NOT REQUIRED ?GENERAL STATEMENTUnder the direction of the Staff Services Manager II, the Associate Governmental Program Analyst is responsible for the development, outreach, and monitoring of discrimination prevention/equal opportunity training and compliance for traditional apprenticeship programs; conducts research, analysis, and uses independent judgment and discretion to interpret and apply statutes, regulations, policies and procedures to specific situations. The analyst also compiles and reports findings as well as makes necessary recommendations to apprenticeship program sponsors and DAS Management, designs and develops the discrimination apprentice complaints process, and examines and evaluates complaint files.As a full journey analyst the duties and responsibilities require the performance of the more responsible, varied, and complex technical analytical staff services assignments which include consulting services to management and apprenticeship program sponsors; evaluating apprenticeship program anti-harassment training and ensuring compliance with statutes, rules, and regulations; creating and maintaining reports (activity and of a compliance nature). The Incumbent develops into a subject matter expert on apprentice discrimination prevention and monitors programs to ensure the implementation of legislatively mandated requirements. Duties require multi-tasking, meeting priority deadlines, as well as maintaining necessary project and workload management. Travel may be required.% OF DUTIESESSENTIAL FUNCTIONS40%Design and develop discrimination apprentice complaints process in accordance with Labor Code § 3073.9 and Assembly Bill 2358. Analyze discrimination apprentice complaints for violation elements under California law. Audit documentation and interview witnesses. Develop tracking mechanisms to track program efficiency and data metrics utilizing the California Apprenticeship (CAS) database system or any other technology.Examine complaint files and evaluate the complaint merits by analyzing legal standards, defenses, and exceptions applied under the Fair Employment and Housing Act (FEHA), and any interpretive guidance issued by the DFEH, to determine if discrimination violations occurred. Develop a legal assessment for the Office of the Director’s Legal Unit, Represent the Division by examining and preparing cases for hearing following the requirements in Title 8, California Code of Regulation, §202 and §203. Document the progress of the investigation by following-up with the Legal Unit to ensure timely resolution and responses to complaints. Prepare correspondence in the CAS database and distribute to all parties involved in the complaint process.35%Provide detailed analysis and implementation of discrimination prevention and equal opportunity outreach and training efforts legislatively mandated for apprentices and apprenticeship programs in the building and construction trades. Maintain thorough and up-to-date discrimination prevention/anti-harassment and equal opportunity materials in electronic and print media. Identify training opportunities and resources to meet the discrimination prevention and equal opportunity legislative requirements. Act as a discrimination prevention liaison between internal and external stakeholders, attend anti-discrimination workshops and training/outreach events, stay current on anti-discrimination/equal opportunity communications and updates, and synthesize information and data into reports and the division’s training materials. 20%Develop and provide analytical consultative and monitoring services to apprenticeship program sponsors and apprentices. Provide technical assistance for apprenticeship programs to ensure they comply with all anti-harassment and discrimination prevention laws.
