ORDINANCE 2007-492-E

AN ORDINANCE APPROVING AND ADOPTING THE WOODLAND ACRES LAND USE AND ZONING STUDY DATED MARCH 2007 (AMENDED JUNE 5, 2007); APPROVING THE RECOMMENDATIONS CONTAINED IN THE STUDY; ESTABLISHING THE WOODLAND ACRES LAND USE AND ZONING STUDY AREA GENERALLY DESCRIBED AS SOUTH OF THE ARLINGTON EXPRESSWAY, WEST OF SOUTHSIDE BOULEVARD, NORTH OF ATLANTIC BOULEVARD, AND EAST OF ARLINGTON ROAD, AND SHOWN ON THE STUDY MAPS (STUDY AREA); REQUIRING THAT ALL DEVELOPMENT AND REDEVELOPMENT WITHIN THE STUDY AREA IS CONSISTENT AND COMPATIBLE WITH THE STUDY AND ITS RECOMMENDATIONS; DELEGATING THE AUTHORITY TO INTERPRET THE STUDY AND TO REVIEW ALL PROPOSED DEVELOPMENT AND REDEVELOPMENT WITHIN THE STUDY AREA TO ENSURE CONSISTENCY AND COMPATIBILITY WITH THE STUDY AND ITS RECOMMENDATIONS TO THE PLANNING AND DEVELOPMENT DEPARTMENT; PROVIDING AN EFFECTIVE DATE.

WHEREAS, the Woodland Acres Study Area is poised to redevelop, and presents a great opportunity to take advantage of its desirable and accessible location; and

WHEREAS, the Woodland Acres Study Area is developed in a traditional grid pattern with well-positioned City services, giving it the potential for redevelopment in the form of a traditional, walkable neighborhood with an elementary school, civic uses and park within the neighborhood area and with commercial uses on the perimeter; and

WHEREAS, the Better Jacksonville Plan funded a septic tank phase-out program that projects connections to city sewer service within the Study Area in 2009, thereby supporting a redeveloped neighborhood with sound and desirable housing, as opposed to housing which must overcome the disadvantages of septic tank systems on small lots in developed areas; and

WHEREAS, given the potential for redevelopment of the Woodland Acres Study Area in the near future, standards and models for such redevelopment should be in place as soon as possible; and

WHEREAS, Policy 3.1.18 of the Future Land Use Element of the 2010 Comprehensive Plan requires that the City recognize and maintain neighborhoods through the development and implementation of district plans and/or neighborhood plans which identify the needs of the City's neighborhoods and the opportunities to improve and maintain those neighborhoods in light of continued growth and development pressures within and surrounding them; and

WHEREAS, given the potential for redevelopment of the Woodland Acres Study Area in the near future, District 2 Council Member Lynette Self requested that the Planning and Development Department undertake a study to provide standards and models for such redevelopment; and

WHEREAS, the Planning and Development Department completed the Woodland Acres Land Use and Zoning Study in March 2007, and transmitted it to the City Council for review and consideration; and

WHEREAS, the City Council and the Land Use and Zoning Committee held duly noticed public hearings regarding the adoption of the Woodland Acres Land Use and Zoning Study, and received and reviewed public comments regarding same; now therefore

BE IT ORDAINED by the Council of the City of Jacksonville:

Section 1. Approval and Adoption of the Woodland Acres Land Use and Zoning Study; Establishment of Woodland Acres Study Area. The Woodland Acres Land Use and Zoning Study dated March 2007, as amended June 5, 2007 by Exhibit 1, attached hereto is hereby approved and adopted as the planning guide for all development and redevelopment within the Woodland Acres Land Use and Zoning Study Area, generally described as south of the Arlington Expressway, west of Southside Boulevard, north of Atlantic Boulevard, and east of Arlington Road. A copy of the Woodland Acres Land Use and Zoning Study is on file in the City Council Legislative Services Division and the Planning and Development Department.

Section 2. Development and Redevelopment within the Study Area shall be Consistent and Compatible with the Woodland Acres Land Use and Zoning Study. All development and redevelopment within the Study Area, including, but not limited to, all Public Works projects and streetscapes, partnerships with the City that require funding, and all projects requiring permits, shall be consistent and compatible with the Woodland Acres Land Use and Zoning Study, and the recommendations contained therein.

Section 3. Delegation of Authority. The Council hereby delegates the authority to interpret the Woodland Acres Land Use and Zoning Study and its recommendations, and the authority to review all proposed development and redevelopment within the Study Area to the Planning and Development Department to ensure consistency and compatibility with the Woodland Acres Land Use and Zoning Study, and the recommendations contained therein.

Section 4. Effective Date. This ordinance shall become effective upon signature by the Mayor or upon becoming effective without the Mayor’s signature.
