U.S. Drivers Set Record for Gas Spending in 2011

The amount households spent on gasoline this year is the highest in 30 years.

LOS ANGELES -- American drivers so far this year have spent more than $448 billion on gasoline, according to the Oil Price Information Service, breaking the previous record for gas expenditures set in 2008 with almost a month to go before the year's done. According to a report by the LA Times, the jump in gas spending is a huge increase over last year, when U.S. drivers spent more than $100 billion less on gas. The increase is attributable to higher gas prices because demand was lower than usual this year.

The report noted that the Organization of the Petroleum Exporting Countries (OPEC) is on pace to top $1 trillion in net oil exports for the first time, or 29 percent more than last year.

Looking ahead when OPEC convenes to discuss production levels, analysts held out little hope that the group would raise output to lower prices. Crude oil for January delivery gained $1.07 to close at $99.41 a barrel on the New York Mercantile Exchange. Nymex oil prices are up 8.8 percent so far for the year.

At the pump, gas prices hit a record for this time of year. On 12-9 2011, the national average price of a gallon of regular gasoline was $3.293, breaking the 2007 record by 28.5 cents. Compared with last year, it was 31.8 cents higher.

The demand for vehicle fuel has been about 4 percent lower this year than in 2010, according to the Energy Department.

The U.S. national average has never been over $3.03/gal on Christmas Day. The consumer must keep conserving.

QuikTrip Faces Federal Antitrust Complaint Over Alleged Price War

ST. LOUIS, Mo. -- A group of independent gas station owners has filed a federal antitrust complaint against QuikTrip. The Association of Independent Gas Station Owners and three of its members allege that the Tulsa, Okla.-based chain has violated the Sherman Act, the Robinson-Patman Act, and the Motor Fuel Marketing Act, according to the Courthouse News Service.

"On or about July 1, 2011 and continuing to this day, defendant QuikTrip began and has engaged in a price war with plaintiffs and other gas station owners in the St. Louis metropolitan area, with QuikTrip posting reduced pricing changes for its gasoline on almost a daily basis, and at times changing its posted gasoline prices several times in the course of a day," the complaint stated.

The group, represented by Eric Vickers, labeled QuikTrip's fuel pricing as "predatory" and believes that "based on information and belief, QuikTrip has been pricing its gasoline for customers at a price lower than QuikTrip's costs."

As a result of these pricing practices, the independent gas stations were forced to lower their own fuel prices in order to remain competitive, they said. The complaint also states that QuikTrip has a history of such abnormally low prices and that the company admitted to Missouri's attorney general in 2004 that it had been selling fuel at below cost.

"The predatory price war engaged in by QuikTrip has caused injury to competition in the retail sale of gasoline in the St. Louis marketplace, which will ultimately cause harm to consumers in the form of higher gasoline prices dictated by QuikTrip," the complaint continued.

The group is asking for QuikTrip to be barred from selling fuel below cost and seeking damages of more than $50 million.

QuikTrip spokesman Mike Thornburgh said yesterday that the company is unaware of the complaint, according to the report. The chain currently operates more than 580 convenience stores across 10 states.

U.S. Oil Exports, Production Inches Up

The country is experiencing a mini oil boom, even though most Americans are paying more for gasoline and home heating oil.

NEW YORK – This year, United States has produced more crude oil than in previous years. The country is now a net exporter of gasoline, heating oil and jet fuel, among other petroleum products, for the first time in years. In short, America is experiencing a mini boom in oil production, USA Today reports.

From January to September, the United States exported more oil-based fuels than it imported, which will mean 2011 will be the first year in 62 years that the country is a net exporter of such products. Another long-term trend has been turned around with America producing 10 percent more crude oil than 2006.

“It's dramatic. It's transformative,” said Edward Morse, a former energy official who now heads global commodities research at Citigroup. “We're moving toward energy independence.”

The biggest change the reversal has is on U.S. foreign policy where 12 percent of U.S. petroleum imports came from Saudi Arabia in 2010. “What's occurring is a rebalancing of the world oil supply,” said Daniel Yergin, author of The Quest: Energy, Security, and the Remaking of the Modern World.

The drive behind the boomlet is the upped production of heavy crude and shale oil, which had not been economically feasible to extract. “It's the new, new thing,” said Yergin of shale oil. He said U.S. production of tight oil could leap to 2.9 million barrels a day within 10 years.

Bahamas oil wells may imperil Florida

WASHINGTON — Just as South Florida braces for oil drilling set to begin next month off the shores of Cuba, a Bahamian company is pressing to dig exploratory wells as early as next year less than 200 miles from the state's delicate coastline.

The Bahamian plans could eventually bring rigs as close as 40 miles from Port Everglades. The prospect of energy exploration off both Cuba and the Bahamas has broadened concerns that widespread drilling will lead to a major oil spill that pollutes the East Coast, fouling beaches, damaging reefs and endangering wildlife. "If an oil slick gets into the Gulf Stream, it would be carried north, not only along the coast of Florida but farther north into the Middle Atlantic states," warned former Florida Sen. Bob Graham, co-chairman of a commission that investigated the BP oil spill in the Gulf of Mexico in 2010. "The main concern for the United States would be, in the event of an accident, what capability would the Bahamas have to contain the consequences?" Seismic testing has convinced the Bahamas Petroleum Co. that more than a billion barrels worth of oil may be found below waters south of Andros Island, the likely site of a first exploratory well.

"Geologically, it's very exciting," said Paul Gucwa, chief operating officer of Bahamas Petroleum, which has contacted larger companies in search of a partner to conduct the drilling. "We will begin our exploration as soon as the Bahamian government puts the necessary regulations in place," Paul Gucwa chief operating officer of Bahamas Petroleum said. "They are moving forward to put those regulations in place. We are moving forward to be ready to drill next year."

When asked about the environmental impact, Gucwa said, "This is very close to Cuba. It would not be any different to the environment than the wells that are being drilled in Cuban waters." But the Bahamian government mindful of the Gulf disaster and a recent spill off the coast of Brazil has blocked offshore production while reviewing its energy regulations and mulling the environmental impact. "They have put on the brakes but not turned off the engine," said Jorge Piñón, a former oil executive and energy expert at Florida International University, who has consulted with leaders in Cuba, the Bahamas and the U.S. government. "After Deepwater Horizon, they want to make sure their regulations are updated before they lift the ban. I think the [parliamentary] elections in the Bahamas in May will set the direction on this." The Bahamas, much like Florida, is conflicted: It wants to protect its ecosystem and tourism but is tempted by the riches of oil production. The parliamentary-election results could sway decisions on when or whether to lift the ban. Removing it would clear the way for contractors with experience in offshore drilling to explore for oil, much as Cuba has contracted with Repsol, a Spanish company, to begin drilling in waters north of Havana. A giant, floating Chinese-made rig named Scarabeo 9 is slowly chugging across the ocean from Singapore toward Cuba to begin drilling next month about 22 miles north of Havana and 70 miles south of the Florida Keys. The U.S. Coast Guard is making contingency plans in case a spill produces an oil slick that rides the Gulf Stream toward Florida. Drilling off Cuba and Mexico plus the prospect of wells near the Bahamas and potentially elsewhere in the Caribbean prompted Graham, Piñón and environmentalists to call for regional cooperation on safety measures and to pool resources to contain a possible spill.

Jamaica which also is considering oil exploration.

Drilling plans in the region have also prompted some in Congress to press for more offshore production in U.S. waters, including the Atlantic coast and the eastern Gulf along Florida's west coast. "You know, someone's going to do the drilling," said U.S. Rep. Allen West, R-Plantation. "If we are not going to take advantage of the resources we have available to us, my concern is that all of a sudden they [Cuba and other countries] start to slant drill. And if there is a catastrophic event, they aren't going to care what happens to our beaches or shores." "Repsol and Cuba and China and everyone else is going to continue to close the noose around our necks as far as energy independence is concerned," West said. "Wouldn't it be a shame if down the road we're going to China or Cuba or someone else for energy resources that we allowed to be taken right from under our noses?"

$4 Gas Forecast???

East Coast refinery closures will affect fuel supply, EIA, analysts say

NEW YORK -- Gasoline prices may rise above $4 a gallon next summer as refineries along the U.S. East Coast close, reducing fuel supply, Edward Morse, head of commodities research at Citigroup Global Markets Inc., New York, told Bloomberg.

Sunoco Inc. and ConocoPhillips have idled two plants and plan to shut a third that together can process more than 700,000 barrels a day of oil, or about 46% of the region's refining capacity. That will increase the dependence on imports to meet fuel demand in the region that includes the delivery point for New York Mercantile Exchange (NYMEX) futures contracts, the basis for national prices at the pump. Cargoes arriving from abroad accounted for 19% of demand in the East Coast in September, Energy Department data show. Shipments from the Gulf Coast and Midwest met another 51% of consumption, with local refineries supplying the rest. "We have a real supply problem ahead this summer because these refineries have not made money and they are shutting down," Morse told the news agency. "Summer gasoline is harder to make than winter gasoline, and we could see $4 as a floor price rather than a ceiling limiting demand."

Sunoco announced December 1 the immediate idling of its 194,000- barrel-a-day Marcus Hook, Pa., and refinery. ConocoPhillips stopped processing crude oil at the 190,000- barrel-a-day Trainer plant September 30.

"The area could be left vulnerable to price spikes if there are ever any unplanned outages or supply disruptions," Tom Bentz, director with BNP Paribas Prime Brokerage Inc., New York, told Bloomberg.

The shuttered refineries, which processed mostly imported crude from Europe and West Africa, faced higher prices than their counterparts in the U.S. Midwest and Gulf Coast able to use less-expensive domestic oil.

The East Coast imported 596,000 barrels a day of gasoline in September out of 3.1 million barrels supplied daily, Energy Department data show. That's poised to rise as suppliers seek to replace local production.

Prices may also rise in New York versus the Gulf Coast in order to attract more shipments from the Gulf, where about half of U.S. refining capacity is located.

Colonial Pipeline Co., the largest pipeline linking the U.S. Gulf Coast with Northeast markets, delivers 2.35 million barrels a day of oil products from Houston to Greensboro, N.C. The main lines from North Carolina deliver about 1.4 million barrels a day to Linden, N.J. "I would assume the Colonial line space just got a lot more valuable," Andy Milton, vice president of supply at Gainesville, Ga.-based Mansfield Oil Co., which supplies more than 2 billion gallons of fuel per year, told Bloomberg. Colonial announced December 21 that it plans to increase capacity on its main gasoline pipeline by 100,000 barrels a day by the first quarter of 2013.

"We foresee some significant tightness" ahead for Nymex gasoline, analysts at Barclays including Miswin Mahesh in London said in a December 6 report cited by the news agency.

The oil companies are heading for record profits again at the expense of the consumer. The consumer should conserve even more to send a message to OPEC and the oil companies. Conservation is the best tool. The U.S. consumer spent (more than $448 billion) a record amount on gasoline in 2011 and OPEC is on pace to top $1 trillion in net oil exports for the first time, or 29 percent more than last year. Conserve, conserve, conserve.

Arco Accepts Credit Cards Again

In major about-face, Arco will start accepting credit cards again at stations after 30 years of abstinence.

Arco is taking credit cards again. The move comes almost 30 years after the refiner “blew up” its credit card in TV commercials and slashed prices, ushering in a new era of competition at the pump.

Arco has launched its new marketing ploy in Seattle, where it has started offering consumers two-tier pricing, cash or credit. The switch is being promoted in signage at stations and in local Internet ads depicting happy consumers dancing at the islands. A pump banner proclaims, “No more 45 cents fee [on debit cards], hello credit cards.” A voiceover notes that Arco now accepts credit cards, concluding with the promise, “Arco, straight up gas.”

BP purchased Arco in 2000 for approximately $28.6 billion but continued its “low-price, no credit cards” policy. A spokesman for the British oil major says the credit card offer in Seattle is a market test at Arco am/pm stores. “It is a pilot credit card program being offered to dealers on a voluntary basis in the greater Seattle area. The majority of dealers in the pilot geography have signed on for the pilot program,” the spokesman said.

There are reports that Arco may shortly expand the new card strategy further south to Los Angeles, and San Diego, but BP officials declined further comment. Los Angeles is Arco’s biggest market.

A return to credit cards by Arco could have a major impact on pump prices in western states where the company and Costco often vie for the title of lowest-priced fuel retailer in the market, experts say.

“There's no telling what the landscape would be like as to price and volume rankings if Arco is going to accept credit cards market-wide, but  such a decision will be the second massive game-changing move in three decades, by the same brand,” says petroleum marketing analyst Trilby Lundberg.

“Everyone, from Chevron to Costco, and of course consumers, would be affected if Arco dumps its ultra low-price strategy.  Brand loyalty would be transformed in one way or another. Arco's price personality may or may not be revolutionized, but it would be affected not only by its taking credit cards but by the reactions of its competitors,” Lundberg added. Arco stopped taking credit cards in April 1982.

Hundreds Report Post-Thanksgiving Debit Card Fraud

Local law enforcement says that skimming devices have led to an increase in card data theft, with similar schemes costing banks hundreds of millions of dollars.

LaFAYETTE, GA – Hundreds of residents of Walker, Catoosa and Chattooga counties in Georgia have had their debit bank cards compromised over the past month, the Times Free Press reports.

“Now I’m wondering if it’s safe to use it,” said Pam Lamberth, who had $544 stolen from her bank account.

Police began receiving calls about the data breaches around Thanksgiving. Since then, the number of victims has grown to nearly 600 in Walker County alone, though it has been a week since any new illegal transactions have been reported.

Chattanooga Secret Service agent Donna Job said skimming devices have led to an increase in card data theft, with similar schemes costing banks hundreds of millions of dollars.

"More and more we're turning to the cyber arena to fight these types of scams," said FBI Special Agent Stephen Emmett of the Atlanta office, adding that the case in North Georgia is unusual for a small community.

The illegal transactions in the case were made as far away as Egypt, which is typical for these types of fraud cases, federal agents said.

Police have yet to determine how the card data was stolen, with theories pointing to an elaborate skimming operation.

"We're not pointing fingers at any one merchant," said Walker County Sheriff Steve Wilson. "There are a lot of theories flying around right now."

Kurt Helwig, president and CEO of the Electronic Funds Transfer Association, said skimming crime rings are becoming more sophisticated and are often based in Eastern Europe.

In the meantime, customers from 17 banks or financial companies have been affected in this case, with the Bank of Lafayette reporting more than 200 compromised customer accounts.

Details Emerge On Getty Petroleum Marketing Bankruptcy

Vows to continue normal operations; claims Getty Realty failed to perform remediaition

EAST MEADOW, N.Y. -- Getty Realty Corp. (GRC) has announced that Getty Petroleum Marketing Inc. (GPM), the company’s largest tenant, has filed for Chapter 11 bankruptcy protection in U.S. Bankruptcy Court, Southern District of New York. 

Getty Realty Corp. had previously disclosed that it had served GPM with a formal notice of termination of the Master Lease as a result of GPM’s nonpayment of November 2011 rent.  The company notified GPM that it was terminating the Master Lease and exercising its right to take possession of the premises underlying the Master Lease effective Dec. 12, 2011. 

The company will continue to protect its interests and pursue appropriate actions against GPM, seek possession of the unitary premises underlying the Master Lease and pursue all other rights and remedies available to it. Getty Realty Corp. cannot provide any assurance regarding the ultimate resolution of GPM’s bankruptcy.

“We welcome the fact that the process will now have structure and the supervision of the Bankruptcy Court to protect the value of our estate,” said David Driscoll, president and CEO of Getty Realty Corp. “We plan to continue our efforts to repossess our properties. Over time we intend to reposition the portfolio of properties subject to the Master Lease in order to maximize the value of the portfolio. We are fortunate to have completed two acquisitions in 2011 that significantly reduced our dependence on GPM. These new portfolios as well as other assets owned outside of the Master Lease continue to perform and meet our expectations. Notwithstanding the filing by GPM today, we remain optimistic about the future of our company.”

As a result of the foregoing developments, it is likely that the company will be required to increase the deferred rent receivable reserve, record additional impairment charges, accrue for environmental liabilities. It is also likely that the company will incur significant costs associated with proceedings against GPM and a repositioning of the Master Lease portfolio. Getty Realty Corp. has not determined the amounts of any such costs or potential adjustments to its financial statements. These developments could materially adversely affect the company’s business, financial condition, revenues, operating expenses, results of operations, liquidity, and ability to pay dividends or stock price.

Uncertainty Awaits Getty Petroleum Sub-Lessees

EAST MEADOW, N.Y-- Hundreds of convenience store owners are uncertain about their future after news broke that Getty Petroleum Marketing Inc. (GPMI) filed for Chapter 11 bankruptcies.

GPMI leases approximately 800 stores from real estate investment trust Getty Realty Corp (GRC). The company then sub-leases many of those stores to another company, such as Lukoil, who in turn sub-leases the properties once again it involves sub-leases of sub-leases and beyond to distributors and independent convenience store owners. "Lukoil was the original purchaser of the GPMI properties and leased them directly to dealers in some cases, Lukoil also leased those properties to distributors, who leased properties to independent convenience store owners(commissioned agents). The distributor in Connecticut is Green Valley Oil [LLC] who leased the properties to independent convenience store owners (commissioned agents).

Can you imagine being a part of that kind of a contract?

Franchise dealers, meaning they have some rights under the Petroleum Marketing Practices Act (PMPA), which sets several requirements between gasoline refiners and distributors and their retailers. One possible benefit of being a PMPA franchise dealer is the possibility for independent c-store lessees to receive the right-of-first-refusal to purchase the properties they operate, as a commissioned agent, you basically have no Petroleum Marketing Practices Act (PMPA) rights.

Natural Gas Vehicles Enjoy New Respect

With more natural gas fueling stations opening around the country, cars powered by natural gas are gaining more converts.

KANSAS CITY, Mo. – Move over, electric car, and make way for the natural gas powered vehicle, the new darling of green automobiles. Natural gas vehicles are inching up in popularity, the Kansas City Star reports.

With supplies of natural gas rising, vehicles powered by the fuel are enjoying a resurgence of interest. One of the biggest challenges to widespread use of such cars is the lack of fueling stations, but companies and states are boosting the number of natural gas stations.

Four states have asked automobile makers to increase the number of natural gas vehicles produced, while a Georgia public utility company recently announced plans to build a network of natural gas stations in the state. Even Congress is looking into providing financial assistance in the building of such a network.

Fueling the push for more vehicles and fueling stations is the huge amount of natural gas being extracted from U.S. shale formations? Currently, natural gas is the main heating source for homes and businesses in the Midwest, but with supplies skyrocketing, more people are considering other uses for the fuel.

Many states have natural gas powered fleets but there’s not as many vehicles running on natural gas available to the public. Supporters of natural gas vehicles say the low cost of fuel is a strong selling point, but that it probably won’t catch on until there’s more places to fill up.

BP’s ampm Adds Chase ATMs

Some 800 ATMs scheduled for ampm locations in five states.

Chase ATMs are set to be installed at 800 ARCO-branded ampm locations in California as well as Washington, Arizona, Oregon and Nevada as part of Chase’s nation-wide ATM network expansion.

“Chase’s ATMs are an exciting addition to our convenience store offering, and will help us grow our customer base,” said ampm President Bill Fry. “We expect this to help generate additional fuel purchases and in-store sales, further strengthening the ampm brand.”

About 75% of the ATMs will be installed in California ampm locations, bringing the total number of Chase ATMs in California to nearly 4,000. The new Chase ATMs began arriving in participating ampm stores in late November, and most will be installed by the end of March 2012.

“We are making banking even more convenient for millions of Chase customers, especially in California,” said Jim Sutton, head of ATM distribution and deployment at Chase. “Many of our customers already take advantage of ampm’s extensive network, and soon they will be able to use Chase ATMs there with no fee. Select locations will also allow Chase customers to make deposits at the ATM.”

Is Electric Car Interest Fizzling?

The ROI on the administration’s $5 billion incentives for the electric car industry may suggest that the plan was too aggressive.

WASHINGTON, D.C. – The administration has given the electric car industry around $5 billion in incentives to encourage production and purchase of the green vehicles, but analysts are questioning whether that move will pan out, the Washington Post reports.

Analysts are predicting that some of the electric car companies receiving federal funds could go dark early next year, especially in light of falling sales and production. For example, A123 Systems, which makes batteries and had gotten $380 million from the government, said it would be downsizing because of low orders. Also, General Motors, which makes the Volt, revealed it would miss its goal of selling 10,000 of the cars in 2011 by 38 percent.

“Many in this industry have jumped the gun on how aggressive the growth of electric vehicles will be,” said Kevin C. See, a Lux Research analyst.

Beginning on Jan. 1, 2012, the standard mileage rates for the use of a car (also vans, pickups, panel trucks) will be:

55.5 cents per mile for business miles driven

23 cents per mile driven for medical or moving purposes

14 cents per mile driven in service of charitable organizations

Pumps at Some Texas Gas Stations Running on Empty

AMARILLO, Texas -- Some gas stations in the Texas Panhandle are experiencing their very own gas shortage.

Last week, KFDA reported that the pumps had Claude's Taylor Food Mart has run dry. Now, further calls by the station have revealed that almost every food mart in the Panhandle were out of gas. Some of those stations have been dry for more than a month.

Employees at several of the Taylor Food Mart locations in the area told the news outlet that the stations have not received any gas and they are quickly running out of supplies. All added they have not been told what the problem is.

Rumors are swirling, with some pointing to a company buyout while others claimed that Taylor Food Mart is going bankrupt. However, the bankruptcy office in Amarillo told the news station that the company has not filed as of yet.

Taylor Food Mart did tell the news outlet that the company is up for sale but confidentially agreements with the buyer prevent further comment.

According to the company website, Taylor Petroleum Cos. Inc. has 74 stores across four states. The first store opened in 1972.

FinCEN Announces Launch of FinCEN Updates E-mail Subscription News Service

The Financial Crimes Enforcement Network (FinCEN) today announced the launch of FinCEN Updates – a new, free

e-mail subscription management service designed to keep the financial industry, the media and the public informed of news, rulemakings, advisories and other developments at FinCEN. This new secure e-mail subscription management service permits users to customize their updates, which enables them to receive e-mails related to the topics to which they have subscribed.

FinCEN Updates allows users to choose their subscription preferences. Subscription items include advisories, guidance, news releases, rulings, enforcement actions, and current career opportunities at FinCEN. Users can add or delete subscription items themselves, and have the option to password protects their accounts for increased security. Users can opt to have FinCEN Updates sent immediately, daily, weekly, or monthly to their e-mail accounts or directly to a wireless device.

FinCEN selected the GovDelivery® E-Mail Subscription Management service to monitor designated website content and to send an e-mail to alert subscribers when there is new information posted on FinCEN’s public websites. Subscribers will receive e-mails from the
