03.127 QUESTIONS FROM THE PUBLIC:

Residents of Ludbrook expressed dismay at the prospect of SHDC being recommended to drop enforcement action at the April Planning Control Meeting regarding the unauthorised development at Ludbrook Gate. They asked for Parish Council support in continuing to press for enforcement action to be taken to reinstate the damage caused by the engineering work (excavation of part of the field and addition of hardcore) and change of use. Resolved: Clerk to write to Alan Robinson (Chief Planning Officer SHDC) to strongly support enforcement action be taken in this highly visible location. (See 03.132/8).

03.128 POLICE REPORT

1. Police report from Jan/Feb- noted.

2. Response from WPC T. Hoskin to various matters: Vandalism in Bittaford: Reported to Police HQ

Redworth Totnes. WPC Hoskin has note this problem and will look into when she joins the South Brent

team. Visual obstruction of junction of Ugborough Road and Exeter Road in Bittaford: Police have visited

‘Cornerway’ on several occasions, to date blue van and owners have not been available. Police stated this

was not a significant problem and greater care should be taken in negotiating the junction. UPC noted that

the large blue van has been replaced by a smaller Land Rover which does not cause a visual obstruction.

Cllr. Holman reported vandalism, cutting down saplings and theft of 3 flag sticks and golf balls at

Wrangaton Golf Club. Resolved: Clerk to write to South Brent Police to pass on information.

Annual Parish Meeting 25th April: Clerk has sent a formal invitation to Ins. Ellis from Totnes.

03.129 ELECTION 1ST MAY 2003

1. Notice of Election posted on Notice Boards on 6.03.03. New Councillors information booklet now

available. – Noted.

2. Nomination Papers were given to all Councillors willing to stand for another term. It was noted these should

ideally be delivered to the Election Office at South Hams District Council by hand. All nomination papers

to be handed in before NOON 1ST APRIL 2003. It was noted that there had been some interest in local

residents thinking of standing as Councillor, but this may still not be enough to warrant an election.

3. Poll Cards: Ugborough Parish Council voted not to issue Poll Cards.

03.131 MATTERS ARISING

1. Response from Ivybridge Local Service Group to various matters: Safe pedestrian access to Jubilee Terrace,

rotten hoardings near Skew Bridge Bittaford – no response to date. Car parking problems Ware Hill

Ugborough – no response to date. Reinstatement of grass verge opposite Jubilee Terrace, Bittaford: Nick

Boulton responded stating that Highway Inspector has informed the Developer that the verge must be

reinstated. DCC Highways cannot condone parking on the verge as the pavement was not constructed to

take that level of use, there is no officially agreed crossing point across the pavement and the verge area is in

private ownership. 20mph speed limit in Bittaford and traffic speed hump in Bittaford: It was noted this is

due to be implemented, however there is no response to date to details of whether this is being paid for by the

106 agreement with Developer of Moorland Close or if there is any money left over. 20mph limit in

Ugborough village: no response to date – noted. Resolved: Clerk to chase up response to these issues.

2. Response from Graham Wall re update on work to create safe pedestrian access to Jubilee Terrace: DNP and

DCC Highways are having discussions about this. Developer to be requested to move street lights and

create a safe walkway, but this cannot be enforced. It would help if new residence of Bittaford and Jubilee

Tce would write to Ivybridge Local Service Group to request improvements to pavement.

Resolved: Cllr. W. Mitchell to ascertain residents’ opinion when he delivers newsletters. Clerk to write to

Housing Association and Ivybridge Local Service Group.

4. Response from Gary Streeter MP to UPC comments on use of brown field sites: Mr. Streeter is to raise this

issue with SHDC and will report back. It was noted Mr. Streeter was willing to attend a UPC meeting to

discuss this issue. It was also noted that the Bewley Garage site was within DNP not South Hams. Clerk

confirmed that the reason for writing to Gary Streeter was to highlight the principle behind land use rather

than to complain about specific sites.

5. Estimate for repainting metal bus shelter Bittaford: Not available to date.

6. Data Protection: copy of Register entry report. Registered from 18.12.02 to 17.12.03 – noted.

7. Response from K. Humphries (Trainee Parks Manager SHDC) re Children’s Play Area Bittaford stating that

it is a new requirement to issue insurance inspector reports on condition of playground equipment twice

yearly. It was noted that SHDC stated that the equipment was ‘owned’ by UPC. There followed discussion

on the ownership of the playground. Resolved: Clerk to locate the deeds which would have been drawn up

when UPC purchased the land many years ago. To report back next month. It was noted that the

playground was insured by SHDC and that the Playground had never appeared on our asset register.

8. Devon to 2016 – pre examination in public changes to Deposit Draft (Jan 2003): representations from Cllrs.

Holman, Beable and Johns. – copy to be kept on file and noted. Chairman thanked the Councillors for

their time and trouble in commenting on this document. UPC’s response sent on 05.03.03 – noted.

03.132 PLANNING

1. Report on Inter Deposit Negotiation Meeting of 17.02.03: Cllr. E. Mitchell expressed concern that as this matter was confidential, Clerk should not have sent a report to all Councillors and the matter should not be raised at the Council meeting. Clerk confirmed that, following discussion with Lee Bray (Chief Forward Planning Officer) SHDC had an open policy which is why the ‘stakeholders’ were invited to attend the meeting with Developers on 17.2.03. Mr. Bray confirmed that this matter should be discussed with the Council and Minuted. Clerk’s report and supporting documents had been read by all Councillors and were noted. Cllr. Beable confirmed that future development in the Filham area had been discussed at the Public Appeal of the Rutt Lane proposal by Cavanna Homes. Following this Appeal, Ivybridge Town Council had a meeting with Redrow Homes to discuss their future proposals. SHDC had met with Redrow Homes who were then told any future discussions should be held with ‘stakeholders’ present so that local views would be heard by the developers at an early stage. Firm proposals could not be made at this stage as there was no provision in the Local Plan. Therefore further action cannot be taken until SHDC have made a decision regarding this site (and others throughout the South Hams) in respect of the Local Plan. Resolved: UPC to be kept informed and be part of all future discussions.

2. Following no comments received from members of public since the February Council meeting the following recommendation to Planning Authority was ratified: Erection of pole barn for animal shelter and fodder store. HIGHER YEO FARM, IVYBRIDGE. Mrs. P. Cook. SUPPORT.

Ugborough Parish Council gave the following recommendations to Planning Authorities:

3. Conversion of stone barn to dwelling with new access. LADYWELL FARM, UGBOROUGH. Mr. E. T.

Mitchell. (Cllr. E. Mitchell declared an interest and left the room during discussion & voting). SUPPORT

4. Installation of six 1.3 square metre solar collectors. 2 THE OLD CHAPEL, LUTTERBURN STREET,

UGBOROUGH. Mr. & Mrs. J. Pursey. SUPPORT

5. Erection of first floor rear extension above existing kitchen and attached conservatory. BEEHIVE COTTAGE, 15 LUTTERBURN ST. UGBOROUGH. Mr. & Mrs. J. Reilly. OBJECION because: Overdevelopment of site to the detriment of close neighbours. Three letters of objection and supporting photographs received.

The following amendment was received following publication of the Agenda. Recommendation to be ratified at April meeting. Any comments received from members of public in the interim period will be taken into consideration:

6. One bungalow and garage WOOD PARK, BITTAFORD. Mr. & Mrs. E. J. Hill NO OBJECTIONS.

7. Proposed extension SUNRISE, BITTAFORD – for information only – Noted.

Local Planning Concerns:

8. Unauthorised levelling and erection of 2 ‘portable’ stable blocks LUDBROOK GATE. Letter from

Mr. Trentham of 28.02.03 – Noted. Reply from A. Robinson stating that in view of the fact that Planning

Officers had mistakenly written to the developers confirming the work they had carried out was within

permitted development, it would be seen by an Appeal that SHDC had acted ‘unreasonably’ if re-

instatement of the ground was later enforced. Therefore, following legal advice from SHDC Solicitors, the

Council was to be advised to drop enforcement at the Planning Control Meeting in April. Resolved: In

view of: strong local opposition, the area concerned was within 25m of the road, the unauthorised

development was detrimental to near neighbours, the area in general and is in a prominent position, UPC

to write to Alan Robinson to support the residents of Ludbrook in that enforcement action be taken.

Concern was raised that should the unauthorised development be allowed to continue, it would set a

precedent locally.

9. Breech of Planning condition 15 LUTTERBURN STREET, UGBOROUGH. Response from Miss

K. A. Owen (Planning Officer SHDC) confirmed that enforcement action is being taken in respect of

application reference 57/0080/87/3 regarding conversion of the outbuilding known as ‘Honey Pot’ to a studio ancillary to the dwelling and not as a separate dwelling as is being used at present – noted. Letter from Mr. & Mrs. Reilly regarding proposed alterations read and noted as was reply from the Clerk.

10. Land at junction of Yellowberries Lane Nr. Sign of the Owl: Clerk reported that Keith Palmer (Planning

Enforcement Officer) was no longer working for SHDC, however other Planning Officers were taking the

case over. Resolved: Clerk to write to SHDC to support enforcement against unauthorised development.

It was noted that an enforcement notice can be applied to the person occupying the land, not necessarily the

legal landowner.

11.Change of Planning Application Notices for 57/0048/03/F Cutwell Barn & 57/0108/03/F Field and Cutwell.

03.133 NEW CORRESPONDENCE

1. South Devon Magistrates’ Courts: Modification of the permitted hours. – Noted.

2. Defra Licensing Bill: Report from Tessa Jowell (Sec of State for culture, Media and Sport) re: amendment to Entertainment licensing bill which stated that all community facilities such as village/church halls religious groups etc were excluded from the Licensing Bill – Noted.

3. SHDC Council Tax Resolutions 2003/04. Agenda for 28.2.03 – Noted.

4. SHDC Young Sportsperson of the Year Award – Thursday 20.3.03 Kingsbridge Community College. It was noted that Cllr. Len Wakeham had been invited to attend in view of his achieving a gold medal for Great Britain in the sport of competitive shooting. Bridie Waycott and Jamie Douglas had been nominated from Ugborough Parish. Details to Cllr. D. Wakeham who would also like to attend on behalf of UPC.

5. DCC Devon County Waste Local Plan: First Deposit version: Comments on policies & proposals by 25.4.03. Resolved: Following discussion on the gross waste of money and paper in sending out such large documents to all Councils, Cllr. D. Johns agreed to respond on behalf of UPC.

6. DNP Publication scheme under freedom of information act 2000 – Noted.

7. SHDC Comprehensive Performance Assessment – Survey of Partners – Completed by Clerk 4.3.03. Noted.

8. SHDC: South Hams 2003 and Beyond, Draft Performance Plan for June 2003. For response by end of March. Noted.

9. Village Green Magazine: Page 11 feature on Rural Housing following opening of Jubilee Tce. Noted.

10. Letter from Rev. Nicola Hunt (PCC) request permission for erection of Notice Board on church lawn: Resolved: UPC in agreement in principle, however would prefer to see a notice board just on the left side of the path, not in front of the main lawn. This lawn is frequently used for community events such as the Fair, wedding photos are also taken on the lawn and cars (especially for weddings and funerals) are parked alongside. A notice board in this position could cause obstruction for these reasons. Clerk to reply and state planning legislation regarding permitted development in a conservation area.

03.134 P.3 WORK

1. Work to FP’s 13 & 14: Replacement of stiles steps etc at Dunwell Farm. Replacement of stile at Well Cross FP 7. Noted. Resolved: Clerk to check stability of slate steps at FP13. 3 stile kits are on order, if work to FP 7 can be completed before end of March, payment to contractor can be made.

2. Letter of introduction from Gordon Flower contractor for P.3 work – noted.

03.135 CHAIRMANS MATTERS ARISING

1. UPC Annual Report 2002/03. Clerk showed Council the completed report and confirmed this has been sent for printing with the April newsletter. UPC to be invoiced by Ugborough School for this.

2. Annual Parish Meeting: Friday 25th April, 7.30pm, Ugborough Village Hall. Topic: Parish Plans, Village Design Statements. Speaker: Ms Lesley Smith (Sec. DAPC). Invitation to Ins. Ellis Totnes Police. Invitation to all groups and societies in Parish. Clerk requested all Councillors try to encourage people to attend, especially from Bittaford, Moorhaven or Wrangaton. Transport could be arranged for those without.

03.136 MEMBERS REPORTS (Councillors to give reports on meetings attended on behalf of UPC and/or on any points of interest in each specialist topic.)

1. Ivybridge Community Strategy: Library, Arts & Resources Centre – Open Evening 19.3.03 – Noted.

2. Ivybridge Community Strategy Group meeting: Cllr. W. Mitchell reported that only half the number of

people attended this meeting than the previous one. A Deputy Town Clerk for Ivybridge has been appointed

(some hours are being paid for by SHDC for Community Strategy work). Very little action has been taken

on items on the ‘Forward Planner’ and the Impact Transport Group had folded up. Other towns, such as

Truro are to be visited to see how they have progressed with their Community Strategies.

3. Village Hall Meeting 11.03.03: Cllr. L. Wakeham confirmed he was pleased to work with such a well

organised group and he is continuing to work on handrails etc to comply with Disabled Access Regulations.

He took measurements of filing cabinet requested for UPC use to report back to Village Hall Committee

who had stated that storage space was very limited.

4. Police Liaison Meeting 10.03.03: Cllr. J. Trend reported a general increase in all crimes locally, including

thefts from Ivybridge shops. Police are actively looking into this. 56.5p per person extra on the rates will

result in good value. Two more police officers in Ivybirdge and one extra for rural area.

5. I&DAPC Cornwood: Cllr. J. Trend reported on discussion regarding Housing Authorities ring fencing

financing and 2nd home Council Tax. Average price in South Hams £195,000. More affordable housing

needed. Jim Barrett SHDC reported on Community Strategy and the Market & Coastal Town Initiative and

urban extensions on to existing communities. Cllr. J. Trend was able to report to the I&DAPC group the

work of Ivybridge Ring & Ride and Community Car Sharing Scheme. Noss Mayo, Cornwood, Shaugh

Prior & Wembury present.

6. Cllr. D. Wakeham reported that Ugborough School Governors were currently working to cope with very

severe under funding in the coming financial year, this is causing grave concern.

7. Councillors W. Mitchell and J. Trend completed outstanding travel expenses for attending these meetings.

8. DNP Community Forum Meeting 11.04.03 at 2.15pm– Notice to Cllr. J. Widdicombe. – Noted.

03.137 WORK CARRIED OUT BY CLERK - Noted

1. Report on meeting of Development Control & Conservation User Group Meeting 19.2.03: Loss of Planning Enforcement Officer, Telecommunication Development, Consultation by Railtrack, suggested improvements to Planning Dept. SHDC.

2. Report on meeting with SHDC 26.2.03: progress of Community Strategy & Market towns initiative. Role of South Hams CVS. Presentation on Comprehensive Performance Assessment. Details of procedure for election on 01.05.03.

3. Update on Training schemes for Clerks. It was noted clerk attended SLCC meeting in Exeter on 7.3.03.

4. Completion of Clerks’ Terms & Conditions Questionnaire

5. Report 5 faulty street lights in Undertown, Ugborough.

6. Report problems with street sweeping in Bittaford Village to Keith Mulhall (SHDC)

7. Advertise SHDC sale of Water butts, composters and wormeries.

8. Advertise SHDC Easter, May Day and Spring Bank Holiday 2003 refuse collection arrangements.

9. Advertise warning from Safer South Hams Partnership Office (SHDC) re false prize winning claims.

10. Advertise Police Liaison meeting Town Hall Ivybridge 10.3.03 7.30pm.

11. Problem with burial ground re: earth on grave following re-opening of neighbouring grave for 2nd burial.
