PETITION FOR GRANT OF LETTERS OF ADMINISTRATION

AFTER TWENTY-ONE YEARS PURSUANT TO 20 Pa. C.S. § 3152

TO THE HONORABLE, THE JUDGES OF SAID COURT:

The petition of Jerleine Bailey respectfully states that:

1. [DECEDENT’S NAME] (“Decedent”), died on [DATE OF DEATH], a resident of Philadelphia, Pennsylvania. A true and correct copy of the decedent’s death certificate is attached hereto as Exhibit “A.”

2. Petitioner is [PETITIONER’S NAME], [PETITIONER’S RELATION TO DECEDENT] of Decedent.

3. Decedent was [UNMARRIED/WIDOWED] at the time of [HIS/HER] death and was survived by [NAMES OF SURVIVING HEIRS], who are the heirs of Decedent under § 2103 of 20 Pa. C.S.A. that governs intestate succession.

4. The Decedent’s other surviving heirs, [NAMES OF SURVIVING HEIRS], have signed Renunciation forms, which are attached hereto as Exhibit “B,” renouncing their rights to administer the Decedent’s estate and requesting that Letters of Administration be issued to Petitioner.

5. The only asset in the Decedent’s estate is the real property located at [PROPERTY ADDRESS], Philadelphia, Pennsylvania, [PROPERTY ZIP CODE,] in which Petitioner has been residing.

6. The Decedent’s other surviving heirs, [NAMES OF SURVIVING HEIRS], would like to transfer their interests in said Property to Petitioner.

7. Petitioner needs to probate the Decedent’s estate at this time in order to qualify as Personal Representative of the estate and in order to distribute said Property in accordance with the wishes of the Decedent’s surviving heirs.

8. No Letters Testamentary or Letters of Administration have been granted on Decedent’s estate, and it is now more than twenty-one (21) years since the death of [DECEDENT].

WHEREFORE, Petitioner respectfully requests this Court to enter a Decree directing the Register of Wills of Philadelphia County to issue Letters of Administration to Petitioner, upon cause shown.
