Colorado has a MEDICAL MARIJUANA (cannabis) LAW

SUMMARY: Fifty-four percent of voters approved Amendment 20 on November 7, 2000, which amends the state’s constitution to recognize the medical use of marijuana. The law took effect on June 1, 2001. It removes state-level criminal penalties on the use, possession and cultivation of marijuana by patients who possess written documentation from their physician affirming that he or she suffers from a debilitating condition and advising that they "might benefit from the medical use of marijuana." (Patients must possess this documentation prior to an arrest.) Patients diagnosed with the following illnesses are afforded legal protection under this act: cachexia; cancer; chronic pain; chronic nervous system disorders; epilepsy and other disorders characterized by seizures; glaucoma; HIV or AIDS; multiple sclerosis and other disorders characterized by muscle spasticity; and nausea. Other conditions are subject to approval by the Colorado Board of Health. Patients (or their primary caregivers) may legally possess no more than two ounces of usable marijuana, and may cultivate no more than six marijuana plants. The law establishes a confidential state-run patient registry that issues identification cards to qualifying patients. Patients who do not join the registry or possess greater amounts of marijuana than allowed by law may argue the "affirmative defense of medical necessity" if they are arrested on marijuana charges.  

Possession/Cultivation: Possession/Cultivation: A patient or a primary caregiver who has been issued a Medical Marijuana Registry identification card may possess no more than two ounces of a usable form of marijuana and not more than six marijuana plants, with three or fewer being mature, flowering plants that are producing a usable form of marijuana. Patients who do not join the registry or possess greater amounts of marijuana than allowed by law may argue the "affirmative defense of medical necessity" if they are arrested on marijuana charges.

State Board of Health Rejects Medical Marijuana Restriction

[pic]DENVER -- On Monday, July 20, the Colorado Board of Health voted down a series of controversial restrictions to the state's medical marijuana law. After over twelve hours of testimony and deliberation the Board voted to reject the changes which would have prohibited those who legally use medical marijuana from appointing a state-licensed caregiver who is already helping five patients and created a new definition of the role of a "caregiver" requiring such individuals to provide services beyond marijuana distribution, such as house cleaning and food preparation. Currently, Colorado caregivers -- those legally designated to provide marijuana for a patient who is unable to produce it due to physical, financial, or other limitations -- can help any number of patients who seek their assistance, and are not required to provide services beyond medical marijuana dispensing.

The proposals were met with vast opposition from across the state, with approximately 1000 opponents attending the hearing. Hundreds testified against the changes including lawyers, doctors, care providers, veterans, and numerous health-care and religious organizations. Approximately ten individuals-- mostly law enforcement-- testified in favor of the proposed rules.

"This is a historic victory for patients' rights and safe access to medicine," said attorney Brian Vicente, who serves as executive director of Sensible Colorado, the non-profit organization which headed opposition to the plan. "People suffering from serious illnesses can continue to select a caregiver of their choice as they do a doctor of their choice. Colorado's sickest individuals have benefited enormously by the Board's compassionate vote."

[pic]Colorado's top doctor backs pot restrictions - 07/20/09 | AP News - Colorado's chief medical officer said Monday the state's medical marijuana program will"continue to grow out of control" unless more restrictive rules are adopted. Dr. Ned Calonge testified before the state health board in support of proposed new rules that would limit marijuana providers to five patients each. Currently, a voter-approved amendment to the state constitution allows designated caregivers to grow marijuana for an unlimited number of patients. Calonge, chief medical officer for the state health department, said those rules are creating confusion and the program is susceptible to fraud.

He said large-scale marijuana growers busted by police are claiming to be medical marijuana suppliers. Calonge also said one doctor recommended that 200 people get medical marijuana cards in one day. The cards allow patients to grow their own marijuana or get it from a designated caregiver. Opponents say the limits would make it harder for patients to get medical marijuana. This provision, while apparently providing for the limitation of cannabis to research purposes only, also seems to allow some latitude for nations to make their own judgments. [pic]Colorado continues to be at the forefront of marijuana policy reform - Last update: September 24, 2008 | A strong history of marijuana policy reform. More than seven years ago, Colorado voters passed a constitutional amendment protecting the rights of seriously ill patients to use medical marijuana in the treatment of certain illnesses as recommended by their doctors. In 2005, MPP grant recipient SAFER spearheaded a successful initiative in Denver that amended city ordinances to remove all penalties for private adult marijuana possession. In 2006, 41% of voters supported SAFER's statewide initiative to make possession of up to one ounce of marijuana legal for adults 21 and older.   Visit -

1. Since 1996, twelve states have legalized medical marijuana use: AK, CA, CO, HI, ME, MT, NV, NM, OR, RI, VT, and WA. Eight of the twelve did so through the initiative process. Hawaii's law was enacted by the legislature and signed by the governor in 2000, Vermont's was enacted by the legislature and passed into law without the governor's signature in May 2004, Rhode Island's was passed into law over the governor's veto in January 2006, and New Mexico's legislation was signed into law by Governor Bill Richardson on April 2, 2007.
