave Act, EEOC guidelines, Department policies and procedures; and rules of evidence; methods of compiling and presenting data. Possess and exercise analytical, time management, organizational, and writing skills.

The SSA will have the ability to conduct complaint reviews in the most sensitive cases throughout the assigned CDCR institutions, parole regional offices, or other departmental offices in a tactful and judicious manner. The SSA shall demonstrate competence, objectivity, and emotional stability; and travel throughout California to CDCR facilities as assigned.

Skills required to perform the essential functions of the position include the ability to communicate effectively both verbally and in writing, read and comprehend written instructions, manuals, and correspondence, and to reason logically while exercising analytical skills.

The SSA must be able to use office equipment including a FAX/copy machine, computer, and voice recording devices. Must have physical ability to sit for extended hours, read handwritten and typed reports and documents, lift and carry up to 20 lbs. on an occasional basis. Work hours may extend past a normal eight-hour work schedule. Overnight travel is required.

DESIRABLE QUALIFICATIONS

Work experience equivalent to five years at a journey level EEO/civil rights analyst or EEO investigator in a state department or three years of experience in a state or federal civil rights enforcement agency.

SUPERVISION RECEIVED

The SSA receives general supervision from the SSM I, and may receive direction from the Staff Services Manager II, OCR Associate Director, OIA Deputy Director, Chief, Headquarters Operations or Chief, Field Operations.

ADMINISTRATIVE RESPONSIBILITY

Adhere to all applicable laws, rules, policies, procedures, and court precedence, including OIA Directives and the EEOC Compliance Manual.

PERSONAL CONTACTS

The SSA has contact with Wardens, Superintendents, Regional Parole Administrators,

Chief Executive Officers, Executives, managers, supervisors, EEO coordinators, staff, complainants, respondents, witnesses, external enforcement agencies, Departmental attorneys, and private legal representatives.

PHYSICAL DEMANDS: The physical demands described here are representative of those that must be met of an employee to successfully perform the essential functions of this job.

Standing: Frequently - stands for periods of time to file/re-file, at the copy machine, fax machine or printer.

Walking: Frequently - to file or copy documents or retrieve documents from the fax machine, from different office areas, hand deliveries. Also carry property received on occasion

Sitting: Frequently - at a desk or computer table. There is a flexibility for movement on a frequent basis to break sitting with standing and walking.

Lifting: Frequently - lifts files and occasionally property received weighing a few ounces up to 30 pounds each.

Carrying: Occasionally - this activity can be considered to require the same physical demands as lifting.

Stooping/Bending/Kneeling/Crouching: Frequently - stretches stoops/bends, kneels, and crouches to pull/re-file documents from the lower shelves in filing cabinets, move boxes, files, furniture, and open property received.

Reaching in Front of Body: Frequently - will be utilizing a keyboard and reaching for items such as the telephone, 10-key, files, boxes, property received, and over furniture.

Reaching Overhead: Frequently - reaches overhead to retrieve files from the top shelf of the file cabinet, shelving, or to open property on pallets.

Climbing: Frequently – the office is located on the second floor of building – will use stairs if elevator not working.

Balancing: Occasionally- walking and holding files, small boxes or archive documents.

Pushing/Pulling: Frequently - has to push/pull to open file drawers and desk drawers or to assist with confidential shred process.

Fine Finger Dexterity: Constantly - will use fine-finger dexterity to write information onto documents and to type information into the computer.

Hand/Wrist Movement: Constantly - uses hands and wrists in the handling of documents, files and typing information into the computer, moving/opening file boxes, folders, small items in receiving.

Crawling: N/A

Driving: N/A

Sight/Hearing/Speech: Adequate vision, hearing and the ability to speak clearly are required to effectively perform the essential job duties.

WORK ENVIRONMENT: Position is located indoors, in an office space. Indoor ventilation provided by heating/air conditioning system and ductwork.

MACHINES, TOOLS, EQUIPMENT, AND WORK AIDS: Computers, printer, fax machine, photocopier, shredder, telephone, 10-key, and usual office supplies.

COMMENTS: Work hours are from 8:00 a.m. to 5:00 p.m., Monday thru Friday.
