NCDHDAlcohol & Tobacco Compliance ReportCreated September 2018 CONTENTSThe data outlined in this report include the results from the Nebraska State Patrol alcohol and tobacco compliance checks, in addition to the alcohol and tobacco Reward & Reminder results conducted by NCDHD and the Area Substance Abuse Prevention coalition. The main different between the two data outputs lies in the results of a passing or failing score. With the Nebraska State Patrol compliance checks, a failing score results in a citation and typically a fine for the clerk and the retailer. After a certain amount of citations, an establishment could lose its license. In the Reward & Reminder program, failing scores are given reminders of the Nebraska tobacco/ alcohol laws and encouraged to comply with State statues. If an establishment passes the Reward & Reminder program the establishment is given a certificate of completion and the clerk is rewarded for checking identification with a small incentive. Area Substance Abuse Prevention Coalition funds the State Patrol alcohol and tobacco compliance checks through the Region 4 Block Grant and the Drug-Free Communities Grant. The Drug-Free Communities Grant also funds the Reward & Reminder program. To implement the Reward & Reminder program, the coalition must receive authorization from each County Attorney. The Tobacco Reward & Reminder program was implemented in 2016, 2017, and 2018. 2018 is the first year the Alcohol Reward & Reminder program was implemented. ALCOHOL & TOBACCO ENFORCEMENTThe Nebraska State Patrol has served as the primary enforcement agency for the Nebraska Liquor Control Commission since July 1986. In addition to liquor law enforcement, the State Patrol investigates the background of liquor license applicants, complaints of alleged violations and conducts licensed premise inspections.Questions and concerns regarding Alcohol/Tobacco enforcement issues should be directed to the Alcohol/Tobacco Enforcement Division of the State Patrol at (402) 471-8494. By using rapid and public rewards and recognition for clerks and retailers/outlets that do not sell tobacco/alcohol to minors, Reward & Reminder aims to reduce illegal sales of tobacco/alcohol, perceived access to tobacco/alcohol, and tobacco/alcohol use prevalence rates. The intervention emerged from a contextual analysis of factors affecting the behavior of store clerks, retailers, and the tobacco industry overall. At the core of the program is the use of "mystery shoppers," teams of youth who--with parental permission and under the supervision of adults--enter stores and try to buy tobacco products. They provide immediate recognition and rewards, such as gift certificates, to clerks who do the "right thing" and give reminders to those who do not.Reward & Reminder is officially included on the U.S. National Registry of Evidence-based programs and practices. REWARD & REMINDER works because it is science-based.?It is the result of considerable study of human behavior. The studies show that public recognition and reward of good behavior by stores and clerks for doing the right thing and not selling tobacco and/or alcohol to minors reduces illegal sales of tobacco and/or alcohol to minors faster than enforcement, which is then saved for people who are really intent on breaking the law.??REWARD & REMINDER works because it is inclusive.?Everyone is involved. The program is not aimed at youth; it includes them and the community, too. These checks resulted in an overall 12.2% non-compliance. In 2018, NSP was contracted to conduct alcohol compliance checks in all nine counties, resulting in an 8.1% non-compliance rate. Alcohol compliance in the NCDHD service area has increased, hopefully as a result of the increase in compliance checks, as previous to 2017 NCDHD did not contract with NSP for alcohol enforcement measures. Tobacco:2016 was the first year NCDHD, through ASAP funding, was able contracted with NSP for tobacco compliance checks in all nine counties. Before 2016, tobacco checks were conducted in half of the counties, alternating every other year. In 2016, the NCDHD area had a noncompliance rate of 11.1%, then 12.5% in 2017. This number plummeted in 2018 with a 0.6% noncompliance rate. We attribute this drastic increase in retailer tobacco compliance to the persistent prevention efforts to keep compliance checks an annual occurrence in the NCDHD service area. ................
