Lazar St., postal code 300081, registered with the trade registry under number J35/1133/2003, having sole registration code RO 15434490 (the “Company” or “Deltatel”) we hereby inform you of this Information Notice regarding the processing of personal data of the candidates (hereinafter referred to as the “Information Notice”), in order to provide you an overview of our practices regarding the collection, registration, organization, structuring, storage, adaptation or modification, extraction, consultation, use, disclosure by transmission, dissemination or making otherwise available, alignment or combination, restriction, deletion or destruction of personal data (hereinafter referred to generically as “Processing”).Categories of personal dataFor the purpose of Processing mentioned in point III below, we process your personal data provided during the recruitment process – hereinafter referred to as "Personal Data", as follows: name, surname, telephone number, home address, e-mail address, citizenship, nationality, date of birth, country of birth, information on studies completed, information regarding training, information regading previous employers, family members, family situation, photos provided in your CV (if applicable) , data disclosed in the letters of intent provided (if applicable).Purpose of ProcessingWe process your Personal Data to the extent permitted or required by the applicable law, for the purpose of your recruitment as an employee of Deltatel, as we will detail below. We will use the Personal Data, as provided by you to Deltatel, only for the purpose mentioned in this Information Notice.Deltatel processes your Personal Data in order to identify and evaluate your application, your skills, qualifications and interests in relation to the available position for which you have been contacted or for which you have contacted us, for the preparation and conduct of interviews, as well as for conducting verifications, according to requirements of the applicable law.Basis of the ProcessingOne of the essential requirements of Regulation no. 679/2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (“GDPR”) is that any Processing of Personal Data must have a basis legal.The processing of Personal Data is necessary in order to carry out the activity specific to the purpose of the Processing, as detailed in point III above, more precisely, your recruitment as an employee of Deltatel.You are generally required to provide your Personal Data mandatorily, except when we inform you that certain information is optional. If you do not provide us with the respective Personal Data, required to be provided mandatorily, the recruitment process may be delayed or even hindered.In order to process your Personal Data, Deltatel relies on various legal basis, as follows:The processing is based on your consent (according to Art. 6 (1) (a) of GDPR) as a legal basis for the collection, processing and use of your Personal Data, as permitted by the applicable law;The processing is necessary in order to make the necessary steps to conclude the employment agreement between you and Deltatel (according to Art. 6 (1) (b) of GDPR), in the event that a recruitment proposal is submitted to you following the recruitment procedure;The processing is necessary in order to fulfill a legal obligation incumbent on Deltatel (according to Art. 6 (1) (c) of GDPR), such as the obligation to inform the person selected in view of employment;The processing is necessary in order to fulfill the legitimate interest of the Deltatel to process the respective Personal Data (according to Art. 6 (1) (f) of GDPR).Transfers of data, recipients and legal basis of those transfersRecipients Affiliate companies: We transfer your Personal Data to Deltatel affiliate companies, to the extent permitted by the applicable data privacy legislation, in accordance with Art. 6 (1) (f) GDPR for the pursuit of the legitimate interests of Deltatel, in order to facilitate the internal communication and administration of the tasks of other affiliated entities, the planning and management of human resources and in order to be able to carry out the employment relationship within the Company.Third parties: Deltatel and any affiliated entity may transfer data to governmental and regulatory agencies, courts and other authorities, all in accordance with the applicable law, pursuant to Art. 6 (1) (c) of GDPR, as well as to external consultants acting as data controllers (e.g., lawyers, accountants, auditors, etc.) based on Art. 6 (1) (f) GDPR.Service providers (affiliated and non-affiliated): Deltatel enters into agreements with affiliated or non-affiliated third party service providers as part of its normal business operations, in order to carry out certain human resources management tasks.Cross-border Transfers of DataWe transfer your Personal Data outside the country where you are located. No recipient of your Personal Data is located in countries for which there is no decision issued by the European Commission according to which that country ensures an adequate level of data protection.Some recipients outside the European Economic Area ("EEA") are certified according to the EU-US Privacy Shield. In each case, the transfer is recognized as providing an adequate level of data protection from the perspective of the European law on data protection (Art. 45 GDPR).By concluding data transfer agreements on the basis of the Standard Contractual Clauses (2010/87/EU and/or 2004/915/EC) referred to in Art. 46 (5) GDPR or using other appropriate means (you may obtain additional information using the contact details indicated herein in relation thereto), we ensure that all recipients of Personal Data outside the EEA will provide an adequate level of data protection and that there are adequate security measures in place in order to protect Personal Data against accidental or unlawful destruction, accidental loss or alteration, unauthorized disclosure or access and against all other illegal forms of processing. All subsequent transfers will be made in compliance with the requirements of the applicable law.Retention periodsPersonal data processed for the purpose mentioned herein will be kept:as long as necessary, for the process of recruitment of personnel; as well assubsequently, in case of rejection of the application, for a possible future recruitment, for another available position, based on your consent, the retention period mentioned below being applicable, or, as the case may be, until you express your option to have your Personal Data deleted from Deltatel database.We will retain Personal Data for the period required or permitted by the applicable law. Subsequently, we will remove/delete your Personal Data from our systems and records and/or will take steps in order to anonymize it so that you can no longer be identified based thereon.In principle, Personal Data will be deleted at the end of 3 (three) years from the end of your last recruitment process, unless you become an employee of Deltatel, in which case the retention period established according to the Information Notice on processing of personal data of employees will apply. If a legal measure is initiated, Personal Data may be kept until the end of this action, including during any potential appeal periods, and then it will be deleted or archived, in accordance with the provisions of the applicable law.Your rightsBased on the applicable GDPR provisions, you have the following rights:Right of access: You have the right to obtain confirmation from us that the Personal Data concerning you is processed or not, and if so, you have the right to request access to the Personal Data. The information you may receive under the right of access includes the purposes of the processing, the categories of Personal Data concerned and the recipients or categories of recipients to whom the Personal Data has been or will be disclosed.You have the right to obtain a copy of the Personal Data processed. For additional copies requested by you, we may charge a reasonable fee based on administrative costs.Rigth to rectification: You have the right to obtain from us the rectification of incorrect Personal Data concerning you. Depending on the purpose of the processing, you have the right to complete the Personal Data that is incomplete, including by means of an additional declaration.Right to erasure (right to be forgotten): You have the right to ask us to delete the Personal Data concerning you. The Company has the obligation to delete Personal Data if one of the following reasons applies:Personal data is no longer necessary to fulfill the purposes for which it was collected or processed;You, in your capacity as data subject, withdraw your consent to the Processing and there is no other legal basis for the Processing;You, in your capacity as data subject, oppose the Processing (on the grounds that it is illegal, but you do not agree with the deletion of Personal Data, instead requesting the restriction of its Processing) and there are no legitimate reasons to prevail and to justify the further Processing of your Personal Data by the Company;Personal Data has been processed illegally;Personal Data must be deleted in order to comply with a legal obligation incumbent on the Company under European Union law or domestic law.Right to restriction of Processing: You have the right to request a restriction on the processing of your Personal Data. In this case, the data will be marked and may be processed by us only for certain purposes, in accordance with the applicable law.Right to data portability: You have the right to receive the Personal Data concerning you and which you have provided to us, in a structured, common and machine-readable format and you have the right to transmit this Personal Data to another entity without objections from us.Right to object:You have the right to object, for reasons related to your particular situation, at any time, to the processing of your Personal Data by us, and you can ask us not to process your Personal Data anymore. If you exercise your right to object, your Personal Data will no longer be processed for that purpose. Exercising this right does not involve any cost.
