SUBJECT: Designation of the Senior Agency Official for Records Management (SAORM) and Delegation of the Responsibilities of the SAORM

DELEGATION

Under the authority vested in me by section 412 of the Department of Education Organization Act, 20 U.S.C. § 3472, and pursuant to the Office of Management and Budget (OMB) and National Archives and Records Administration (NARA) Memorandum M-12-18, I hereby designate you, your successor in function, or anyone serving for you in an acting capacity or delegated the authority to perform the functions and duties of your position, as the SAORM with the delegated authority to perform the following responsibilities:

A. Implementing, advocating for, overseeing, coordinating, and facilitating the Department’s records management program;

B. Ensuring that the Department complies with all applicable records management requirements in law, regulation, and policy including, but not limited to, the Federal Records Act of 1950, as amended; the Records Disposal Act of 1943, as amended; OMB-NARA Memorandum M-12-18, Managing Government Records Directive; OMB Circular No. A-130; and, 36 CFR Chapter XII, Subchapter B, Records Management.

C. Instituting a records management program that, as appropriate, documents Department activities and decisions;

D. Setting the vision and strategic direction for the Department’s records management program including incorporating these goals into the Department’s Strategic Information Resources Management Plan;

E. Ensuring the Department’s management of electronic records in accordance with applicable law, regulation, and policy including, but not limited to:

a. Managing all permanent electronic records electronically to the fullest extent possible for eventual transfer and accessioning by NARA in an electronic format, as applicable; and,

b. Managing all email records electronically and retaining them in an appropriate electronic system that supports records management and litigation requirements, including the capability to identify, retrieve, and retain the records for as long as they are needed;

F. Ensuring the Department’s ability to access, retrieve, and manage records throughout their life cycle regardless of form or medium;

G. Developing records schedules for all Department records including, but not limited to, establishing and obtaining the approval of the Archivist of the United States for such records schedules in a timely fashion;

H. Ensuring the proper preservation and timely disposition of Department records in accordance with records schedules approved by the Archivist of the United States;

I. Ensuring that the Department protects records against unauthorized removal or loss;

J. Submitting reports to NARA supporting records management inspections and other oversight activities;

K. Formally designating the Department Records Officer and informing NARA, in writing, of this decision; and,

L. Ensuring that Department personnel, including employees, contractors, volunteers and others that create, receive, access, or use Federal records on behalf of the Department, are informed of and receive training and guidance on, as appropriate, their records management responsibilities, as defined in NARA regulations and guidance.

Unless otherwise specified in future delegations of authority, amendments to the authorities delegated herein are included within the scope of this delegation.

RESERVATIONS

None.

REDELEGATIONS

You may re-delegate, consistent with applicable law, the other authorities delegated to you herein and authorize further re-delegations, but you will retain the original delegated authority for and are accountable for any and all duties that you re-delegate pursuant to this delegation. Any re-delegation of authority must be in accordance with the ACS Departmental Directive entitled “Delegations of Authority,” OM: 1-102 or any updated directive.

CERTIFICATION AND EFFECTIVE DATE

This delegation is effective upon certification by the Department’s Principal Delegations Control Officer, and it supersedes all previous delegations and re-delegations of these authorities.

I ratify actions within the scope of this delegation taken by you prior to the date of certification.
