O R D E R

The Delhi Medical Council through its Executive Committee examined a representation from Police Station, Paschim Vihar, Delhi, seeking medical opinion in respect of death of late Geeta Devi, allegedly due to medical negligence on the part of doctors of Malik Hospital, 6, Avtar Enclave, Paschim Vihar, New Delhi-110063, resulting in her death on 27.01.2016 at G.B. Pant Hospital, where she subsequently received treatment.

The Order of the Executive Committee dated 24th April, 2018 is reproduced herein-below:

“The Executive Committee of the Delhi Medical Council examined a representation from Police Station, Paschim Vihar, Delhi, seeking medical opinion in respect of death of late Geeta Devi, allegedly due to medical negligence on the part of doctors of Malik Hospital, 6, Avtar Enclave, Paschim Vihar, New Delhi-110063, resulting in her death on 27.01.2016 at G.B. Pant Hospital, where she subsequently received treatment

The Executive Committee perused the representation from police, written statement of Dr. V.S. Malik, Director of Malik Hospital, copy of medical records of Malik Hospital and other documents on record.

The Executive Committee noted that the medical records of late Geeta Devi who had expired on 27.01.2016 at GB Pant Hospital, and observed that following.

1. She presented with feature of acute cholecystitis on 16.07.2015 at Malik Hospital along with a repeat suggestive of stone in common bile duct.

2. She was referred to Dr. Arvind Khurana for removal of stone from CBD through ERCP and the procedure was carried out by Dr.Arvind Khurana on dated 16.07.2015. Stone was removed, followed by insertion of biliary stent. She was advised to get the stent removed after 6 weeks.

3. Cholecystectomy was carried out at the Malik Hospital on 18.07.2015 and the patient was discharged.

4. She reported to Dr. Arvind Khurana for biliary stent removal after 6 months on 06.01.2016, instead of reporting after 6 weeks Dr. Arvind Khurana removed the biliary stent with difficult as the stent was adherent.

5. She was advised by Dr. Arvind Khurana to report back, if there was abdominal pain, vomiting and fever.

6. Late Geena Devi, instead of reporting back to Dr.Arvind Khurana reported to Malik Hospital where she was admitted with fever, vomiting and jaundice. She was again referred back to Dr. Arvind Khurana for re-stenting. During the procedure Dr.Arvind Khurana found that there was pus oozing out of the papillae.

As the condition started deteriorating, she was referred to higher centre and she got admitted at GB Pant Hospital, where she died on 27th January, 2016.

We are of the view that the patient deteriorated and died because of the biliary cholangitis. This could have resulted from the biliary injury while removing the biliary stent which got adherent to the biliary mucosa because of the late removal of the stent. Whether surgical exploration of the CBD instead of re stenting of the CBD (third time) could have helped the patient is difficult to be addressed at this stage.

In view of the observation made hereinabove, it is, therefore, the decision of the Executive Committee that Smt. Geeta Devi was treated as per accepted professional practices in such cases and primafacie no case of medical negligence is made out on the part of doctors of Malik Hospital in the treatment administered to late Smt. Geeta Devi.

Matter stands disposed.”
