LYONS CITY COUNCIL MEETING

April 4, 2017

A regular meeting of the Mayor and Council of the City of Lyons was called to order by Mayor Andrew Fuston at 5:30 P.M., April 4, 2017, at the Lyons City Hall. Present were Council members Brink, Steinmeyer, and Housh Sr. Wheaton arrived at 5:47 p.m. Also in attendance were City Attorney Smith, Chief Buck, City Clerk Ritter and Utility Superintendent Daberkow.

Visitors at the meeting were Brandy McElroy, Brian Depew, Jamie Horter of Lyons Mirror Sun, Jacob Stromer, Pat and Dave Nelson of Nelson Construction, Bill Hedges, Lori Wheaton, Dave and Bev Armstrong, Robert Byrnes, and Terry Ueding.

The Mayor publicly stated to all in attendance that a current copy of the Nebraska Open Meetings Act was available for review and indicated the location of such copy posted in the room where the meeting was being held. Advance notice of said regular meeting was given to the Mayor and all members of the Council, and a copy of their receipt of such notice and the agenda is filed in the City Clerk’s office. Availability of the agenda was communicated by posting notices in three public places and in the notice to the Mayor and Council. All proceedings hereafter shown were taken while the convened meeting was open to the attendance of the public.

The meeting was called to order upon motion by Steinmeyer, second by Housh Sr. All council members voted yes on roll call except Wheaton who was absent.

Moved by Brink, seconded by Steinmeyer to approve the following consent agenda:

1. Dispense with reading of minutes of meetings held on March 7, March 14, and March 27.

2. Claims as presented.

3. Treasurer report.

4. Clerk Report of Mayoral Action of March 7, 2017 meeting: Resolution No. 2017-2 Authorize Mayor Fuston to sign the CDBG application documents was approved and signed.

All council members voted YEA except Wheaton who was absent.

Brandy McElroy discussed wanting to have six to eight chickens in city limits, no roosters. They would be fenced in with no free roaming. She called around to other towns to see if chickens are allowed. West Point does allow yet needs to be at least 100 feet from other buildings, houses, churches, etc. Blair allows up to 14 chickens with signed agreement from neighbors. Tekamah doesn’t allow fowl. The Council has some concerns such as the smell and what to do if a chicken dies. The Mayor needs to think about the request first. No action taken.

Tina McRoberts was absent to discuss closing a street off for an auction.

Lori Wheaton thanked the Council for improvements to Brink Park. She discussed needed repairs to the grills though at the park. A suggestion was made to see if Brehmer Mfg can make some new grill pans that could be attached to the metal posts. Council member Wheaton arrived at 5:47 p.m.

Brian Depew presented some cost comparisons between repairing the bowling alley verses demolition. Jamie Horter applied for a grant of up to $500,000 for repairs to Main Street buildings including the bowling alley. There was concern about a possible common wall between Happy Days Senior Center and the bowling alley, yet there is no common wall between the two buildings.

Chief Buck presented the police report.

Mike Heavrin presented the Library Report and Grants Report. The Library Commission received the 2017 Bibliostat report. Mary Jane Bell will replace Kevin Hayes as Assistant Librarian until further notice. The Council agreed to go ahead with the Downtown Revitalization Grant. Engineering firm will need to update the blight study. Funds are being raised to purchase a new color copy machine. We have $3,193 in funds at this time.

One sealed bid on the demolition of the bowling alley was opened. Nelson Construction bid was $46,580. Motion by Wheaton, second by Housh Sr to accept the bid of $46,580 from Nelson Construction to demolition the bowling alley. All voted yes on roll call.

Inspections reports by Mike of R. O. Youker Inc suggested repairs on all three building on Main St (Shatto, Stillman, Fallout Bar buildings). The City will issue yellow placards again with the recommended repairs on the Shatto and Stillman buildings. For Fallout Bar’s building, the Council needs to think about it more regarding costs. It was suggested that Mr Housh Sr maybe get costs on the recommended repairs. A suggestion of putting up vinyl siding was made. This would let the bricks breath to wick moisture away. The City hasn’t heard back from Dennis at Brehmer Mfg on the electric project expenses. Council President Wheaton will talk with Dennis. April 22, 2017 is the town clean-up date. Utility employee is on hold for now. The liner project for the water tower is scheduled for this fall. Sealed bids for the surplus equipment were opened. Ditch Witch Trencher: bid of $1,020.00 from Mark Niewohner. Used Cardboard Baler: bid of $685.00 from Mark Niewohner. Target Concrete Saw: bid of $475.00 from Mark Niewohner. Motion by Brink, second by Wheaton to accept the total bid of $2,180.00 from Mark Niewohner on the surplus equipment of a trencher, baler, and concrete saw. All voted yes on roll call.

City Clerk Ritter reported on the General, Utility, and Debt Service Income Statements for the month ending March 31, 2017. The General side had a month to date net gain of $13,590 and a year to date net loss of $45,723. The Utility side had a month to date net gain of $39,994 and a year to date net gain of $122,155. Debt Service had a month to date net gain of $10,695 and a year to date net loss of $63,232. Budget reports for the General and Utility side were as follows: General had expended 35.12% of its fiscal year budget in the first six months. The Utility side had expended 40.66% of its fiscal year budget. Six month average is 50%. The pet clinic will be held on April 25, 2017, at Steiny’s General Store from 6:30 p.m. to 7:30 p.m. The July Council meeting is rescheduled for Thursday, July 6, 2017 due to the 4th of July holiday.

Council Member Steinmeyer motioned approve increasing the rate of pay for pool manager to $12.00, assistant pool manager to $10.50, and lifeguards to $9.25, seconded by Brink. All voted yes on roll call.

Council Member Wheaton motioned to approve the appointment of Roger Andersen to the Lyons Planning Commission to replace Gail Bovee who resigned, seconded by Steinmeyer. All voted yes on roll call.

Council Member Brink motioned to approve a special designated liquor license to Fallout Bar for Brittney Burgett’s wedding event on June 3, 2017, at the Lyons Community Center, seconded by Steinmeyer. All voted yes on roll call except Housh Sr who abstained.

Council Member Wheaton motioned to approve a special designated liquor license to Fallout Bar for the 4th of July Beer Garden at Brink Park on July 4th, seconded by Brink. All voted yes on roll call except Housh Sr who abstained.

Council Member Steinmeyer motioned to approve a special designated liquor license to Fallout Bar for the Annual Street Dance on July 15, 2017, seconded by Wheaton. All voted yes on roll call except Housh Sr who abstained.

Council Member Steinmeyer motioned to approve a special designated liquor license to Lyons Volunteer Fire Department for the Alumni Dance on May 27, 2017, at the Lyons Community Center, seconded by Wheaton. All voted yes on roll call.

Council Member Steinmeyer motioned to approve a special designated liquor license to Lyons Volunteer Fire Department for the Fireman’s Street Dance on July 3, 2017, seconded by Housh Sr. All voted yes on roll call.

Council Member Brink motioned to approve the building permit to Jacob & Darlene Stromer for a garage & storage at 840 Debbie Lane, Lyons, NE, seconded by Wheaton. All voted yes on roll call.

Council Member Steinmeyer motioned to approve the building permit to Kathryn Frey for an addition to the house at 530 State St, Lyons, NE, seconded by Housh Sr. All voted yes on roll call.

The meeting was adjourned at 7:07 P.M., upon motion by Steinmeyer, seconded by Wheaton. All council members voted yes on roll call.
