A Damage Deposit equal to two (2) months rent is required at time of signing of this agreement to be held by Blank Condominium Association, Inc. as security and be refundable to Boat Owner at the satisfactory termination of the lease agreement and after the removal of the boat from the property of Blank Condominium Association, Inc.

Terms and Conditions of Lease of Dockage Agreement:
1. This Agreement is for use of a Mooring Space only for the above-described boat ("Boat"), and such Mooring Space shall be used at the sole risk of Boat Owner. The Association shall not be liable for the care or protection of the Boat nor for any loss or damage of whatever kind or nature to the Boat, her contents, gear or equipment, or any other property howsoever occasioned.
2. Blank Condominium Association, Inc. shall have a lien against the Boat, her appurtenances and contents, for any and ·all unpaid sums due for use of the Mooring Space or for damage caused or contributed to by the Boat or by the Boat Owner, its guests, invitees or licensees to any other docks or property of Blank Condominium or to any other person at the Blank Condominium harbor. Lessee agrees to pay any and all costs of collection and reasonable attorney's fees incurred by the Association in connection with or arising out of any and all delinquent sums owed to the Association.
3. This Agreement shall continue in effect from month to month, unless sooner terminated as provided below:
a. By destruction of the Mooring Space by fire, storm or any other calamity.
b. In the event that the Boat Owner shall make a bona fide sale of the Boat, in which event the Boat Owner shall immediately notify the Association.
c. Upon ten (10) days written notice by the Association to Boat Owner terminating the Agreement with or without cause.
d. By breach or default by Boat Owner as provided in Paragraph (4) below.
4. In the event Boat Owner defaults in the payment of rent or any part thereof or if Boat Owner shall violate any of the covenants or conditions of this Agreement or any of the regulations governing dockage, then the Association shall immediately be entitled to remove the Boat from the Mooring Space at the Boat Owner's sole risk and expense and to re-enter and retake possession of the Mooring Space. In addition, the Association shall have any and all rights and remedies available to it in law or in equity.
5. Boat Owner shall not use the mooring Space, or any part thereof: or permit the same to be used for any illegal, immoral or improper purposes. Boat Owner shall not make or permit to be made any disturbance, noise or annoyance whatsoever detrimental to the vicinity of the Mooring Space. Boat Owner shall make any and all repairs to the mooring Space if the damage was in any way caused by the fault or negligence of the boat or his guests, invitees or licensees and Boat Owner shall, at the expiration of the term of this Agreement, surrender and deliver said Mooring Space, without demand in as good order and conditions as when entered upon, ordinary wear and tear excepted.
6. Boat Owner shall permit the Association or its agents, at any reasonable time, to enter the Mooring Space for the purpose of exhibiting same or making repairs thereto.
7. Boat Owner shall not assign this Agreement, nor sublet the Mooring Space, or any part thereof, to be used for any other purpose than as above stipulated, nor .make any alterations therein, nor any and all additions thereto, without the prior written consent of the Association and remain upon the Mooring Space as a part thereof, and be surrendered with the Mooring Space at the termination of this agreement.
8. Boat Owner shall, at Boat Owner's sole cost and expense, comply with all statutes, ordinances, rules, orders, regulations and requirements of federal, state .and municipal authorities of any kind and all of their departments and bureaus applicable to the Mooring Space and/or Boat Owner's rental thereof.
9. The Failure of the Association to enforce any provisions of this Agreement shall not constitute waiver of the right to enforce same thereafter.
10. Payment is due monthly in advance to date. There will be a late fee of $25.00 per
month if payment of rental is more than five (5) days past due.
11. Boat Owner shall not make any repairs or maintenance on Boat while it is docked at the Mooring Space, nor, shall Boat Owner wash the Boat with or without a water hose, nor shall any spillage, debris or of any kind be spilled, dropped or swept from the Boat. It is not permitted for anyone to reside on the Boat at any time. No pets are allowed on the premises of Blank Condominium.
12. Boat Owner shall provide the Association at time of signing this agreement, a copy of adequate liability· insurance and vessel registration.
