Policy

Employees who qualify for statutory holiday pay shall receive holidays with pay as per the following procedures.

Procedures

Permanent full-time employees who qualify for statutory holiday pay shall receive the following statutory holidays with pay:

• New Year’s Day

• Good Friday

• Canada Day

• Labour Day

• Thanksgiving Day

• Victoria Day

• Christmas Day

• Boxing Day

1. An employee is not entitled to a day off with public holiday pay if he/she fails, without reasonable cause, to work all of his/her last regularly scheduled day of work before the holiday or first regularly scheduled day after the holiday.

2. An employee who is scheduled to work on a public holiday and, without reasonable cause, fails to perform all of the work agreed to (or required) on that day is not entitled to public holiday pay or to a substitute paid day off (although premium pay—1½ times the employee’s regular rate— for each hour worked shall still be paid). The same applies to an employee who has a reasonable cause for not performing all of the work on the holiday but who, without reasonable cause, failed to work all of his/her last regularly scheduled work day before or first regularly scheduled day of work after the public holiday.

3. An employee who is employed under an arrangement whereby he/she may elect to work or not when requested to do so is not entitled to public holiday pay, but must nevertheless be paid 1½ times his/her regular rate for work performed during a public holiday.

4. Part-time employees who qualify for statutory holiday pay shall receive averaged holiday pay for recognized statutory holidays.

5. In order to qualify for statutory holiday pay, an employee must fulfill the conditions specified in the Employment Standards Act.

6. In the event that a recognized statutory holiday occurs during an employee’s vacation period, it shall not be counted as a vacation day.

7. An employee on a leave of absence without pay, on Workplace Safety and Insurance Board (WSIB) benefits, or on Long Term Disability at the time of the holiday, is not eligible for statutory holiday pay.

8. An employee has the right to request a substitution of a statutory holiday in order to observe religious holidays of his/her faith.

9. A substitute holiday in lieu of a paid holiday must be taken within 30 days of the designated paid holiday, unless prior approval has been granted by the supervisor.
