The meeting of September 9, 2005 was called to order by Laurence A. Vallieres, Chairman, at 8:34 a.m. in Room 117 of the State Office Building, 165 Capitol Avenue, Hartford, Connecticut.

REVIEW MINUTES OF PREVIOUS MEETINGS
The Board voted unanimously to approve minutes of the July 15, 2005 and August 12, 2005 special meeting.
APPEARING BEFORE THE BOARD
Stewart W. Jaeger – Requesting to appear before the Board to discuss the requirements for
a (V-7) Master Antenna Installation and Repair Dealer license.
Ms. Jaeger appeared before the Board today concerning the definition of the word
“receiving antenna”, which appears to be used as meaning any activity in the field involving an
antenna. Mr. Jaeger suggested that the antenna, because of its nature of being a transmitting
device, that its operations and characteristics follow the realm of the FCC. Mr. Jaeger further
suggested that installation of antennas that are under control of the FCC should not be under
the jurisdiction of the State.
Mr. Hurlburt stated that the FCC regulates the air ways and that any transmission device
adjustment that would affect the air ways would require a license issued by the FCC.
However, DCP’s position is that it regulates the actual physical installation of antennas.
Joseph Daniele – Requesting to appear before the Board to present his qualifications to sit
for the (T-1) Limited Electrical Contractor exam. Mr. Daniel’s application was returned by DCP
on 7/7/05 due to lack of required (T-2) Limited Electrical Journeyperson license for a minimum
of two years and lack of notarized statements from occupational related employers as to the
dates and duties of employment.
Mr. Daniele appeared before the Board today and expanded on his training & experience
as a public service license holder. The Board voted to approve Mr. Daniele to sit for the
(T-2) Limited Journeyperson examination only. Board member Douglas A. Reid was opposed.
Jonathan Love – Requesting to appear before the Board to present an application package
for their review. Mr. Love appeared before the Board at their 7/15/05 meeting, requesting a
waiver of apprenticeship completion due to a medical injury. The Board denied his request
due to lack of required occupational related experience.
Mr. Love was a no-show at today’s meeting. No action was taken on this matter.
REQUEST FOR EQUIVALENT CONTINUING EDUCATION CREDIT
Timothy J. Marley, (T-2) Limited Electrical Journeyperson – Requesting equivalent continuing education credit for participating in a 3-year Certified Technical Specialist course and a School of Audio Visual Technologies course.
The Board voted unanimously to deny Mr. Marley’s request.
CONTINUING EDUCATION WAIVER REQUEST
Eddy Kriskey, (E-1) Unlimited Electrical Contractor – Requesting renewed license mailed to his mother’s home in Georgia and continuing education alternatives for his 2007 renewal. Mr. Kriskey is caring for his mother due to a serious medical condition and is not certain if he will be in Connecticut for the 2007 license renewal period.
The Board voted unanimously that no action was required on this matter.
Alexander R. Penkoff, (E-2) Unlimited Electrical Journeyperson – Requesting waiver of continuing education due to a medical condition.
The Board voted unanimously to deny Mr. Penkoff’s request. The Board further unanimously concluded that Mr. Penkoff has upto one year to renew his license, contingent upon paying the license fee of $60.00, proof of continuing education, and a late fee of $10.00 if license is renewed thirty days after the due date of 9/30/05.
Kyle F. Pettinga, (E-2) Unlimited Electrical Journeyperson – Requesting waiver of continuing education due to a medical condition.
The Board voted unanimously to deny Mr. Pettinga’s request. The Board further unanimously concluded that Mr. Penkoff has upto one year to renew his license, contingent upon paying the license fee of $60.00, proof of continuing education, and a late fee of $10.00 if renewed thirty days after the due date of 9/30/05.
CORRESPONDENCE
Gary R. Gauthier, (E-1) Unlimited Electrical Contractor – Letter dated 7/8/05 from
Douglas Gauthier (Gary’s brother / power of attorney), requesting continuing education alternatives due to Gary’s incarceration. Gary will be eligible for parole in May 2006.
The Board voted unanimously to deny Mr. Gauthier’s request.

Related to this matter, the Board further voted “Without Prejudice” to dismiss any action taken against Kevin Thibadeau. Board Chairman Laurence A. Vallieres recused himself from participating on this matter and Board member Ronald Bish abstained from voting on this matter.

Board Chairman Laurence A. Vallieres recused himself from participating on this matter and appointed Board member Roger L. Johnson, Jr. as Acting Chairman on this matter. Attorney Santoro provided the Board with the respondent’s memorandum as well as his own memorandum in response to respondent’s memorandum for their review. After further discussion and oral arguments on this matter, the Board voted unanimously to deny the respondent’s motion to dismiss or revise. The Board voted unanimously to a Stipulation consisting of a Cease and Desist Order, and a Civil Penalty in the amount of $16,000.00.
CONTINUING EDUCATION
Board Chairman Laurence A. Vallieres reports on feedback received from both schools and licensees relative to class sizes, course content, and conduction of course. An open discussion ensued concerning all relevant issues concerning continuing education in order to assist the Board in establishing its continuing education curriculum for 2005-2006.
Some of the issues of concern were that many course takers don’t adhere to what is covered in class and are not informed of the necessary statutory information, which is evident within the number of complaint received by DCP.
The Board voted unanimously to accept the following continuing education curriculum outline for 2005-2006:

1. All of the following curriculum materials shall be submitted in a properly indexed 3-ring loose-leaf binder to the Commissioner of Consumer Protection and the Electrical Work Examining Board for approval. Provide at least 4 copies for review and approval.
2. All curriculums to be used and distributed in class shall be provided in a “bound “ format for the license holder attending the class.
3. All license holders attending classes shall be required to have their own copy of the 2005 National Electrical Code. This will be used for 3 years.
4. As a condition of approval, In addition to the NEC 2005 each provider shall select from the following approved list of reference books, which reference book they will use in their classes. All license holders will be required to purchase one of the following as determined by the school and bring with them their own copy for each class. This reference will be used for 3 years.
• “Significant Changes to The NEC 2005 Edition” as published by THOMSON DELMAR LEARNING
• “Stallcup’s Illustrated Code Changes 2005” as published by NFPA
• “NEC 2005 Analysis of Changes” as published by NFPA
5. Each provider shall provide for their instructors the following reference books for use at each class. (Attendees will not be required to purchase these publications)
• “Applied Codeology” Understanding the 2005 National Electrical Code as published by THOMSON DELMAR LEARNING
• “OSHA Regulations” (29CFR Part 1926)
• “NFPA 70E” Standard for Electrical Safety in the Workplace, 2004 Edition, as published by NFPA
6. All material used in class as it relates to Connecticut General Statues, OSHA, and the Related Building Codes shall be in bound format for distribution to each attendee.
7. Providers shall obtain and submit written proof of authorization to copy any material that a provider may copy and distribute that is copyright protected.
8. Providers shall submit for approval all calculation materials that shall be used in teaching Chapters 2 and 3 of the 2005 National Electrical Code.
9. It is the intent of this curriculum that the instructor and attendee have good interaction of the National Electrical Code, particularly in those areas where calculations are required. Multiple calculations of all applicable materials must take place.
