Report: Eagle Ford and Bakken are fastest-growing producers

WASHINGTON — Drilling hotbeds in South Texas and North Dakota are responsible for most of the U.S. oil production growth over the past month, according to a report issued Tuesday.

The Energy Information Administration’s analysis effectively labels the Bakken formation in North Dakota and Montana and the Eagle Ford in South Texas as the top-growing oil producers, among six regions where energy companies are using hydraulic fracturing and horizontal drilling to tap dense rock formations. The two formations accounted for 75 percent of the monthly oil production growth across those regions, with the Bakken and Eagle Ford responsible for an increase of nearly 700,000 barrels per day.

Visa Improves Payment Card Fraud Detection

WASHINGTON, D.C. -- Visa Inc. is attempting to fight potential electronic payments fraud with gas stations and their customers in mind.

Visa today announced enhancements to its authorization model, including indicators specific to automated fuel dispensers (AFD) transactions. The model can now pinpoint suspicious activity at a gas station and apply that to all transactions processed through that station.

The enhanced model also uses account velocity at AFDs compared to the account's normal behavior in the score determination. This can potentially increase the effectiveness of fraud detection in this segment by as much as 163 percent for credit transactions and 266 percent for debit transactions, Visa stated.

Across the board, enhancements to Visa's Advanced Authorization (VAA) technology will enable financial institutions to use the information to more reliably know which transactions to decline in real time, while allowing them to more confidently approve legitimate transactions to remove friction from payments for merchants and consumers alike, the credit card company added.

The VAA improvements are also poised to substantially reduce fraud where the physical Visa card is present, or in virtual environments such as online shopping.

"Cardholders, merchants and issuers all want to have confidence in the convenience and the security of every Visa transaction," said Mark Nelsen, Visa Inc.'s head of risk and authentication products. "The great improvements we've made in advanced authorization this year were designed to do just that: fight fraud and its costs to financial institutions and merchants, while also ensuring legitimate transactions are handled with the speed and convenience that consumers and merchants want."

Judge Halts Enforcement of NY Surcharge Regulation

The state law penalized retailers if they added a fee for credit card payments.

​NEW YORK –AU.S. District Court judge stopped enforcement of a New York State law that assessed criminal penalties to retailers who tacked on a fee for customers paying with credit cards instead of cash, Reuters reports.

U.S. District Judge Jed Rakoff decided for several retailers who had filed lawsuits against the regulation on the grounds that their free speech rights were trampled by not allowing them to tell customers about the fees associated with credit card payments. Rakoff founded his ruling on the First Amendment. The law “perpetuates consumer confusion by preventing sellers from using the most effective means at their disposal to educate consumers about the true costs of credit-card usage.”

Retailers violating the state law could face a 12-month sentence in prison plus a $500 fine for adding a surcharge to credit card purchases. The judge blocked the enforcement with a preliminary injunction while the case is pending.

New York State Attorney General Eric Schneiderman and Manhattan District Attorney Cyrus Vance said the law’s intention was to protect shoppers from unexpected additions to their checkout tallies. Neither office commented on the ruling as of press time.

A new report issued this week found that lower debit card swipe fees spurs lower prices. Reducing the cost for merchants to swipe debit cards put $5.8 billion back into the hands of consumers through lower prices, according to the Merchants Payments Coalition

Circle K Purchases PIX Stores

Publix Super Markets Inc. has announced its decision to sell PIX, the fuel/c-store concept it began testing in 2001.

Circle K Stores Inc., a wholly owned subsidiary of Alimentation Couche-Tard Inc., will purchase 13 sites of which 11 are located in Florida and two in Georgia, and Max Arnold & Sons LLC, a family-owned company located in Hopkinsville, Ky. that has been in operation for more than 60 years, will purchase the site located in Tennessee.

“We consistently evaluate our business, including the products and services we choose to offer our customers,” said Publix CEO Ed Crenshaw. “The sale of PIX locations gives us the ability to remain passionately focused on our core business, our customers and the products and services we offer within our grocery retail environment.”

The company will help the approximately 120 PIX associates find employment within Publix comparable to their current positions.

Dollar General Pumps Up Competition With First Fuel Station

GOODLETTSVILLE, Tenn. -- Dollar General Corp. is ramping up its competition with convenience stores. The locally based retailer added a gas station as part of its test pilot project.

The new fuel pumps are located at the Dollar General Market in Hanceville, Ala.

"Dollar General continues to innovate to provide convenience and value for our customers," said Rick Dreiling, chairman and CEO. "This project to test a fuel offering is consistent with our strategy of continually looking for new and better ways to meet our customers' needs for value and convenience and enhancing our position as America's general store."

The pilot project is part of an agreement with Gainesville, Ga.-based Mansfield Oil Co., which provides comprehensive fuel supply, distribution, delivery and dispensing solutions to customers. Dollar General and Mansfield will evaluate the results of the pilot project over the next year and jointly assess expansion opportunities.

"Mansfield and Dollar General share core values that have led to decades of growth and innovation," said Michael Mansfield, CEO of Mansfield Energy Corp. "This pilot program will fuse Dollar General and Mansfield's dedication to unparalleled service, while bringing a new level of convenience to customers."

Dollar General Corp. has more than 11,000 stores in 40 states.

Interest Groups Call For Ethanol Mandate Cuts

The various organizations want permanent — and deep — reductions to the Renewable Fuel Standard.

​WASHINGTON, D.C. – Diverse groups are asking Congress to significantly reduce the U.S. corn ethanol mandate, E&E reports. The coalition also wants such cuts to be made permanent. The Renewable Fuel Standard states that refiners have to blend 13.8 billion gallons of conventional ethanol into gasoline in 2013, a number that goes up to 14.4 billion gallons in 2014, which would constitute just over 10% of the U.S. gasoline supply.

Anti-poverty, environmental, livestock, small-equipment manufacturers and fiscal organizations have banded together to ask members of the House Energy and Commerce Committee to consider their requests as the committee works on reforming the RFS. The coalition’s concern was that the RFS hurts consumers, small engines and food producers.

“The mandate on corn-based ethanol in particular has had a devastating effect on the entire food economy from livestock and poultry producers facing record feed costs, to food retailers facing record food costs, to consumers here and abroad struggling to balance food budgets in tough economic times,” said the 44 groups in a letter to the committee.

The House committee is working on reform legislation after having a series of hearings.

EPA may cut ethanol mandate

Bloomberg is reporting that finally the EPA may be considering cuts to the ethanol mandate of the RFS for 2014. According to the report, the U.S. Environmental Protection Agency is considering scaling back requirements on the use of ethanol in 2014 because of complaints from refiners that mandates would exceed their ability to blend it into fuels without putting engines at risk.

A proposal from EPA would cut the requirement to 15.21 billion gallons for renewable fuels in 2014 instead of the 18.15 billion gallons established by a 2007 law, according to Bloomberg. EPA would call for the use of 13 billion gallons of conventional corn-based ethanol and 2.21 billion gallons of advanced biofuels such as biodiesel, down from 13.8 billion gallons and 2.75 billion gallons respectively this year.

The proposal is “addressing both availability of qualifying renewable fuels and constraints on their consumption,” the agency said in the draft, which is dated Aug. 26, just days before a plan was officially submitted to the White House for review. The EPA document was provided to Bloomberg by an industry representative.

OPEC curbing supply to two-year low sees sluggish fuel demand

The Organization of Petroleum Exporting Countries predicted “sluggish” fuel demand and increasing supplies this winter as the group’s output dropped to the lowest in almost two years amid losses in Iraq.

Consumption in Asia will be constrained by the removal of subsidies in countries such as Indonesia and Malaysia, while demand in Europe will continue to ebb despite an economic recovery, OPEC said in its monthly market report. Its 12 members pumped 30.05 million barrels a day last month (September), the least since October 2011. OPEC kept estimates for global oil demand in 2014, and the amount of crude it will need to provide, in line with last month’s forecast.

“Despite the more positive outlook for the U.S. and Europe, global product markets are expected to come under pressure over the winter season,” the group’s Vienna-based secretariat said. “The combination of sluggish demand and increasing product supplies are likely to damp margins, leading to lower refinery runs over this period.”

Brent futures have slipped about 1 percent this year, trading near $109 a barrel in London. Slower growth in emerging economies as well as easing of tensions between Iran and the west over the OPEC member’s nuclear program also helped lower oil prices. Oil refiners will cut processing of crude by about 2 million barrels a day in the fourth quarter, from 77.2 million in the third, because of reduced profit margins and seasonal maintenance work, the group said.

OPEC’s production fell by about 390,000 barrels a day to 30.047 million in September as output from Iraq slumped by 370,300 barrels a day to 2.8 million amid maintenance at the Basrah terminal, data from secondary sources cited in the report show. Supplies from Libya, Saudi Arabia and Venezuela also declined, according to the data. The organization is responsible for 40 percent of global oil supplies.

The group forecast that world demand will increase by 1 million barrels a day, or 1.2 percent, to 90.8 million a day in 2014, unchanged from its prediction in last month’s report.

Supply from outside the organization will increase by 1.2 million barrels a day to 55.27 million next year, reducing the amount that OPEC will need to supply. The call on OPEC will average 29.6 million barrels a day in 2014, or about 400,000 a day less than it pumped in September.

OPEC’s members are Algeria, Angola, Ecuador, Iran, Iraq, Kuwait, Libya, Nigeria, Qatar, Saudi Arabia, the United Arab Emirates and Venezuela.

Sale of Hess' Retail Division Still on Track

NEW YORK -- Hess Corp. completed six of its 10 stated goals this year in an effort to become a pure-play exploration and production (E&P) company. One the four goals not completed is the selling of the company's 1,714 gas stations and convenience stores.

However, the divestiture of the retail division "is well underway," said CEO John Hess during the company's 2013 fiscal third-quarter earnings call this morning. The executive made similar comments on July 31, when Hess announced its fiscal second-quarter earnings.

The CEO would not elaborate on which convenience store retailer would buy the assets. But as Convenience Store News previously reported, Marathon Petroleum Corp. -- parent of Speedway LLC -- has been mentioned as a possible suitor.

"Hess has very good looking assets," Marathon Petroleum CEO Gary Heminger stated on April 30.

A spinoff of the retail division, similar to the process recently taken by Valero Energy Corp. and Murphy Oil Corp., is also a possibility, the company noted during the call. Valero spinoff CST Brands Inc. and Murphy spinoff Murphy USA Inc. both began trading as separate entities earlier this year.

As for earnings, Hess' discontinued operations division, under which retail, energy marketing and energy trading is housed, earned a net profit of $54 million in the third quarter, which ended Sept. 30. That is slightly higher than the $53 million the company earned in its 2012 third quarter.

Companywide, Hess achieved a net profit of $420 million in its latest quarter, compared to a $557 million profit in the year-ago period. Civil unrest in Libya was cited as the top reason for lower earnings.

"We are pleased in the progress we have made in our conversion to an E&P company," Hess concluded.

Oregon Tests Mileage Tax

As states scramble for new revenue, many wait for the results of Oregon’s pilot mileage tracking program.

Oregon is set to tax motorists based on the number of miles they drive as opposed to the amount of fuel they consume, raising concerns about cost and privacy, Fox New reported.

Following a recently signed bill, the pilot program is expected to roll out in 2015 with a preliminary group of 5,000 volunteers, as other states watch the model closely to see the outcome. If the plan is adopted following the pilot program, it would replace the 30-cents-a-gallon state tax in Oregon with one for 1.5 cents a mile, for those participating.

Oregon isn’t alone in looking for new revenue. As Americans drive less and vehicles have become more fuel efficient, the current gas tax isn’t as lucrative for states as it used to be.

The federal Highway Trust Fund, which gives money to states for highway construction and repairs, has needed a congressional bailout four times since 2009, in part the result of no federal gas tax increase in the past 20 years.

The issue over how to fund necessary infrastructure repairs, such as to roads and bridges, has led many to call for an increase in the federal fuel tax.

But CNN Money reported that a higher gasoline tax would be extremely unpopular in a country where almost 90% people drive to work. The last hike of 18.4 cents a gallon took place on Oct. 1, 1993. Currently, the tax raises about $30 billion a year for the nation, according to the Institute on Taxation and Economic Policy. In April, a Gallup poll found two-thirds of Americans opposed a hike in state gas taxes of up to 20 cents, even if it went to pay for infrastructure.

Oregon’s mile tax could be a viable solution. But economists and civil libertarians are concerned about the Oregon tax because of the fear that mileage meters could track and record residents’ whereabouts, thereby infringing on privacy. Geddes, a Cornell University professor, told Fox News the device is simply attached to a vehicle’s computer and cannot track locations. But he acknowledged that privacy concerns could resurface if the government expanded the program and used SmartPhones or apps to track movements. Cost is yet another concern, including who pays for the devices.

Oregon is reported to be considering several tracking methods for the pilot project’s 5,000 volunteers before the 2015 start date appears. It is expected that mileage meters will be connected to the vehicles’ odometers or GPS systems that could better track non-taxable miles on private and out-of-state roads.

A 2012 Government Accountability Office report, however noted that the costs of a GPS system for 230 million U.S. passenger vehicles would likely be greater than the cost of collecting fuel taxes.

Gilbarco Veeder-Root Launches Play at the Pump

​GREENSBORO, N.C. – Gilbarco Veeder-Root announced the launch of Play at the Pump in partnership with Linq3, an application that allows consumers to purchase lottery tickets via the dispenser. 

According to Gilbarco, this new service gives retailers access to would-be lottery players, increases lottery sales opportunities among consumers who may not enter the store and encourages repeat business.

“With this product we are bringing innovative technologies to the forecourt, to drive loyalty and repeat business among consumers and offer retailers a way to differentiate from competition,” said Bryan Crossan, director of marketing, Gilbarco Veeder-Root.

"In just a year’s time from 2011 to 2012, lottery sales in North America grew by roughly 10%,” said Daniel Cage, CEO of Linq3. "The technology Gilbarco Veeder-Root is introducing with Linq3 will be instrumental in increasing overall sales by offering a lottery product that caters to the casual player who uses self-serve at the pump. It's a new and convenient way to play that complements traditional sales." To date, Minnesota and Missouri are piloting Play at the Pump.

Florida now imposes $30 fine for texting while driving

On October 1, texting and driving became prohibited in Florida. To show you how serious Florida lawmakers are about texting and driving, if you're caught, you pay a whopping $30.

The new Florida law says police must first catch you in another traffic offense; texting is only a 'secondary' infraction, nothing you can be pulled over for on its own.

The Palm Beach Post reports that while you can’t type and drive, it’s still legal to thumb away at that message while stopped at a light or in a traffic jam. And even then, should the officer ask to see the phone in question, you’re not obligated to hand it over.

In Florida from 2010 through 2011, at least 85 crashes caused by distracted drivers turned fatal, according to the National Highway Traffic Safety Administration. The state has more than 120,000 miles of roads used by more than 15 million licensed drivers.

Florida Highway Patrol officials have taken steps to get the word out about the new law, Capt. Nancy Rasmussen said earlier this week.

A public service announcement has been distributed to Florida high schools. Students should hear the 15-second spot Tuesday during school announcements. Also, FHP’s 10 public affairs staffers have been ordered to fan out across high schools Tuesday, Oct. 15, to make presentations about texting-while-driving.

Rasmussen acknowledges that some critics question whether secondary enforcement sends a mixed message. “We think it’s going to be a deterrent,” Rasmussen said. “People will know they’re not supposed to try to text while they’re behind the wheel. It’ll be another tool in our toolbox for traffic safety.” Think about it, what else could she say if she wants to keep her job?

Florida is now among 41 states with a texting-while-driving ban, but one of only four states that watered it down so that it's virtually meaningless --as just a secondary offense, according to the Governor’s Highway Association.

7-Eleven to Get New Logo, Look

The convenience store chain is refreshing its brand in an effort to reach younger customers.

​DALLAS – From redesigning its stores to revamping its logo, 7-Eleven is poised to make wholesale changes to its look, Fast Company reports. The convenience store chain is embarking on the first brand redo in four decades.

The changes will be rolled out in stages to 7-Eleven retail locations. WD Partners were tapped to “reposition and rejuvenate stores in order to better capture the millennial and female demographics.”

The new storefront logo will hold onto the red and orange “7,” but curves a lowercase “eleven” onto its back on a black backdrop. Smaller signs and brand identifiers will have an “eleven” penned across a “7” with a bright, green background sans white.

Store interiors will have a more upscale grocer feel with layout and signage pointing more to healthier options and fresh-made foods. Granite flooring, green furniture, white tiles and stations simply labeled with onomatopoeic signs, such as “Sip. Sip. Sip.” positioned over the coffee urns.

GM to offer vehicle that runs on choice of gasoline or natgas

The choice may soon be yours: gasoline or natural gas. General Motors is planning on becoming the first car manufacturer to sell a dual-fuel-powered vehicle that can run on either conventional gasoline or compressed natural gas (CNG). Sources say GM CEO Dan Akerson will unveil GM's plans at the Securing America's Future Energy Conference in Washington.

According to sources, GM has been looking at such a vehicle for "some time". Indications are that GM isn't planning on this being their hottest seller, but over time, volumes will build.

GM is not yet putting a price tag on the dual-fuel vehicle, which is projected to go on sale next summer. The automaker is estimating it will have a range of roughly 150 miles using CNG and another 350 miles using gasoline. The driver will be able to switch between the two fuel tanks even in the middle of driving.

GM CEO Akerson has long supported developing natural gas powered vehicles, and a few weeks ago GM said it plans to sell dual-fuel compressed natural gas versions of the 2015 Chevrolet Silverado and GMC Sierra pickups. While the automaker hasn't yet released a price for those trucks, previous versions of CNG-powered pickups have gone for over $10,000 more than their gasoline powered counterparts.

The high costs, along with the lack of public natural gas refueling stations, are reasons automakers have been slow to expand their lineups to include CNG vehicles. There are just over 600 publicly available CNG stations in the U.S. versus more than 120,000 gas stations.

However, natural gas powered vehicles may resonate with Americans on their benefits: far fewer emissions vs. gasoline vehicles and plentiful supply of natural gas, thus reducing the price to fill up. A gallon of gasoline in major cities this summer hit over $4/gallon while the equivalent volume of natural gas sold for just $2.15.

e-mail subscription management service designed to keep the financial industry, the media and the public informed of news, rulemakings, advisories and other developments at FinCEN. This new secure e-mail subscription management service permits users to customize their updates, which enables them to receive e-mails related to the topics to which they have subscribed.
