RE: PRUCOL Verification

The term PRUCOL (Persons Permanently Residing under Color of Law) refers to persons residing in the U.S. who are known to the immigration authorities and whose extended presence in the U.S. is accepted by those authorities. Some PRUCOL individuals may not have been granted an official legal status.

Examples of PRUCOL include individuals:

• With deferred action status

• With approved immediate relative petitions

• With indefinite stays of deportations

• With indefinite voluntary departures

• With stays of deportation or grants of voluntary departure where deportation is not contemplated

• Under an order of supervision

• Who meet the registry date

• Who have temporary protected status

• Who are applicants for asylum

For MassHealth purposes –an individual with PRUCOL status is an Alien with Special Status (AWSS)

• May qualify for:

o MassHealth CommonHealth (Child under age 19 only)

o MassHealth Family Assistance (Child under age 19 only)

o MassHealth Essential plus Limited (Disabled/LTU Adult age 19-64; or Age 65 and older)

o MassHealth Limited

o Children’s Medical Security Plan

o Healthy Start

o Commonwealth Care

o Health Safety Net

Acceptable verification of PRUCOL status:

• Applicant/member must supply documentation from United States Citizenship and Immigrations Services (USCIS) showing either that he or she has one of the types of PRUCOL or that the individual satisfies the general definition of someone who is known by the immigration officials to be residing in the US and whose deportation/removed is not contemplated. Generally, this will require documents from the USCIS or other immigration authorities.

• Proof of having lived in the U.S. since before 1972

• When an applicant/member submits immigration documentation, the “Provision of Law” or “Category” code is used to determine the appropriate immigration status.

• The chart below highlights most common codes to indicate PRUCOL.
