VISTA DEL LAGO ASSOCIATION

RULES AND REGULATIONS

These Rules and Regulations have been established by the Board of Directors of Vista Del Lago Association in accordance with the Declaration of Restrictions. Ownership or residency constitutes acceptance of responsibility for the upkeep, maintenance and compliance with the Declaration of Restrictions, By-laws, and Rules and Regulations governing Vista Del Lago Association.

GENERAL STATEMENT

1. The Rules and Regulations contained herein apply to all owners and tenants of Vista Del Lago and are published under the provisions of the Declaration of Restrictions.

2. It is the intent of the Board of Directors that these Rules and Regulations shall not be in conflict with or diminish the effect of the Declaration of Restrictions or By-laws of the Association. These Rules are supplementary to those documents.

3. These Rules may be amended or replaced in their entirety by action of the Board of Directors.

4. Owners are responsible for providing Tenants with copies of these Rules and Regulations and the By-laws and ensuring their understanding of the Declaration of Restrictions and By-laws.

5. Each owner is liable for any property damage occurring to the common area as a result of actions by his family, tenant, or any invited guest in his unit. The Board of Directors has the authority to levy fines and/or restrict residents use of private streets. Flagrant violations, or violations which pose a serious threat to persons or property will result in immediate action. Residents will make restitution for property damage.

6. Inform Management promptly of any change of ownership of your property. If you are a non-resident owner, keep Management advised of your address and telephone number.

7. Tenants are welcome to attend the Board and Association meetings; however, only owners may vote.

PET CONTROL

City of Murrieta Animal Control (L.E.A.F.) (951) 674-0618; Hours: 10:00 a.m. - 4:00 p.m. Monday - Saturday.

1. All dogs are required to be licensed by the City of Murrieta.

2. There shall be no more than two (2) pets per household (this does not include birds). Very large or exotic types of pets are not permitted. No barnyard animals are allowed. Owners retain the right to restrict or deny pet maintenance.

3. Pets may not be tied and left unattended in any of the common areas. Pets may be tied within their apartment area or confined inside the residence or backyard area. The City of Murrieta leash law applies in Vista Del Lago. Dogs must be walked on a leash, attended by a person capable of handling and restraining the animal.

4. Pet owners are responsible for the actions and behavior of their animals at all times and should see that such action and behavior is not disturbing to others. Pet owners are liable for all damage caused by their animals.

5. Pet droppings on lawns, bushes, sidewalks, or other common areas must be cleaned up immediately by the Owner or the person caring for the animal at that time.

6. No breeding of pets for commercial purposes is allowed in Vista Del Lago.

7. Excessive and continued barking of dogs is not allowed.

8. Homeowner/Tenant is/are liable for any damage occurring to person(s) and/or property by pets brought within Vista Del Lago by invited guests and/or family members.

TRASH DISPOSAL

All rubbish and trash storage facilities shall be kept screened and concealed within the enclosed Dumpster. All rubbish, trash, or garbage shall be regularly removed from each Residential Lot and shall not be allowed to accumulate thereon or on the adjacent Common Areas, except in designated trash collection areas.

PARKING AND SAFETY

1. Maximum speed limit throughout Vista Del Lago is twenty-five (25) miles per hour and 5 M.P.H. on driveways. All California Vehicle Codes pertaining to private streets are enforced within Vista Del Lago.

2. No vehicle may stand or be parked for longer than eight (8) hours on the Common Area of the project within any twenty-four (24) hour period, with the exception of recreational vehicles which may be parked overnight the day preceding a trip and the day following a trip.

3. No trucks, campers, tent campers, boats, trailers or recreational vehicles in excess of 1,500

lbs. shall remain in guest spaces, driveways, or streets.

4. Trucks, trailers, tractors, or motor homes are not permitted in the project except for

loading and unloading. See #2 above with respect to temporary RV parking.

5. No parking is allowed on lawns.

6. No one shall block a Resident’s driveway without an owner’s permission.

7. Vehicles parked in driveways, streets and parking areas must be operable and currently registered.

8. No major vehicle repairs will be allowed except in an enclosed garage. It is the intent of this section to limit personal used to infrequent activity and forbid all commercial usage.

9. Homeowners and Tenants are responsible for the cleanup of any spillage of oil, coolant, or other unsightly materials which they, or their guests may deposit on Common Areas or driveways or Lots. Use of a drip pan on the driveway is acceptable and recommended. However, an excessive amount of oil and/or grease accumulation on an Owner’s driveway and/or drip pan must be promptly removed or cleaned. In addition, the drip pan must be put away when there is not a motor vehicle standing over it.

10. Garage doors should be kept closed both for aesthetic value and security reasons, except when using the garage.

MISCELLANEOUS

1. No business or commercial activities may be conducted in any unit per Article 3, Letter O

of the CC&Rs for the Association.

2. Storage of any personal items on the private streets and/or driveways is prohibited. Storage

of items on enclosed patio areas must be kept below the fence line. The hanging of rugs,

blankets, etc. on walls and/or fence is prohibited. Private patio areas are to be kept free of

trash and litter to discourage pests.

3. Loud music is prohibited. Loud parties are prohibited after 10:00 p.m.

4. All windows visible from common areas (private streets) must be of a conventional nature,

such as drapes and curtains, decorator blinds, shutters and shades, and kept in good

condition. Foil, paper, bedsheets, blankets, towels and other makeshift materials are not

permissible.

REPORTING DAMAGE

As a Vista Del Lago resident, it is your responsibility to report damage or abuse directly to the owner, security or Management or (in an emergency) to a Board Member. If graffiti appears on Association property, Management should be informed immediately. Graffiti should be considered a serious problem and corrected at once. Any resident involved shall be fined and/or prosecuted in accordance with the law.

GARAGE SALES

One garage/yard sale per year, including moving or estate sales is permitted. Any and all garage sales will be conducted on the same date to be determined by the Board of Directors. Any exceptions to this must be submitted in writing and approved by the Board of Directors.

POLICY FOR PROCESSING COMPLAINTS

All complaints shall be submitted in writing to the Board through Management. The Board, acting as the Complaint Committee, will review all complaints a minimum of once a month and take appropriate action. Complaint forms are available through Management upon request.

VIOLATIONS –OWNERS RIGHT TO DUE PROCESS

If a member violates any of the Rules and Regulations, or the Declaration of Restrictions, they will receive a letter informing them of the infraction and requesting corrective action.

If a member wishes to protest the alleged violation, they must request a Hearing before the Board of Directors. The request for a Hearing must be made in writing within ten (10) days from the receipt of the letter notifying the member of the violation. Such requests are to be submitted by the member to Management.

If the violation persists, or if the violation is of a serious nature, the Board will issue a written request for the member to appear at a Hearing to resolve the matter.

CONFLICTS

If there are any conflicts or inconsistencies between these Rules and Regulations and the provisions of the Articles of Incorporation, the By-laws, and Declaration of Restrictions, the terms and provisions of the Declaration of Restrictions shall control.
