Welcome to the Eighth Judicial District Treatment Court. You have been accepted into this program based upon the Treatment Court Team’s confidence in your ability to successfully complete the program. This means that our community will be making a significant investment in you! You will receive chemical dependency treatment and collateral services to support you in achieving and maintaining an alcohol, illicit drug and crime free life. aimed at breaking your addiction, opportunities to gain new job-related skills, andYou will be supported from a team of well-qualified professionals. In exchange, we expect you to work extremely hard in your effort to emerge as a solid employee, a successful parent, and a valuable member of our community.
This Adult Drug Treatment Court Particiant Handbook is designed to answer your questions and provide overall information about the Treatment Court Program. As a participant, you will be expected to follow the instructions given in Treatment Court by me, and to comply with the treatment plan developed for you by the case manager and treatment team.

OVERVIEW
The Eighth Judicial District Treatment Court seeks to improve the quality of life in our community by establishing a judicially supervised, comprehensive, diversionary treatment program of incentives and sanctions. The Adult Drug Court Program supports criminal offenders diagnosed with chemical dependency in reaching and maintaining a sober and crime free life. aimed at breaking the offender’s drug addiction.
Adult Drug Treatment Court (ATC) is a five-phase, 18 month or longer treatmentintervention program for adults who enter the program through pretrial diversions, guilty pleas, sentencing or probation revocations involving any of the following listed offenses:
CRIMINAL POSSESSION OF DANGEROUS DRUGS, A FELONY, in violation of M.C.A. § 45-9-102;
THEFT, A FELONY, in violation of M.C.A. § 45-6-301, when motivated by drug addiction;
ISSUING A BAD CHECK, A FELONY, in violation of M.C.A. § 45-6-316, when motivated by drug addiction;
DECEPTIVE PRACTICES, A FELONY, in violation of M.C.A. § 45-6-317, when motivated by drug addiction; and
FORGERY, A FELONY, in violation of M.C.A. § 45-6-325, when motivated by drug addiction.
Participants can also quality to take part based on a probation revocation for DRIVING UNDER THE INFLUENCE OF ALCOHOL, A FELONY.
Program eligibility for Defendants and/or Probationers with prior violent or sexual offense convictions, or who have other pending felony charges, will be considered on a case-by-case basis and legal eligibility is not guaranteednot be eligible to take part.
THE TREATMENT COURT TEAM
The ATCis program Team is a collaboration of ve effort between the Great Falls Police Department, the Cascade County Sheriff’s Office, the Cascade County Attorney’s Office, the Cascade County Public Defender’s Office, drug treatment providers, the Montana Department of Corrections Adult Probation and Parole Bureau, the Great Falls Pre-Release Center, the Center for Mental Health, the Alliance for Youth and the Eighth Judicial District Court. By working together, they seek to provide a variety of programs and consistent supervision and accountability geared toward supporting and helping you maintain a drug-free life. Treatment Court involves frequent court appearances, random drug and alcohol testing, as well as group and individual counseling. The Court provides incentives for compliant behavior and imposes sanctions for non-compliant negative behavior. Participants who do not comply with the rules may be placed in short-term custody, moved back to the previous phase of drug court or a variety of other sanctions. They may also be terminated from Treatment Court. All of the staff working with Treatment Court will assist you to be sure you understand what is expected of you.
The Treatment Court Judge will make all decisions regarding your participation in the program with input from the Treatment Court Team. In addition to the Judge, the Drug Court Team consists of the following members:

Prior to the weekly Treatment Court Status Hhearings, the Team members familiarize themselves with your progress (compliance, non-compliance and life issues). The Judge will discuss, as appropriate, compliance and life issues with you so that they and the Judge may discuss that progress with you during yourthe status hearingsession.
TREATMENT COURT HEARINGS
As a Treatment Court participant, you will be required to appear in Treatment Court on a regular basis. The number of times you must appear depends upon which phase of the program you are currently in. Failure to appear will result in a warrant being issued for your arrest and detention in jail until you can appear before the court. If you have questions about your court appearances you may contact your Probation Officer or your attorney. The phases of Treatment Court are listed and explained later in the Participant Handbook.on pages 5-9.
PHASES OF TREATMENT COURT & REQUIREMENTS
The Treatment Court program is a comprehensive 18 month or longer, five-phase, individualized treatment program combined with frequent drug testing and judicial and community supervision.
Your compliance and/or non-compliance with the Drug Treatment Court requirements are subject to the application of sanctions and/or incentives. You will accept judicial sanctions and/or incentives as appropriate. The sanctions and incentives continuum is presented later in your handbook. Application of sanctions and incentives are subject to judicial discretion.
Your progress through the phases of the Drug Treatment Court Program may be delayed or you may be demoted due to any of the following: missed individual or group therapy sessions or office visits, incomplete treatment assignments, positive drug tests, failure to follow through on ancillary service referrals, unexcused failure to appear at any status hearing and/or drugs or drug paraphernalia in your home.
You may be temporarily removed from the Drug Treatment Court Program if you continue to not comply with treatment and/or abstinence from alcohol and other drugs requirements.
You may be terminated from the Drug Treatment Court Program if you conduct drug sales on treatment provider premises; threaten or commit an act of violence against any Drug Treatment Court Team member, staff or peers; are convicted of an offense pre-determined to render you ineligible for program participation or an offense that threatens the public safety; conviction of manufacture, sale or distribution of or use of dangerous drugs; and/or continued lack of progress/compliance.
The following tables outline the requirements and goals for each of the five phases. Your initials on the lines to the left of the tables indicate that you have read and understood this aspect of the program.

CONTINUING CARE
In order to provide you with a continuing support system and to support ensure that you in maintainingcan maintain your valuable sobriety, you will be able to participate in a Treatment Court Program Alumni Group. While the Alumni Group participation is not a Maintenance Phase requirement. d phase of the Treatment Court Program, Upon graduation from the ATC, you will be encouraged those participants who successfully commence from the program are encouraged to continue participatinge in the Alumni Group. Long term sobriety can be attributed in part to continued accountability for each participant and his or her actions. While the Court will no longer be providing accountability upon commencement from the program, the Alumni Group can provide this for those who have completed the Treatment Court Program as well as offer support and encouragement when individuals encounter obstacles or challenges. In addition, this group will act as mentors for any new participants in the Treatment Court program. The Alumni Group servescan stand as examples of the success of the program and testifiesy to the rewards such completion brings. The Alumni Group is asked to attend each commencement ceremony for subsequent participants who successfully complete the program as well as offer support within the community to these participants. Lastly, the Alumni Group may be called upon to attest to the impact of the program on his or her lives at public forums. Please take advantage of this opportunity to prove to the Treatment Court team that you are ready to start your new life as a productive, law-abiding member of society.

TREATMENT COURT RULES
As a participant you will be required to abide by the rules outlined in thise participant contract, including, but not limited to the following:
_____ Totally abstain from the use of illegal drugs, alcohol and/or any mood altering substance.
_____ Inform your treating physician that you are a recovering addict and may not take narcotic or addictive medications or drugs.
_____ Maintain a patient relationship with only one medical provider.
_____ Attend court sessions and treatment sessions as scheduled, submit to random alcohol and drug testing, remain clean and sober and law abiding.
_____ Be on time for all Court appearances.
_____ Do not associate with people who use or possess drugs and/or known felons.
_____ Do not possess any weapons while in the Treatment Court program.
_____ Keep the Treatment Court team, case manager, treatment provider and police officer liaison informed of your current address and phone number at all times.
_____ As a condition of participation in the Treatment Court program, your person, property, place of residence, vehicle or personal effects may be searched at any time with or without a warrant, and with or without reasonable cause, when required by a probation officer or other treatment court team members or contractors.

FEE AGREEMENT
The Treatment Court Program participant will be responsible to pay all fees, fines and/or restitution as directed by the Court and will have an opportunity to “earn down” some fees for excellent program compliance. All participants must establish a payment plan before completion of Phase I of the Treatment Court Program. The Treatment Court Program will enroll any eligible offenders into the Program regardless of their current ability to pay their fees, fines and/or restitution.
1. The Treatment Court Program fee is $15.00 per week throughout the 12-24 or longer month program. The Treatment Court Judge will order the Treatment Court fee and the form will include space for specialized orders.
2. As financial need is demonstrated to the Court and approved by the Court, Treatment Court Program participants may establish an extended or reduced payment plan.
3. As financial need is demonstrated to the Court and approved by the Court, volunteer community service hours, valued at $7.50 per hour, may be credited to partially offset fees, fines and/or restitution.
4. Costs associated with confirmation testing of a urine specimen, if use is not admitted and drug use is confirmed, will be assessed to the participant.
5. Costs associated with additional drug screens assigned to participants as sanctions by the Judge will be assessed to the participant.
6. As financial need is demonstrated to the Court and approved by the Court, Treatment Court Program participants may establish an extended or reduced payment plan.
7. Monetary payments will be made to the Drug Treatment Court Aadministrating agency, Alliance for Youthor. Payments must be in the form of money order or cashier’s check only, no cash or personal checks.
8. Participant’s compliance with payment plans is a Court requirement and will be evaluated in the same regard as compliance with treatment plans and community supervision. Lack of compliance with the payment plan is an offense for which a sanction may be imposed.

TERMINATION FROM TREATMENT COURT
Warrants, new arrests or a violation of any aspect of your treatment plan may result in your being terminated from the Treatment Court Program. Other violations, which could result in termination, include the following:
( Missing and/or positive drug tests;
• Altered drug test;
( Demonstrating a lack of program response by failing to cooperate with the case manager or treatment program;
( Violence or threats of violence directed at treatment staff, other participants of the program or other clients of the treatment providers;
To ensure protection of your due process rights, a termination hearing will take place at which point both the Prosecutor and the Defense Counsel will present termination arguments.
SEARCH AND ARREST REQUIREMENTS
As a participant in Treatment Court, you are required to submit your person, vehicle, place of residence or area to search and seizure of narcotics, drugs or other contraband at any time of the day or night with or without a search warrant, without prior notice and without probable cause by any peace officer or probation officer. Any law enforcement officer who observes a current participant of Treatment Court in any of the following circumstances is authorized to arrest that individual:
• In violation of any criminal law
• iIngesting a controlled substance, marijuana or alcohol;
• Bbeing under the influence of a controlled substance, marijuana or alcohol;
• Ppossessing a controlled substance, marijuana or alcohol or drug paraphernalia;
• Bbeing in the presence of a person in possession of controlled substance(s) and a reasonable person in a like position, would conclude that drugs are present.
Participants detained in jail after arrest will be brought before the a Adult Drug Treatment Court judge for hearing.
DRUG AND ALCOHOL TESTING
You will be drug and alcohol tested randomly throughout your entire Treatment Court Program. Without exception, provision of all urine samples will be directly observed. If the urine drug screen is positive and you do notrefuse to admit to drug use, your urine will be submitted to a SAMSHA certified lab for confirmation testing. If drug use is confirmed, you are responsible for costs of the confirmation test. If you admit to use, confirmation is not necessary and no additional fees are assessed. Urine specimen collection may occur at Adult Probation and Parole offices, treatment provider facilities, the Great Falls Pre-Release Center and/or the participant’s home. Your first urine specimen will be sent to the SAMHSA lab for baseline confirmation of drug levels. This confirmation test is at the expense of the Treatment Court Program and will help the Team monitor your drug use or non-use. The Treatment Court Program expects residual marijuana (THC) to be out of your system within seven to 21 days of non-use. These time frames are based upon national studies of chronic users. As per contemporary drug testing literature and practice, a positive urine drug test after two (2) consecutive negative urine drug test, separated by at least five (5) days will be attributed to new use.
Portable breathalyzer equipment will be utilized to screen for alcohol use. Minimally, a breath analysis will be completed in conjunction with each urine screening.
Each Phase of the Treatment Court Program is assigned a color. You are required daily to call 231-0197 and check the message prior to 10:00 a.m. to determine whether you are to be drug and alcohol tested that day. Upon release from jail you MUST call the Treatment Court phone within one (1) hour of release. The Treatment Court Case Manager will update the voice message daily. The message will inform you of the color (s) requiring drug and alcohol testing for that particular date and by what time and where you should report for testing. If your assigned color is to be tested that day, you MUST report to the Pre Release Center prior to 10:00 a.m. within two (2) hours of calling for testing. Failure to call in or to appear for and complete screening will be considered as a positive test and sanctioned correspondingly.
In addition to the required random testing schedule, Community Supervision and/or Case Management maywill be randomly conducting alcohol and drug testing in both the home and office settings. In the course of completing a home visit, the Great Falls Police Department, the Cascade County Sheriff’s Office, and/or Adult Probation and Parole and/or Case Mangementmay require you to complete observed urinalysis and screening and/or completion of a breathalyzer screening. Failure to submit to screening will be considered as a positive test and sanctioned correspondingly.
If you have a positive test in any treatment court phase, the judge, based on recommendations from the Treatment Court Team, will apply immediate sanctions including time in jail to help you stop your drug using behavior.
COMMENCEMENT
Upon your successful completion of a treatment program and satisfaction of all other court requirements including continued sobriety, you will graduatecommence from Treatment Court and be eligible for promotion to the Continuing Care Phase of the Treatment Court Program. Commencement from the Treatment Court Program is recognized as a very important event. Your loved ones will be invited to join you at a special ceremony as the Treatment Court Team congratulates you for successfully completing Phases I through IV of the Treatment Court Program and achieving your goal to establish a drug-free life.
CONCLUSION
The goal of the Eighth Judicial District Treatment Court Program is to help you achieve a life free of dependence on mind-altering substances. The Judge, court staff and the Treatment Court Team are here to guide and assist you, but the final responsibility is yours. To succeed, you must be motivated to make this commitment to a drug and alcohol free life.
