Washington Square, Lansing MIMonday-Friday, 8:00 am – 5:00 pm14.General Summary of Function/Purpose of PositionThis position serves as a Foreign Labor Certification Analyst (FLCA) within the office of Foreign Labor Certification. The FLCA performs work as assigned and under the supervision of the Agricultural and Foreign Labor Services (AFLS) Program Manager. The FLCA reviews and approves foreign labor applications under the H-2A and H-2B visa programs. The FLCA is responsible for conducting prevailing wage and practice surveys in accordance with the Code of Federal Regulations. Will prepare H-2A and H-2B training modules and train One-Stop Service Centers and state staff. The FLCA will respond to H-2A and H-2B inquiries from employers and employer representatives. The FLCA will maintain constant communication with the CNPC to ensure all foreign labor requests meet federal and state requirements. Will process housing inspection requests with Michigan Department of Agricultural and Rural Development and, on occasion, conduct provisional pre-occupancy housing inspections. Maintain H-2A and H-2B data and prepare reports. The FLCA will share all State Workforce Agency and FLC duties and responsibilities with the state AFLS staff.15.Please describe the assigned duties, percent of time spent performing each duty, and what is done to complete each duty.List the duties from most important to least important. The total percentage of all duties performed must equal 100 percent.Duty 1General Summary of Duty 1% of Time65Under the direction of the AFLS Program Manager, will be responsible for reviewing and approving H-2A and H-2B worker requests. Will coordinate workload with the Foreign Labor Certification Officer (FLCO).Individual tasks related to the duty.Review all H-2A and H-2B foreign worker requests to ensure compliance.Identify deficiencies and communicate with AFLS staff, CNPC, and/or employer.Correct deficiencies.Daily correspondence with CNPC to address issues with H-2A/H-2B application, ETA form municate as needed with local One-Stop Service Centers to ensure Order Holding Office (OHO) responsibilities are followed.Prepare quarterly grant report and provide program performance data to complete LEARS report.Assist the State Monitor Advocate (SMA) with training for One-Stop Service Centers, state staff and employers.Work closely with Migrant and Seasonal Farmworkers (MSFW) staff members to ensure Applicant Holding Offfice and OHO responsibilities are followed.Duty 2General Summary of Duty 2% of Time15Review and finalize all prevailing wage and practice survey results prior to submitting to the SMA and CNPC.Individual tasks related to the duty.Identify employers in wage reporting areas involved in the harvest of specific fruits and vegetables.Contact employers in-person, by telephone, e-mail and mail, to gather information to establish prevailing wages and practices.Work closely with outreach staff to obtain most accurate wage/practice information municate with SMA unit staff any issues arising from data collected.Assist training outreach staff in proper methods of conducting surveys.Maintain records of all completed surveys.Research and analyze collected wage and practice data collected.Conduct surveys in conjunction with MSFW staff.Duty 3General Summary of Duty 3% of Time5Other duties as assigned.Individual tasks related to the duty.Participate in unit and division planning sessions.Gather and summarize materials and data for planning purposes.Participate in One-Stop Service Centers partnership meetings.Make public presentations to employers, labor organizations, and community groups regarding services available from the Foreign Labor programs.At manager’s discretion, may attend and participate in meetings relating to MSFW and/or employers, when necessary.Duty 4General Summary of Duty 4% of Time10Using ETA Form 790, conduct provisional pre-occupancy housing inspections for H-2A employers who file emergency applications, and when otherwise required to ensure timely processing of applications.Individual tasks related to the duty.Provisional housing inspections.Duty 5General Summary of Duty 5% of Time5Field checksIndividual tasks related to the duty.Conduct field checks at H-2A worksites where US workers are hired.Conduct field visits where problems arise.Prepare field check reports.Identify any apparent violations and attempt informal resolution.Receive H-2A complaints and process accordingly.Conduct field checks with MSFW staffDuty 6General Summary of Duty 6% of TimeIndividual tasks related to the duty.16.Describe the types of decisions made independently in this position and tell who or what is affected by those decisions.Decisions regarding daily activities of the position, decisions regarding training venues and delivery of training and reference material approved by AFLS Program Manager.
