MINUTES OF A REGULAR MEETING OF THE BOARD OF TRUSTEES OF THE VILLAGE OF AIRPORT DRIVE, MISSOURI

A regular meeting of the Board of Trustees of the Village of Airport Drive, Missouri was held on Thursday, May 28, 2020 at the Village Municipal Building. The meeting was open to the public according to guidelines from the President of the United States, the Governor of Missouri and the Centers of Disease Control and Prevention.

Chairman James Paul called the Board of Trustees to order at 7:02 p.m. Members present were Terry Myers, Mark Rains, Reed Thompson, and Ray Bryant. Village Clerk Sue Hirshey was present to take the minutes. Also present were Village Attorney Derek Snyder, Village Engineer Jerald Norton, and Deputy Clerk Kristy Hoggatt. Jasper County Sheriff’s Officer Sergeant Melissa Roughton was absent, Deputy Justin Henry was present but left before the end of the meeting. Also present were Toby Buckner from GFI Digital, Dan Mitchell, Schuber Mitchell Homes, and Joe Perkins, Carl Junction Fire Protection District Chief. All present gave the Pledge of Allegiance to the Flag of the United States of America. Attorney Snyder gave the invocation.

MINUTES

Minutes of the Board of Trustees Meeting held on April 23, 2020 and the Minutes of the Special Board of Trustees Meeting held on May 5, 2020, having been previously provided to the Trustees, were discussed. Trustee Bryant motioned to approve the minutes previously provided. Trustee Rains seconded the motion. Motion passed unanimously.

TREASURER’S REPORT

Clerk Hirshey presented the Treasurers Report. The Board was provided the Balance Sheet by Fund, Cash Receipts Control Report, Check Register, Accounts Payable Control Report, Payroll Calculation Report, Current Statement of Revenues and Expenses, Recap of Sales Tax Year to Date, and worksheets for Carl Junction Sewer Costs, Building Permits in Progress, Deposits Payable, and Certificates of Deposits for Airport Drive. Clerk Hirshey also noted the two Certificates of Deposits at Southwest Missouri Bank would mature in July of 2020. Trustee Bryant motioned to approve the Treasurer’s Report and to pay the bills. Trustee Thompson seconded the motion. Motion passed unanimously.

OTHER BUSINESS

Engineer Jerald Norton reported the bid opening for Phase One of the Street Overlay Program was held at the Village Municipal Building at 10:30 a.m. on Tuesday, May 26, 2020. Hutchens Construction was the low bidder at a total of $254,950.00. The only other bidder was APAC Central, Inc., with a bid of $370,060.00. Trustee Rains motioned to accept the bid from Hutchens Construction for $254,950.00. Trustee Thompson seconded the motion. Motion passed unanimously.

ATTORNEY REPORT

Attorney Derek Snyder reported a Zoning Commission meeting was scheduled for June 16, 2020 to discuss uses permitted, uses permitted upon review and signage allowed on properties zoned C-4 Compact Planned Shopping Center District. This was at the request of the property owner of 5898 N. Main Street Road, Mark Kersey. Enterprise Car Rental planned to use the property.

William McCaffree, the attorney for the Jasper County Public Water Supply District #1, had been corresponding with Attorney Snyder. Mr. McCaffree sent a letter comparing Jasper County PWSD #1’s current monthly charges with the average rates for 2018 of other cities in Missouri. A copy of the 2018 Missouri Rural Water Association study was included. The average amount charged for 5,000 gallons of water was $50.49. Jasper County #1’s average amount charged was $47.60. Trustee Myers questioned the 47% increase all at once; was there any cap on a rate increase? Attorney Snyder did not think there was. According to Attorney McCaffree, Jasper County’s Board planned to start meeting monthly and was aware they had infrastructure issues; but did not have the funds to make repairs or improvements. Attorney Snyder cautioned the Trustees that if they helped Jasper County financially, they might not have any say in future events. He suggested that if Airport Drive were able to appoint members to the Jasper County’s Board, Airport Drive could be more involved.

Attorney Snyder responded to a request for zoning certification from Street Sotheby’s International Realty for a Medical Marijuana facility at Highway 171 and Fir Road, next to Harp’s Food Store.

Schuber Mitchell/Anderson Engineering applied for three variances from the Board of Adjustment for the preliminary re-plat of Briarwood Subdivision, formerly Fountain Estates Phase 3. The drawing was still being reviewed by Engineer Norton and Zoning Chairman Steve Allgood.

A council bill was provided for discussion to amend Chapter 430, Mobile Homes. The code contained out of date definitions for mobile homes and manufactured homes.

COUNCIL BILLS

Council Bill 10-20, an ordinance amending Chapter 430, Mobile Homes, by amending Section 430.010 and repealing and replacing Section 430.080(F) for manufactured homes and mobile homes inside the Village of Airport Drive was discussed. Trustee Thompson motioned to have the first reading of Council Bill 10-20 by title only. Trustee Bryant seconded the motion. Paul; yea, Myers; yea, Rains; yea, Thompson; yea, Bryant; yea. Attorney Snyder read Council Bill 10-20 by title only. Trustee Bryant motioned to approve the first reading and have the second reading of Council Bill 10-20 by title only. Trustee Bryant motioned to approve the second and final reading of Council Bill 10-20 by title only and adopt Ordinance 10-20. Trustee Rains seconded the motion. Paul; yea, Myers; yea, Rains; yea, Thompson; yea, Bryant; yea. Ordinance 10-20 was adopted.

OTHER BUSINESS

The April 7, 2020 General Election was postponed due to COVID-19 restrictions. The election was scheduled to take place Tuesday, June 2, 2020. A special meeting needed to be scheduled after the election. The Trustees agreed to hold a Special Meeting for after election procedures on Monday, June 8, 2020 at 6:00 p.m. at the Municipal Building.

Bids to replace the office copier were submitted by Office Concepts - $106.15 per month; Lakeland Office Systems, Inc. - $109.00 per month; and GFI Digital - $140.00 per month. Attorney Snyder noted any of the contracts signed for more than one year would be conditioned on approval and annual appropriations made by the Board of Trustees each December beginning December 2020 and thereafter until the end of said lease period. Trustee Rains motioned to accept the proposal from Office Concepts in the amount of $106.15 per month. This included 50,000 black and white copies and 1,200 color copies per year. Trustee Thompson seconded the motion. Motion passed unanimously. Attorney Snyder promised to prepare a council bill for the June 8, 2020 Special Meeting to accept the contract for the 60-month lease.

Dan Mitchell, Schuber Mitchell Homes, appeared to ask the status of the request for three variances for the Briarwood Subdivision, formerly Phase Three of Fountain Estates Subdivision. Mr. Mitchell stated they were ready to go. Trustee Rains questioned three driveways leading to lots #26, #27, and #28. The Board was concerned this would make passage difficult for emergency vehicles, busses, trash trucks, etc. The Trustees asked about the size of lot #18. Attorney Snyder stated these questions were to be explored by the Zoning Commission and Board of Adjustment.

Carl Junction Fire Protection District Chief Joe Perkins updated the Trustees. Topics included COVID-19 policies and procedures, fire hydrants, current ISO rating, and the tax levy proposal on the June 2, 2020 ballot.

Trustee Bryant noted the fireplace needed maintenance. The Trustees instructed Clerk Hirshey to contact Victor at The Fireplace Shop to inspect and repair the fireplace.

CLERK REPORT

Resident Tracy Gilliam Nichols, owner of Jubilee Art Studio, wrote a letter to the Board to express her gratitude for the Economic Stimulus Program and Bingo game.

Republic Services performed the annual Spring Clean Up on Monday, May 2,2020. The Office had not received any complaints or comments from residents.

The ballot for the ½ cent Sales Tax for Police and Fire Protection Services for the August 4, 2020 election was filed with Jasper County Clerk’s Office on May 13, 2020.

Jordan Bolander, Liberty Utilities, reported they would be changing out several meters in Airport Drive to update to auto-reporting meters. Work should begin in July with minimal disruption of service.

As of May 22, 2020, the office had received $1980.93 in payments as credit cards and ACH transactions. A report showing payments, when applied and deposited was included.

The Office had received $785.00 for Steve Hughlett for Tabor Woods sign expenses.

The Census Bureau provided us a link to view the percentage of homes that had responded by state, county, or city to the 2020 Census. As of May 27, 2020, 71.2% of the homes in Airport Drive had responded. Out of the 71.2%, only 34.4% had responded by internet.

Deputy Clerk Hoggatt had finished averaging the water usage numbers for January, February, and March 2020. The billing for the month of May 2020 was calculated using the new averages. The well rate went from 3560 gallons to 3679 gallons per month.

There was a note from July 2019 to ask Aaron Colson about a fireworks display. Would everyone still want to do this? The Board responded yes.

Joplin Industrial Electric replaced the floats in the Fountain Estates Lift Station. Harvey from Carl Junction reported the new floats were working well.

Clerk Hirshey requested two vacation days in June, dates unknown. Trustee Rains motioned to approve two vacation days for Clerk Hirshey. Trustee Bryant seconded the motion. Motion passed unanimously.

The Green Folder contained documents requiring the Chairman’s signature. Items in Gray Folder were provided for information and possible discussion.

REMINDERS

The next Board of Trustee Work Session and Regular Meetings were scheduled for June 25, 2020, at 6:30 p.m. and 7:00 p.m. respectively.

The General Election would be held Tuesday, June 2, 2020.

OTHER BUSINESS

Trustee Rains asked about the mowing normally done by MODOT. It looked like they stopped mid-job. Clerk Hirshey agreed to contact MODOT for more information.

The trees planted between Highway 171 and Leffen Lane were discussed. The developer for the Highway 171 and Fir Road intersection planted pine trees many years ago. The trees did not survive. Trustee Rains motioned to replant trees in between Leffen Lane and Highway 171. Trustee Bryant seconded the motion. The motion passed unanimously. The Trustees instructed Clerk Hirshey to talk to Marvin Heckart about planting the trees. It was suggested to plant the trees in October or fall.

ADJOURNMENT

With no other business to come before the Board, Trustee Rains motioned to adjourn the meeting. Trustee Bryant seconded the motion. Motion passed unanimously.
