The regular monthly meeting of the Board was called to order by the Chairman at 9:30 a.m. in the Conference Room of the Board’s offices, Baton Rouge, Louisiana. Members of the Board present:

Mr. Meredith, Board member, led the members and audience in the Pledge of Allegiance, which was followed by an invocation given by retired Judge Darrell White, Hearing Officer then Judge White introduced himself and advised those present of his duties.
A MOTION was made by Mr. Lambert and seconded by Mr. Weston to accept the Minutes of the September 16, 2010 regular meeting, as prepared. The Motion passed.

◙ Judgment Hearing(s):
Arctic Air by Adam Daniel, L.L.C. (CL #44465)
Administrative Hearing – Consider an alleged violation by Arctic Air by Adam Daniel, L.L.C. of the provisions of Louisiana R.S. 37:2150 - 2192, the Contractors’ Licensing Law, and in particular Section 115, Paragraph C, of the Rules and Regulations of the Board and consideration of applicable penalties therein. This hearing is being called for reason that on information and belief that you have a judgment which was rendered by the Civil District Court for the Parish of Orleans, No. 09-13046, Division “K-5”, Parish of Orleans, State of Louisiana, on the 21st day of July, 2010, in which AB Insurance Company, Adam K. Daniel, Kent J. Daniel, and Arctic Air by Adam Daniel, L.L.C., holder of commercial contractor’s license number 44465, “are condemned jointly, severally, and in solido and were ordered to pay to plaintiff the full sum of SEVENTEEN THOUSAND NINE HUNDRED FORTY NINE DOLLARS AND 05/100 ($17,949.05) plus all court costs and judicial interest from December 16, 2009 until paid in favor of Louisiana Building Maintenance Co., Inc.”
Ms. Kris Fitch read the allegations against ARCTIC AIR BY ADAM DANIEL, L.L.C. then asked if a representative of either ARCTIC AIR BY ADAM DANIEL, L.L.C. or Louisiana Building Maintenance Co., Inc. was present. There was no response from either party.
A MOTION was made by Mr. Weston and seconded by Mr. Clouatre to give ARCTIC AIR BY ADAM DANIEL, L.L.C. thirty (30) days to resolve the outstanding judgment with Louisiana Building Maintenance, Co., Inc. If is matter is not resolved within the thirty (30) days, there will be an immediate revocation of Commercial License Number 44465 held by ARCTIC AIR BY ADAM DANIEL, L.L.C. The Motion passed.
Berthelot Design Construction, Inc. (CL #36633 & RL #87415)
Administrative Hearing – Consider an alleged violation by Berthelot Design Construction, Inc. of the provisions of Louisiana R.S. 37:2150 - 2192, the Contractors’ Licensing Law, and in particular Section 115, Paragraph C, of the Rules and Regulations of the Board and consideration of applicable penalties therein. This hearing is being called for reason that on information and belief you have a judgment which was rendered by the Fourth Ward Justice Court, No. C-10-142, Parish of St. Tammany, State of Louisiana, on the 23rd day of June, 2010, in which Gary K. Berthelot, d/b/a Berthelot Design Construction, Inc., holder of commercial contractor’s license number 36633 and residential contractor’s license number 87415, was ordered to pay in the sum of TWO THOUSAND FIVE HUNDRED TWENTY DOLLARS AND 00/100 ($2,520.00), with judicial percent annum interest thereon from the 23rd day of June, 2010 until paid plus all costs in favor of American Truss, LLC.
Ms. Kris Fitch read the allegations against BERTHELOT DESIGN CONSTRUCTION, INC. then asked if a representative of either BERTHELOT DESIGN CONSTRUCTION, INC. or American Truss was present. Mr. Gary Berthelot, representing Berthelot Design Construction and Mr. Melville Borne, Jr., representing American Truss were both present. Mr. Berthelot came to the stand, was sworn in. Mr. Borne also came to the stand and was sworn in. Mr. Talbot asked Mr. Berthelot if he would be able to resolve this matter. Mr. Berthelot responded yes.
A MOTION was made by Mr. Lambert and seconded by Mr. Clouatre and Mr. Stuart to give BERTHELOT DESIGN CONSTRUCTION, INC. forty-five (45) days to resolve the outstanding judgment with Mr. Melville Borne, Jr., with American Truss Company unless a Stay Order applies. Berthelot Design Construction must get a letter from his attorney or the judge. If this matter is not resolved within the forty-five (45) days, an immediate revocation of Commercial License Number 36633 and Residential License Number 87415 held by BERTHELOT DESIGN CONSTRUCTION, INC. will be imposed. The Motion passed.
C and C Performance Construction LLC (CL #39139)
Administrative Hearing – Consider an alleged violation by C and C Performance Construction LLC of the provisions of Louisiana R.S. 37:2150 - 2192, the Contractors’ Licensing Law, and in particular Section 115, Paragraph C, of the Rules and Regulations of the Board and consideration of applicable penalties therein. This hearing is being called for reason that on information and belief that you have a judgment which was rendered by the 16th Judicial District Court, No. 74773, Division “B”, Parish of St. Martin, State of Louisiana, on the 12th day of July, 2010, in which 1688, L.L.C. and C and C Performance Construction, LLC a/k/a C&C Construction, LLC, holder of commercial contractor’s license number 49139, after the arbitration award was “hereby confirmed and, taking into account payments that have been made by the defendants to petitioner, were ordered “to pay in solido in the full sum of TEN THOUSAND TWO HUNDRED TWENTY FIVE DOLLARS AND 06/100, ($10,225.06), together with legal interest thereon from date of judicial demand until paid and for all costs of the proceedings in favor of Delta Concrete Products, LLC a/k/a Angelle Concrete Group, LLC. IT IS FURTHER ORDERED, ADJUDGED AND DECREED that petitioner’s privilege on the 0.528 acre tract, 1428 Reese Street, Breaux Bridge in Section 40, T9S, R5E in St. Martin Parish be recognized. 1688, L.L.C. reserves all its rights against C and C Performance Construction, LLC a/k/a C&C Construction, LLC.”
Ms. Kris Fitch read the allegations against C AND C PERFORMANCE CONSTRUCTION LLC then asked if a representative of either C AND C PERFORMANCE CONSTRUCTION LLC or Angelle Concrete Group, LLC was present. There was no representative present for C AND C PERFORMANCE CONSTRUCTION. Attorney Craig Kaster, representing Angelle Concrete Group was present. Attorney Kaster came to the stand and stated this is a final judgment rendered by the 16th Judicial District Court on the 12th of July, 2010 in favor of Delta Concrete Products a/k/a Angelle Concrete Group, LLC.
A MOTION was made by Mr. Meredith and seconded by Mr. Clouatre to give C AND C PERFORMANCE CONSTRUCTION LLC thirty (30) days to resolve the outstanding judgment with Delta Concrete Products a/k/a Angelle Concrete Group, LLC. If this matter is not resolved within the thirty (30) days, there will be an immediate revocation of Commercial License Number 39139 held by C AND C PERFORMANCE CONSTRUCTION LLC. The Motion passed.
Spears Consulting, Inc. (CL #48797)
Administrative Hearing – Consider an alleged violation by Spears Consulting, Inc. of the provisions of Louisiana R.S. 37:2150 - 2192, The Contractors’ Licensing Law, and in particular Section 2158, Paragraph A (9), and consideration of applicable penalties therein. This hearing is being called to consider suspending or revoking your commercial contractor’s license number 48797 for reason that on information and belief that you, Mr. Spears, have failed to properly engage in the business of contracting as demonstrated by your prior contracting business experience due to an alleged violation by you of the above statutes. This violation is based on the fact that you, Mr. Spears, as the only incorporator of this company and only qualifying party of Spears Consulting, Inc., holder of commercial contractor’s license number 48797, have a default judgment which was rendered by the Justice of the Peace Court, No. 2010-093, Ward 2, District 2, Parish of East Baton Rouge, State of Louisiana, on the 28th day of June, 2010, in which Spears Roofing & Consulting, L.L.C., an unlicensed contractor, was ordered “to pay in the sum of SIX HUNDRED DOLLARS & 00/100, ($600.00), with 3.75 percent interest thereon from the 19th day of April, 2010, until paid, plus court costs, plus reasonable attorney fees should an attorney be necessary to satisfy this judgment in favor of Bill and Janet Mosley.” This judgment results in problems relating to the ability of the contractor(s), its qualifying party(ies), or any of its principal owners or principal shareholders to engage in the business of contracting, as demonstrated by their prior contracting business experience.
Ms. Kris Fitch read the allegations against SPEARS CONSULTING, INC. then asked if a representative of either SPEARS CONSULTING, INC. or Bill and Janet Mosley were present. Attorney Benjamin Klein and Mr. Raymond Guidry representing Spears Consulting, Inc. were both present. Bill and Janet Mosley were also present. Attorney Klein and Mr. Guidry came to the stand, Mr. Guidry was sworn in then Attorney Klein made a statement. Bill and Janet Mosley also came to the stand, each was sworn in. Mr. Talbot asked Mr. Guidry if he would be able to resolve this matter within thirty (30) days with Mr. & Mrs. Mosley. Mr. Guidry responded yes.
A MOTION was made by Mr. Weston and seconded by Mr. Clouatre and Mr. Dupuy to give SPEARS CONSULTING, INC. thirty (30) days to resolve the outstanding judgment with Bill and Janet Mosley. If this matter is not resolved within the thirty (30) days, there will be an immediate revocation of Commercial License Number 48797 held by SPEARS CONSULTING, INC. The Motion passed.
Warren Construction Company, Inc. (CL #35806 & Inactive RL#85176)
Administrative Hearing – Consider an alleged violation by Warren Construction Company, Inc. of the provisions of Louisiana R.S. 37:2150 - 2192, The Contractors’ Licensing Law, and in particular Section 2158, Paragraph A (9), and consideration of applicable penalties therein. This hearing is being called for reason that on information and belief that both Mrs. Mary H. Rose as only the Fiscal Officer, and you, as the President and only qualifying party, for Warren Construction Company, Inc., holder of commercial contractor’s license number 35806 and inactive residential contractor’s license number 85176 (can still be renewed), have failed to properly engage in the business of contracting as demonstrated by your prior contracting business experience due to an alleged violation by both of you of the above statutes. This violation is based on the fact that you have a judgment which was rendered by the 24th Judicial District Court, No. 666-413, Division “L”, Parish of Jefferson, State of Louisiana, on the 4th day of May, 2009, in which XYZ Insurance Company and Timber Ridge Properties, L.L.C., an unlicensed contractor, was ordered “to pay in the full sum of FORTY EIGHT THOUSAND NINE HUNDRED DOLLARS AND 00/100, ($48,900.00) as general damages and special damages in the full sum of FORTY EIGHT THOUSAND NINE HUNDRED DOLLARS AND 00/100, ($48,900.00) with interest from date of judicial demand until paid and for all costs of the proceedings in favor of Denise Spencer.” This judgment results in problems relating to the ability of the contractor(s), its qualifying party(ies), or any of its principal owners or principal shareholders to engage in the business of contracting, as demonstrated by their prior contracting business experience.
Ms. Kris Fitch read the allegations against WARREN CONSTRUCTION COMPANY, INC. then asked if a representative of either WARREN CONSTRUCTION COMPANY, INC. or Mr. Victor Ray Rose were present. Ms. Denise Spencer with Warren Construction Company was present. Ms. Spencer came to the stand and was sworn in. Attorney Philip Gattuso, representing Mr. Victor Ray Rose and Mr. Victor Ray Rose were also present. Mr. Rose came to the stand and was sworn in. Attorney Gattuso stated he wanted to file documents into the record then requested this matter be dismissed. Ms. Laborde questioned Attorney Gattuso what type of work does Timber Ridge perform. Attorney Gattuso responded that they buy and sell homes.
Board Member questioned Ms. Laborde about the allegations against Warren Construction Company. Ms. Laborde responded the hearing today is against Warren and the basis for that is Mr. Rose, principal in both Timber Ridge and Warren. Ms. Laborde responded in the Louisiana Revised Statutes there is a provision that allows the Board to revoke or suspend the license or take action against a contractor if the principal or shareholder demonstrates by their prior business activities the inability to act as a contractor
Ms. Denise Spencer came to the stand then Judge White asked if Ms. Spencer would like to be heard. Ms. Spencer responded yes then gave her statement.
A MOTION was made by Mr. Lambert and seconded by Mr. Dupuy and Mr. Weston to dismiss the allegations and stated as part of the Motion, if in the future a final judgment is rendered against WARREN CONSTRUCTION COMPANY, INC. then the parties involved in the judgment can request that the matter be brought back before this Board. The Motion passed.
Norman Whitaker (CL #26324)
Administrative Hearing – Consider an alleged violation by Norman Whitaker of the provisions of Louisiana R.S. 37:2150 - 2192, the Contractors’ Licensing Law, and in particular Section 115, Paragraph C, of the Rules and Regulations of the Board and consideration of applicable penalties therein. This hearing is being called for reason that on information and belief that you have a judgment which was rendered by the 19th Judicial District Court, No. C584751, Section 21, Parish of East Baton Rouge, State of Louisiana, on the 23rd day of March, 2010, in which Raw Development, L.L.C. and Norman Whitaker, holder of commercial contractor’s license number 26324 as a sole proprietorship, were ordered “to pay in the amount of SIXTY NINE THOUSAND SEVEN HUNDRED DOLLARS AND 00/100 ($69,700.00), plus attorneys fees in the amount of $5,000.00 and for all costs of the proceedings in favor of Baker Notary Service, L.L.C. IT IS FURTHER ORDERED, ADJUDGED AND DECREED that plaintiff BAKER NOTARY SERVICE, L.L.C., has reserved all rights of action, whatever they may be, against co-defendant RAW DEVELOPMENT, L.L.C. “
Ms. Kris Fitch read the allegations against NORMAN WHITAKER then asked if a representative of either NORMAN WHITAKER or Baker Notary Service, L.L.C. were present. Mr. Norman Whitaker was present. Mr. Whitaker came to the stand and was sworn in. Ms. Joslyn McGhee Johnson with Baker Notary Service was also present. Ms. McGhee Johnson came to the stand and was sworn in. Judge White asked Mr. Whitaker and Ms. McGhee Johnson if this was a final judgment. Mr. Whitaker responded yes.
A MOTION was made by Mr. Clouatre and seconded by Mr. Gallo to give NORMAN WHITAKER sixty (60) days to resolve the outstanding judgment with Baker Notary Service. The Motion passed.

ENGlobal Construction Resources, Inc. (Unlicensed)
Continuance / Settlement Offer Only – Consider an alleged violation by ENGlobal Construction Resources, Inc. of the provisions of Louisiana R. S. 37:2150-2192, the Contractors’ Licensing Law, and in particular Section 2160 (A,1), and consideration of applicable penalties therein. This hearing is being called for reason that on information and belief, ENGlobal Construction Resources, Inc., acted as a contractor to perform work on the South Louisiana Ethanol Plant project in Belle Chasse, Louisiana in the amount of $8,620,336.89 without possessing a Louisiana state contractor’s license.
Ms. Bobbie Hughes read the allegations against ENGLOBAL CONSTRUCTION RESOURCES, INC. then stated that ENGlobal had submitted a counter offer of $5,000.00 plus Administrative Fees. Board Members questioned Ms. Laborde and Ms. Hughes what was the project value on this job and if ENGLOBAL was awarded this job. Ms. Laborde responded the project value was $8,620,336.00, Ms. Hughes responded they were not awarded this job.
A MOTION was made by Mr. Clouatre and seconded by Mr. Stuart to accept the counter offer of $5,000.00 plus Administrative Fees submitted by ENGLOBAL CONSTRUCTION RESOURCES, INC. The Board voted on Mr. Clouatre’s Motion, the MOTION failed.
Dennis Allred (Unlicensed)
Continuance / Administrative Hearing – Consider an alleged violation by Dennis Allred of the provisions of Louisiana R. S. 37:2150-2192, the Contractors’ Licensing Law, and in particular Section 2160 (A,1), and consideration of applicable penalties therein. This hearing is being called for reason that on information and belief, Dennis Allred, acted as a contractor to perform work on the Treads & Care Auto Service project in Baton Rouge, Louisiana in the amount of $536,080.50 without possessing a Louisiana state contractor’s license.
Ms. Bobbie Hughes read the allegations against DENNIS ALLRED then asked if a representative of DENNIS ALLRED was present. Attorney David Carley, representing Dennis Allred and Mr. Dennis Allred were both present. Attorney Carley and Mr. Allred both came to the stand, Mr. Allred was sworn in. Ms. Hughes gave a brief synopsis of the allegations against DENNIS ALLRED then stated that Dennis Allred was pleading No Contest and had submitted a Settlement offer of $4,500.00 plus Administrative Fees.
Mr. Miles Holly, representing Treads & Car Care was also present. Mr. Holly came to the stand was sworn in then was questioned by Board Members on how much work Mr. Allred performed and why the job was stopped. Mr. Holly responded that he terminated the contract with Mr. Allred because the checks Mr. Allred wrote to pay the contractor for the concrete bounced. The concrete contractor called Mr. Holly and that is when Mr. Holly found out that Mr. Allred was not a licensed contractor.
Board Member asked Mr. Allred what name the Permit was pulled in and if the checks from Mr. Holly were made out to Mr. Allred. Mr. Allred responded the permit was pulled in the name of Johnny Coleman and yes the checks were made out to Mr. Allred. Board Member asked Mr. Allred if he was paying the subcontractors. Mr. Allred responded yes. Board Member asked if Mr. Allred represented himself to Mr. Holly that he was a licensed contractor or did Mr. Allred represent to Mr. Holly that Mr. Allred would accepted the checks, even though they were not written to the name the Permit was pulled in. Mr. Allred responded yes.
Board Member asked Mr. Holly how much work Mr. Allred performed before Mr. Holly terminated Mr. Allred. Mr. Holly responded the slab was poured and Mr. Allred was roughly paid between $75,000.00 and $80,000.00. Then Attorney Carley came to the stand and gave a brief statement.
A MOTION was made by Mr. Lambert and seconded by Mr. Gallo to accept the No Contest plea of DENNIS ALLRED. The MOTION passed.
A MOTION was made by Mr. Weston and seconded by Mr. Meredith to assess DENNIS ALLRED a fine of $1,000.00 plus Administrative Fees. The MOTION passed.
Johnny Coleman, Jr. (CL #16865)
Continuance / Administrative Hearing – Consider an alleged violation by Johnny Coleman, Jr. client of the provisions of Louisiana R.S. 37:2158 (A) of the State of Louisiana Contractors’ Licensing Law, and in particular Paragraph 5, in that Johnny Coleman, Jr. has permitted his contractor’s license to be used by another when the other contractor does not hold a license for the classification of work for which the contract is entered at Treads & Care Auto Service, Baton Rouge, Louisiana.
Ms. Bobbie Hughes read the allegations against JOHNNY COLEMAN, JR. then asked if a representative of JOHNNY COLEMAN, JR was present. Attorney Scott Mercer, representing Johnny Coleman, Jr. and Mr. Johnny Coleman, Jr. were both present. Attorney Mercer came to the stand, Mr. Coleman was sworn in. Judge White asked Attorney Mercer how his client was pleading. Attorney Mercer responded his client was pleading No Contest then stated that Mr. Coleman hired Mr. Allred to be his Superintendent on this job. Ms. Hughes stated that JOHNNY COLEMAN, JR. had submitted a Settlement offer of $500.00 plus Administrative Fees. The Settlement Offer submitted by Johnny Coleman, Jr. was discussed by the Board Members.
A MOTION was made by Mr. Lambert and seconded by Mr. Gallo to accept the No Contest plea of JOHNNY COLEMAN, JR. The MOTION passed.
A MOTION was made by Mr. Weston and seconded by Mr. Meredith to assess JOHNNY COLEMAN, JR., a fine of $1,000.00 plus Administrative Fees and that JOHNNY COLEMAN, JR., be placed on probation for one (1) year and if he allows his license to be used again by an unlicensed contractor, Commercial License Number 16865 held by JOHNNY COLEMAN, JR. will be revoked. The MOTION passed.
Falcon Exteriors LLC (Unlicensed)
Continuance / Administrative Hearing – Consider an alleged violation by Falcon Exteriors LLC, of the provisions of Louisiana R. S. 37:2150-2192, the Contractors’ Licensing Law, and in particular Section 2160 (A,1), and consideration of applicable penalties therein. This hearing is being called for reason that on information and belief, Falcon Exteriors LLC, acted as a contractor to perform work on the CVS Pharmacy #5321 project in Baker, Louisiana in the amount of $97,698.00 without possessing a Louisiana state contractor’s license.
Ms. Bobbie Hughes read the allegations against FALCON EXTERIORS, LLC. then asked if a representative of FALCON EXTERIORS, LLC. was present. Attorney John Andrishak, representing Falcon Exteriors and Mr. Kirk Thompson with Falcon Exteriors were both present. Attorney Andrishak and Mr. Thompson both came to the stand, Mr. Thompson was sworn in. Ms. Hughes gave a brief synopsis to the allegations against FALCON EXTERIORS, LLC. then stated that Falcon Exteriors had submitted a Settlement Offer of $2,000.00 plus Administrative Fees. Judge White asked Attorney Andrishak how his client was pleading. Attorney Andrishak responded his client was pleading No Contest.

Section 113. Maintenance of Skills

C. A residential building contractor shall be required to complete in each calendar year a minimum of six (6) hours of continuing education by a provider approved by the Board. Proof of compliance with this requirement shall be filed with the Board annually in the format required by the Board, as a condition for the maintenance and/or renewal of the license. Such filing shall be timely when it is received by the Board, postmarked, or transmitted by facsimile transmission, electronic transmission, or other means of transmittal with a verifiable date stamp, by December 31st of each year.
D. A contractor who has held continuously since January 31, 1996, a valid commercial license in the major classifications of: Building Construction; Highway, Street and Bridge Construction; Heavy Construction; and/or Municipal and Public Works Construction; and who holds a valid current license in said classification(s), shall be exempt from this requirement. For purposes of this exemption only, the term “contractor” as used in this subsection shall include successors of the original contractor, including business reorganizations, name changes, and similar related contractor successions, provided that at least one Qualifying Party for the contractor on January 31, 1996 is a Qualifying Party for the successor contractor in the year for which this exemption is claimed.

Staff Report
Ms. Dupuy distributed to each Board Meeting a packet of information, containing information regarding a mandatory workshop and training for our Investigative Staff and Supervisors on November 17, 2010 with National Regulatory Instructor and Professional Speaker, Tom Hannah, she also distributed an updated Organizational Chart and a listing of the current number of positions – filled, vacant and position reductions within the past two (2) years.
Ms. Dupuy then reported that a monthly Contractors News Source Bulletin that will be distributed on the 15th of each month. A copy was given to each Board Member. Ms. Dupuy reported to the Board that the Louisiana State Licensing Board for Contractors will be entering into a reciprocal agreement with the Kentucky Electrical Advisory Committee. Ms. Dupuy invited all the Board Members to attend the Fall Feast on November 18, 2010, taking place at the conclusion of the Board Meeting. Ms. Dupuy then distributed a listing of Contractor Complaint Statistics from January, 2010 to September, 2010.
