The following are the guidelines and standards of rules set forth by your Associations’ Declaration of Restrictive Covenants and those Rules adopted from time to time as permitted by the Bylaws of each Association. This document is not intended to be all inclusive of all requirements set forth by your governing documents but should serve as a general overview for members, guests, residents, and invitees. Irrespective of this summary, all provisions of the covenants apply.

Rules & Regulations

Parking:

01. Each Condo owner is allotted ONE parking space under the respective building for which they own a unit. Spaces are not assigned or numbered and available on a first come first serve basis. Each owner shall be issued and must display a valid parking permit in the vehicle parked underneath the building. Guests and additional vehicles must use the other parking areas, not under the buildings.

02. In addition to each Condo owner’s regular parking pass, each Condo owner is also issued one “Reserved” parking permit. These permits can be used to park one additional vehicle under their respective building, in one of the parking spaces marked “Reserved”. The reserved spaces are also on a first come, first served basis, and are very limited under each building. “Reserved” spaces may be used for up to 48 hours, after which time the vehicle must be moved to allow others access.

03. A Condo owner may transfer his/ her parking privileges to his/ her tenant only during the period for which a valid residential lease is in effect.

04. Slip owners who do not own a Condo must use the other parking areas, not under the Condo buildings.

05. Anyone who violates The Shores at Spooner’s Creek parking policy (whether they be a Condo owner, Slip owner, or Non-owner) is subject to having their vehicle towed. If towing should occur, it will be the vehicle owners’ responsibility to contact the towing company directly and the vehicle owner will be responsible for any and all associated fees. The Shores at Spooner’s Creek will contract with Carteret Body Shop, (252) 726-9988 for any necessary towing services.

06. Parking on the cobblestone driveway is prohibited. Slip owners, renters and vendors may use the cobblestone driveway for loading and unloading only which is limited to 15 minutes. Violators are subject to towing.

07. No trailers, buses, campers or RV’s of any type are allowed to be parked on the property. Vendors needing to use a trailer for business purposes may do so only while working on the property and must have permission from the site manager.

08. Parking on the grass is not permitted anywhere on the property, except construction sites.

09. Personal items (e.g. bicycles, kayaks, scooters, skateboards, toys, etc.) may not be left in the parking areas under the condominiums, except in the owners’ personal storage unit.

10. Any vehicle parked on the property must have current registration and license plate. Violators are subject to towing.

11. No repair work or washing of vehicles shall be carried out in the parking spaces except for emergency repairs.

Pets:

01. Pets must be kept on a leash at all times on the property.

02. It is the responsibility of the owner to immediately clean up any pet waste. There are currently two “waste bag stations” for your convenience.

03. Pets are not allowed in the pool area or in the clubhouse.

04. If any pet is determined, in the sole discretion of any Board Member, the Association site staff or Management, to be disruptive or a safety hazard, the owner will be required to remove the pet from the property.

05. Pets over 90 pounds are not allowed on the property.

06. The following breeds of dogs are specifically prohibited: Rottweiler, Doberman, German Shepherd, Mastiff, Boxer, Bulldog, Pit Bull, Chow and Wolf Hybrids.

Pool:

01. All swimmers must be aware that there is no lifeguard on duty and they are swimming at their own risk.

02. Pool hours are from 10 a.m. to 10 p.m.

03. Glass containers are not allowed in the pool area.

04. All trash must be placed in the trash cans before leaving the pool area.

05. No running, horseplay, noxious or offensive behavior will be allowed in the pool area. This includes loud music, excessive noise or screaming, excessive splashing or one group monopolizing the pool area.

06. Persons under twelve (12) must be accompanied by an adult.

07. Everyone must shower before entering the pool.

08. Pool toys must be removed from the pool and pool enclosure when not in use. Toys left unattended will be removed and disposed of by site staff.

09. No one should use any of the emergency equipment (e.g. emergency floatation devices, emergency telephones, etc.) except in an emergency.

10. No diving in the pool. The depth of the pool makes this extremely dangerous.

11. Swimmers using the pool area must access the bathrooms from the outside restroom entrance- not through the clubhouse. Wet bathing suits and towels are not allowed in the clubhouse.

12. Use of the pool is for owners, authorized Condo occupants and their accompanied guests only.

13. Friends and guests of owners may not use the pool or clubhouse unless the owner is present. For example, a person who is a friend of a Shores owner may not use the pool if the owner is in Raleigh. Merely knowing someone at the Shores does not entitle friends to have membership privileges.

Clubhouse:

01. Owners may use the clubhouse after hours but must lock the clubhouse when they leave.

02. The clubhouse is not available to rent. Any owner may have a function in the clubhouse but it cannot be “reserved” so that other owners are excluded from use of the facility. Any member wishing to hold an event/party on the property must have prior approval from the Board of Directors and member will be responsible for timely clean-up. Fire capacity limits must be observed.

03. The clubhouse is not to be used for overnight stay.

04. Persons under 16 are not permitted to use the clubhouse without adult supervision.

05. Wet bathing suits and towels are not allowed in the clubhouse.

Docks:

01. The docks are for the orderly use of slip owners, renters and their guests only. Disorderly conduct by owners, renters, their family or guests will not be tolerated, will terminate lease, and require immediate eviction from slip.

02. Personal items (e.g.. coolers, fishing equipment, etc) are not to be stored on the docks. Any unattended items will be removed. Items such as hoses, electric cords and water softeners should be neatly stored and kept out of walkways. Items that are improperly stored may be removed, at the sole discretion of the Dock master.

03. All slip owners and renters must have current registration information, proof of insurance and emergency contact information on file with the marina office.

04. All lines used in securing vessels must be of adequate size, configuration and in good condition for forecast weather, in the sole judgment of the Dock master, or they may be replaced by Spooner’s Creek Marina at the boater’s expense.

05. Spooner’s Creek is a closed-head marina. No refuse is to be thrown overboard. No dumping of raw sewage into Spooner’s Creek; there is a pump out station located on the fuel dock, which is free of charge. All overboard sewage discharge valves should be closed at all times.

06. Slips are restricted to non-residential usage. Live-aboards are expressly prohibited from occupying slips within the Marina.

07. Spooner’s Creek Marina is not responsible for any losses on or damages to vessels in the marina. Each boat owner or operator will be held responsible for damage which he may cause to other boats in the marina or for damage to any structure in the marina.

08. In the event of a local hurricane classified by the National Weather Service as being higher than a Category 2, all boats must be removed from Spooner’s Creek Marina immediately.

09. No satellite dishes or antennae may be affixed to pilings, docks, bulkheads, or other common property within the Marina.

10. No open fires, including outdoor cooking activities, shall be permitted anywhere on the Common Elements except in such areas as may be designated for such purposes, from time to time by the Board of Directors.

11. Owners are entitled to lease or rent their slip, however all leases must be in writing, using lease form provided by marina management. Leases shall not be for a term less than one (1) month, and management must be given names, contact information, boat registration information and proof of insurance for all tenants by the owner of the slip.

12. Recreational swimming is not allowed in the marina at any time.

13. Owners shall assure the Spooner’s Creek Dock master has ready access to the interior of each vessel.

14. Fish cleaning is permitted only in the designated fish cleaning station, or on Owner’s boat.

15. Owners shall maintain a “Named Perils” or “All Risk” marine hull insurance policy for the value of the owner’s boat, and a third party liability policy of not less than $300,000 per occurrence for death, bodily injury and property damage.

16. Boat owners shall maintain their boats in a safe and operable condition. Inoperable boats shall not remain at SCM. Vessels shall be in a seaworthy condition and not constitute a fire hazard or they will be removed from the marina by SCM at the boater’s expense.

17. Slip owners are responsible for their tenants (renters) compliance with all rules, bylaws, and restrictions of any of the Associations at The Shores at Spooner’s Creek Marina.

18. Boats docked at SCM are prohibited from taking on fuel from fuel delivery trucks, due to environmental and liability issues. Fuel may be purchased at the SCM Fuel Dock.

19. Commercial fishing boats, boats for hire and other types of commercial craft will not be permitted, except by permission of SCM.

20. Contractors, service organizations or individuals are permitted to service vessels at the Owner’s request so long as proof of workman’s compensation and general liability insurance can be shown to be in force upon request of the SCM staff or Management upon signing in with the marina office.

21. Major structural repairs or refitting of vessels is prohibited. Minor repairs, mechanical adjustments, electrical work and touch-up painting are permitted. Owner of vessel shall be held responsible for any damages he or contractor may cause to other boats or Common Elements as a result of any repairs or touch-up painting.

Condominiums:

01. All units are to be occupied for single family residential use only.

02. No unit may be conveyed or transferred as a time share.

03. Any changes to the exterior of the condominiums (e.g. walls, windows, doors, balconies etc.) such as painting or any other changes are prohibited without specific written approval by the Board of Directors.

04. No clothing, towels, or linens shall be hung on the balcony railings.

05. No signs are to be displayed in the common areas, external walls, docks or pilings, including “for sale” or “for rent” signs, unless authorized by the Board of Directors.

06. The storage of any personal items in any common areas is strictly prohibited.

07. No open fires, including outdoor cooking activities (no propane, kerosene, or charcoal grills or appliances) are allowed on the patios, balconies or Common Elements, except in such areas as may be designated for such purposes, from time to time by the Board of Directors. Electric grills and appliances are permitted.

08. Persons twelve (12) years old or under must be accompanied by an adult at all times and should not be allowed to play in the hallways, corridors, stairways, etc.

09. Garbage should be disposed of promptly in the receptacles located under the condominiums.

10. Drapes or shades covering windows in a unit must be backed with white lining.

11. Owners, residents, and guests should be conscious of noise levels in the common areas as well as in their units and not disturb or interfere with other members’ rights, comfort or convenience.

12. Satellite dishes and/or transmitting antennas are not permitted to be installed on any part of the Unit or Common Elements.

13. Owners are entitled to lease or rent their unit, however, all leases must be in writing, leases shall not be for a term less than one (1) month, and Management must be given names and contact information for all tenants by the owner of the unit.

14. Condo owners are responsible for assuring that their tenants have knowledge of and comply with all rules and regulations.

Smoking:

01. “No smoking” applies in the clubhouse, pool area, elevators, elevator lobbies, stairwells, entry ways of units and under building parking areas.

General:

01. Skate boards and bicycles are not allowed to be ridden on the docks, walkways, parking areas or under the buildings. Additionally, skate boards, roller blades, etc., are not allowed to be ridden on the cobblestone driveway.

Security:

01. All service personnel and vendors are required to sign in and out at the office. A log will be maintained to ensure the Association knows who is on the property at all times. This will apply to all service personnel and vendors for residences or boats.

02. Gate procedure: The auto gate will be closed from sunset to sunrise. All access after hours will be by individual access code. Construction general contractors will be issued an individual project access code for sub-contractors during the construction of each project.

03. General contractors will be responsible for all workers and sub-contractors knowing and complying with all applicable rules and regulations.

Compliance and Penalties:

01. Failure to comply with the Rules and Regulations may cause a fine to be levied against the owner. Fines may vary from $100 or more per occurrence or per day to be determined by the Board of Directors after notifications and possible compliance or remediation period.

02. It is ultimately the responsibility of the owner of the unit (Condo, Slip and/or Lot) to ensure that their family, guests, tenants or invitees are aware of and follow these rules. Should any violations or damages occur, the owner shall ultimately be held responsible.

03. The Shores at Spooner’s Creek Staff, Management Company, and any Board member shall have the authority to enforce these rules. It is the responsibility of the Unit owner to come into compliance with these rules, once notified of any violation within the time frame given in such notice.
