MINUTESJanuary 17, 2019A regularly scheduled meeting of the Town Board was held on January 17, 2019 at 7:00 p.m. in the Board Chambers located at 224 First Street.Item 1 – Roll call and Pledge of Allegiance. Those present and answering roll call: Trustees; Heid, Gentry, Isbell, Ledall, Rohn, Winter and Mayor Ross. Attorney Rocklin was also present. Item 2 – Review of the Minutes of the December 20th meeting. Trustee Isbell moved to approve the December 20th minutes as written, seconded by Trustee Heid. Motion carried 6-0. Mayor Ross then called for an introduction of Faith Smith who has been hired as the Financial Director for the Town of Eaton. Gary gave an introduction. Faith then gave a little history about her past experience at the Town of Berthoud and the City of Fort Collins and her time spent in the private sector. She is very excited to be working for the Town of Eaton and has been out in the community and everyone is very friendly and she looks forward to working here for a long time. Mayor Ross and the board welcomed her aboard.Item 3 – Ordinance No. 590-regarding residential uses in the C-2 Zoning District. Concluding second reading, questions and discussion of Ordinance No. 590, amending Section 7-2-22 of the Eaton Municipal Code to recognize that historically-zoned residential dwelling units that do not have a corresponding nonresidential use constitute a permitted principal use in the C-2 Zone on the condition that the properties continue to be used solely for residential purposes, Trustee Winter moved to adopt, seconded by Trustee Ledall. Motion carried 6-0. Item 4 – Ordinance No. 591-regarding Chap. VIII of Municipal Code to include Sec. VI concerning liquor license. Concluding first reading, questions and discussion of Ordinance No. 591, amending Chapter VIII of Eaton Municipal Code to include Section VI concerning liquor licensing, establishing liquor licensing regulations and assigning administrative functions to the Town Clerk, Trustee Rohn moved to adopt, seconded by Trustee Gentry. Motion carried 6-0. Item 5 – Ordinance No. 592-regarding Sec. I of Chap. V of Municipal Code concerning Municipal Judge. Concluding first reading, questions and discussion of Ordinance No. 592, amending Section I of Chapter V of the Eaton Municipal Code concerning appointment of a Municipal Judge and related provisions, Trustee Isbell moved to adopt, seconded by Trustee Heid. Motion carried 6-0. Item 6 – Resolution 2019-01: Posting Public Notices in 2019. Gary advised, the board must pass this resolution annually according to state law. Concluding discussion Trustee Isbell moved to approve the resolution, seconded by Trustee Ledall. Motion carried 6-0.Trustee Gentry made a motion to amend the Agenda to include Jeff Schreier’s Town of Eaton Employment Agreement for Town Administrator and Eaton Housing Authority Management Agreement. Mayor Ross noted that this amendment will be item 8 on the agenda. Trustee Isbell seconded the motion. Item 7 – Intergovernmental Agreement-Water Treatment Plant Property. Gary gave background information and a handout on how this IGA came about. In 2017, the Group, which consists of Town of Eaton, Town of Windsor, Town of Severance and Fort Collins-Loveland Water District, hired Black & Veatch to do a study on a future water treatment plant and location. There were six sites presented to the Group. In December of 2017 the Group hired Bruce Johnson to investigate and contact the property owners to see if there was any interest in selling their properties, private property owners were not interested. Anheuser-Busch, Inc. owned three of the six properties and owned the preferred site number two. Andy Kline, Principal of Westside Investment Partners was given a letter of intent by the Group to purchase the 150+ acres for $750,000.00 and four days later a counter offer via email with a bottom line of $1,000,000.00 was given. The Group accepted the bottom line and the purchase price will be split equally between the Group at $250,000.00 each. Town of Windsor has signed the IGA, Fort Collins-Loveland Water District will be considering the IGA at the end of January and Town of Severance has the IGA on their agenda for early February. After each entity has signed the IGA they will enter into the Purchase Contract and closing will take place in either April or May. Test Drilling has been ordered at the site to be sure the ground does not hold any surprises. The water treatment plant is projected to be built in 15 to 20 years. Concluding questions and discussion of the IGA concerning purchase of real property for prospective water treatment plant, Trustee Ledall moved to adopt, seconded by Trustee Winter. Concluding questions and discussion of Jeff Schreier’s Town of Eaton Employment Agreement for Town Administrator, Trustee Winter made a motion to accept, seconded by Trustee Isbell.Motion carried 6-0. Concluding questions and discussion of Jeff Schreier’s Eaton Housing Authority Management Agreement, Trustee Heid made a motion to accept, seconded by Gentry. Motion carried 6-0.Item 9 – Citizen comments/questions. None. Item 10 – Reports.Trustee Heid provided an update on the following:Hometown Revitalization Committee Resident Survey sample to be distributed with utility mailing.Great Western Trail will be applying for two more grants next month.Chief Mueller provided an update of activities in the police department as follows:Suspicious death in the 500 block of Cheyenne Avenue.2018 Annual Police Progress & Statistical Summary Report.CSP provided over head lights for two units.Two more units have been ordered.The units have new vinyl decals and are gold and silver.Received a request from police departments of Windsor and Severance, to send a representative to shadow our court clerk and clerk assistant in their procedures to run court efficiently.Two separate shootings in neighboring towns, local agencies in traffic pursuit which is not our policy for traffic violations unless it is BARKS which means Burglary Arson Robbery Kidnapping Sex crimes.Taser re-certification on January 24, 2019, 5 pm to 7 pm.Jeff provided an update on the following:Emergency prep class will be on January 31, 2019 at 7 pm at EAPRD.Met with Chad from Northern Water and toured sites done by Jerry Nelson and he will do a conceptional drawing for the Early Learning Park site. There was a question about the round-a-bouts along CR 74, if it would handle a four lane highway, the answer is yes, and round-a-bouts would be compatible.Avi echoed what Chief Mueller stated: Kathy and Mandy are doing a fabulous job, are very organized, pleasant and make municipal court a lot easier.Gary discussed on the following:Jay Tapia, high school principal, reached out to see if there is anything the town can do by ordinance or fines for kids that are vaping or smoking. Chief Mueller expressed that he would want to discuss the issue in depth since it is on school grounds and what type of infractions that would be given to the offenders.Letter to Jason Brancel at Agfinity, looks like Agfinity is headed towards moving the corporate office out of Eaton, of the 28 employees only 3 live in the Eaton area. Looking to see what they can do to maximize the usage of their office and retail property that they have in town.Trustee Winter provided an update on the Planning Commissioner’s meeting:Had a Public Hearing on Governor’s Crossing and only two community members showed up and asked questions. Questions were answered and after further discussion the board had a motion and approved the plan as is and recommendation to the Town Board which will be at the regular board meeting on February 21st.Trustee Rohn provided an update on the EAPRD as follows:3,058 enrollment, donated 1,200 pounds of food from the Deck the Halls food drive to the Weld Food Bank.MINUTES CONT. – January 17, 2019 - PAGE 3Mayor Ross provided an update on the following:MPO meeting will be hosted by the Town of Eaton at the EAPRD on February 7th at 6:00 pm.Mayor’s Bullseye Meeting in Platteville last Thursday and CDOT was in attendance and they expressed their disappoint in the stoplight and crossing arms not getting opened up because they cannot finalize the road project until the stoplight is on. They are working on letter to submit to The Greeley Tribune and North Weld Herald to let residences know that they have completed all they can until the railroad installs the crossing arms. County Road 72 has been approved by PUC and now waiting on a judge to approve it.January 16th attended a Regional Mayor’s Meeting, 13 mayors and Alo Tele-Communications to increase and improve broadband with fiber optics was discussed.Senate Bill 152 Primer that was passed in 2005 putting all telecommunications under the State control was brought to the table as discussion. Consider bringing this bill to a vote by the community with a special election. Should the town want to contribute to or benefit in directly from internet services then the community would need to vote to opt out of Bill 152. Item 13 – Adjourn.
