DECLARATION OF CANDIDACY INFORMATION
If you are interested in becoming a candidate for Commissioner or Municipal Judge for the City of Clovis – Election Day is March 4, 2014. As a potential candidate, there are things you need to know concerning the election process, your rights and responsibilities, and the rights and responsibilities of the City Clerk.
When do I file for office?
January 7, 2014 between the hours of 8:00 am and 5:00 pm. This is the only time the City Clerk can accept a declaration of candidacy for a candidate for their name to appear on the ballot.
All candidates must file the following documents:
1. A Declaration of Candidacy form; AND
2. A Certified copy of the candidate’s current affidavit of voter registration that is on file with the Curry County Clerk. The registration must be certified on a date not earlier than the date of the adoption of the election resolution which is scheduled to be on the December 5, 2013 commission agenda.
The voter registration must include the candidate’s actual physical address and the name on the voter registration will be the same name that will appear on the ballot.
3. Municipal Judge candidates must also certify they are available to attend a week long training in Albuquerque the week of March 17, 2014.
The Declaration of Candidacy form is provided with this information packet and must be used for filing. Only this form will be accepted. Please read through the form and understand the requirements of the information you need to provide. Your signature is required to be notarized. A notary will be available in the City Clerk’s office.
The Affidavit of voter registration must show a street address, not a post office box. Certifications of voter registration must be obtained from the Curry County Clerk’s Office, 700 Main, Clovis, NM.
If you are unable to personally appear on January 7, 2014 an Affidavit Authorizing Filing of Declaration of Candidacy is also available. This provides an authorized representative for you during the election process who acts for the official candidate in any part of the election process that requires or permits a candidate to appear. This form is required to be notarized. You, as the candidate, must sign your Declaration of Candidacy. The representative may not.
When the Declaration of Candidacy is filed in the office of the City Clerk, it becomes a public record.
Is there a fee to file for City Commissioner or Municipal Judge?
There is no fee to file for City Commissioner or Municipal Judge.
How does the City Clerk certify my candidacy?
From the information provided on the Declaration of Candidacy form, the City Clerk determines if the individual is a qualified elector and if the individual resides in the City limits, is a registered voter, and the certificate of registration has been processed after the introduction of the election resolution.
By January 9, 2014 at 9:00 am the City Clerk shall post a list of certified candidates including those who have not been certified and the reason for the non-certification. Each candidate or authorized representative shall contact the City Clerk’s office to learn whether the declaration has been certified as valid.
How is each candidate’s position determined on the ballot?
At 5:01 pm, January 9, 2014 in the lobby of City Hall, the City Clerk will conduct a drawing by lot for position on the ballot, in the presence of the certified candidates or their representatives.
Drawings for position will be in the order Declaration of Candidacies are filed in the Clerk’s office.
Either you or your representative should be present to draw for your position. If no one is present to draw for your ballot position, a member of the City Clerk’s staff will draw for the position.
The order of the ballot shall be:
Mayoral candidates (if year of election)
Commissioner candidates – listed in District Order
Municipal Judge candidates (if year of election)
Any question to be placed on the ballot by the governing body
Any question to be place on the ballot from petition
Can I still run for office if I don’t file on January 7th?
If you decide to run for office after the January 7th filing day, you may still choose to run as a write-in candidate.
January 14, 2014, between the hours of 8:00 am and 5:00 pm is the only time the City Clerk can accept a declaration of candidacy for a write-in candidate.
All candidates must file the following documents:
1. A Declaration of Candidacy form; AND

What happens if I change my mind about running for office?
For candidates that file on January 7, 2014 – the deadline to withdraw their candidacy is January 14, 2014. This will remove the candidate’s name from the ballot. If you, the candidate, withdraw after this date, your name will still appear on the ballot. The form to withdraw the candidacy is included in this packet.
For write-in candidates that file on January 14, 2014 – the deadline to withdraw the candidacy is January 28, 2014. The line for the write-in will still be on the ballot, but any votes for the write-in will not be counted. The form to withdraw the candidacy is included in this packet.
Is this a paid position?
The compensation for Commissioner is $7,000.00 per year. The compensation for Municipal Judge is $67,600.00 All elected officials are eligible for City benefits
Where are the polling places for this election?
This election the City is going to implement Voter Convenience Centers. The Election Resolution approved the combining of all Precincts and establishing four (4) polling places conveniently located around the City. A registered voter within the City limits will be allowed to vote at any of the centers.

Certified Candidate Information – Dates to Remember
1. After the City of Clovis Commission adopts the election resolution it will be published twice in the Clovis News Journal. This will notify the public that an election will be occurring and what will be on the ballot.
2. The City Clerk will place the order for ballot information by January 10, 2014 to provide the correct spelling and position on the ballot of each candidate. The candidate’s name will appear on the ballot exactly as shown on the voter’s registration.
3. The City of Clovis Commission will appoint the precinct board members. The list of poll workers will be posted. No relatives of any candidate can serve on a precinct board.
4. All election supplies must be received in the office of the City Clerk by January 28, 2014. Requests for an application for an absentee ballot can be made anytime. The actual absentee ballots cannot be mailed to any person who has submitted and had an application accepted by the City Clerk until January 28, 2014.
5. The Curry County Clerk shall close the voter’s registration books for the municipal election at 5:00 pm on February 4, 2014. If any voter registration occurs after this date, that person will not be eligible to vote in the municipal election.
6. Certification of the voting machines will be completed by February 5, 2014 for the absentee by mail or in paper/voting in person machines. Certification of the voting machines for the regular election will be completed by February 25, 2014. All machine certifications will be done in the office of the County Clerk at 700 Main. As a candidate, you will be notified of the time and place of the certification and are welcome to observe.
7. Election school for all precinct workers will be held by February 27, 2014 at City Hall. As a candidate you will be notified of the date and time of the school and are welcome to attend.
8. February 28, 2014 at 5:00 pm is the last day to vote by absentee in person. This is also the last day to mail absentee ballots from the City Clerk’s office. After 5:00 pm no absentee ballots may be mailed.
9. Election Day is March 4, 2014. Voting times are between the hours of 7:00 am and 7:00 pm. The Presiding Judge and precinct workers at the polling place have control of the election process during this time. You, as a candidate, and the City Clerk may not interfere in any way with the election process.
10. There is no campaigning within 100 feet of the building where the poll is located. There will be no campaign literature within 100 feet of the building.
11. All unofficial election results will be returned to City Hall after each Voting Convenience Center has completed their procedures. The election returns will be given to the City Clerk, who will provide UNOFFICIAL results from the polling place. All candidates or their authorized representatives and the general public are welcome to gather in the Assembly Room at City Hall to wait for the posting of the results.
12. By March 7, 2014 at the City Clerk’s office the appointed board will convene to begin the canvassing of the election results. This will be the OFFICIAL result of the election.
13. A ceremony to administer the oath of office for newly elected officials will be held by 7:00 pm on March 10, 2014.
14. The City Commission shall hold an organizational meeting between March 10, 2014 and March 25, 2014. This may be a regular or special meeting.
ABSENTEE VOTING
Absentee Ballot on Paper Application
The City Clerk shall furnish an absentee ballot application at any time before the election. A voter may request an application for an absentee ballot in person, by telephone or by mail. The City Clerk cannot by law automatically send applications to any qualified elector.
When a completed application is received in the office of the City Clerk, the voter will be verified on the Voter Register List as a qualified elector of the City.
The application may be rejected if:
1. The application is not made on the form provided by the City Clerk.
2. The application does not set forth the applicant’s full name and address.
3. The application does not set forth the applicant’s date of birth.
4. The applicant has already voted absentee.
5. The applicant:
a. Has no valid affidavit of registration on file with the County Clerk and is not a federal qualified elector or federal voter.
b. Has a valid affidavit of registration on file with the County Clerk but is not a resident of the City; or
c. Is a federal voter but is not entitled to vote in the municipal election.
If the application is accepted, the City Clerk shall:
1. Mark the application accepted.
2. Enter the required information in the absentee ballot register, and
3. Issue to the applicant an absentee ballot beginning January 28, 2014.
If the accepted application is received by mail, the City Clerk shall mail the ballot to the accepted applicant.
If the accepted application is received in person, the City Clerk shall hand the voter a ballot. The ballot must be voted in the office of the City Clerk, sealed in the proper envelope and returned to the City Clerk or authorized representative before the applicant leaves the office.
Absentee ballots shall be returned to the office of the City Clerk by mail or in person. If returned in person, only the voter, a member of their immediate family or a caregiver may return the ballot.
Absentee Voting on Machine
February 12, 2014 to February 28, 2014 are the dates for absentee voting in person on machines. Absentee voting will be conducted in the City Clerk’s office Monday through Friday from 8:00 am to 5:00 pm.
When a completed application is received in the office of the City Clerk, the voter will be verified as a qualified elector of the City.
